HomeMy WebLinkAbout5069 961 Route 28 Letter of Opposition 3Fallon, Dolores Subject: FW: Zoning Board of Appeals - Harborside Suites From: Cheryl Ball Sent: Thursday, January 11, 2024 9:29 AM To: Fallon, Dolores <dfallon@yarmouth.ma.us> Subject: Zoning Board of Appeals - Harborside Suites Dear Ms. Fallon, RECEIVED BAN 11 202� YARMOUTH BOARD OF APPEALS understand that there is an agenda item on tonight's Zoning Board of Appeals meeting to discuss the Harborside Suite's violation of the transient occupancy/short term occupancy bylaws of the Town of Yarmouth. I am writing to implore the Board to enforce our bylaws as written. The Governor of the Commonwealth, Maura Healy, has wielded considerable executive power to address the so-called "migrant crisis." She has reportedly done so under legal authority described as "emergency powers." State of emergencies should be reserved for natural disasters and extreme circumstances such as the COVID-19 pandemic, not for disasters that have been created by our own federal government. The powers being mandated by Healey override local zoning and require significant expenditure of taxpayer money to provide housing, clothing, food, transportation, and healthcare. Furthermore, they place a burden on our Town to shell out additional monies toward education, translation services, and emergency services. The offering of these services comes at the expense of our own citizens. Allowing children to enter schools unvaccinated and delayed testing for contagious diseases presents a health risk to our community. Whether or not that risk manifests in an actual contagion does not negate that the risk exists. Without presenting legal ground or statute, or citation of an appellate case, any enforcement of Healey's orders that bypass our Town laws seems unconstitutional. Finally, I would like to address the hotel owners. While I don't fault them for pursuing their right to earn a living, I do fault them for doing so with a lack of regard for the impact that their actions have on our local residents.
