The home is listed on the National Register of Historic Places. The Chase family owned the home from 1891 to May 1980. My wife (presently ex-wife) and I purchased the house May 1980 for $67,500.00 a cash transaction. My ex-wife and I, sold the house to Richard A. and Jane M. Crecco, August 7, 1998, for $230,000.00, once again a cash transaction. The absence of third party financing precluded home inspection for insect damage, lead paint, benzene, DDT, Chlordane, Flit, Triox, naphtha, carbon tetrachloride, trichloroethylene, kerosene, potassium cyanide, and other chemicals, pesticides, insecticides, herbicides used or stored in the cellar, interior coal bin, or detached garage/grease pit /workshop/hen house. It would be prudent to investigate the Crecco's prior mortgage applications with Option One Mortgage, H&R Block Co., Countrywide Financial Corp, Centex, First Franklin, Wells Fargo Bank, for accuracy of information/data. The creation of the Crecco Family Investment Trust February 5, 2010, and concurrent homestead estate declaration February 5, 2010, violated Massachusetts's individual/family homestead estate laws as written. The Massachusetts legislature approved `entity/ nominee trust' versus `family' homestead estate protection December 16, 2010. There appears to be an ongoing pattern of premeditated misunderstandings surrounding the juxtaposition of home, business, investment trust; and profit center. January 3, 2011, I spoke with Elizabeth Hartsgrove X1270. She explained the investigation had been referred to Brian Heaslip, in the Health Department. November 10, 2010 Town of Yarmouth 02!n 1146 Route 28 South Yarmouth, MA 02664 m Dear Mr. Lawton: This letter is memorialize my concern with The Town of Yarmouth's autonomous departments abstinence in securing an administrative search warrant for (non criminal) civil violations. Elizabeth Hartsgrove's enclosures present the health department being unwilling to investigate soil/ground water pollution independent of the building department. The electrical inspector remains mute. The town attorney could provide each department with legal guidance in securing a civil search warrant and activating the "Code Impact Enforcement Team". If the individual departments are rebuffed in district court; the Town of Yarmouth's various departments would be absolved of responsibility. Is Mr. Brandolini unwilling/unable to perform effectively as a department head? Prior statements of `neighbor only reports' were in error and obviously self delusional confabulation. September 22, 2010 n Town of Yarmouth 1146 Route 28 South Yarmouth, MA 02664 Dear Mr. Lawton: This letter is to memorialize my concern with Mr. Brandolini's inability to distinguish between a criminal search, initiated by law enforcement employees, for violation(s) of criminal codes i.e. weapons of mass destruction, explosives, anthrax, illicit drugs etc. An administrative search is initiated by civilian employees for (non -criminal) municipal/state code violation(s) i.e. plumbing, health, electrical, building departments etc. Please refer Mr. Brandolini to the town attorney for a comprehensive manifest of administrative search articles, including the `Code Impact Enforcement Team's authority/responsibility(s) and the search of private residence(s). I, am not an attorney. From past interaction with various town departments a criminal search cannot be expanded into an administrative search. I received your September 17, 2010 letter sans enclosures. I suspect the missing documents would constitute improperly acknowledged correspondence based on Mr. Brandolim"s misunderstanding of criminal verses administrative search warrant(s). In addition to the health department the wiring/electrical inspector should be alerted to potentially dangerous conditions in the garage/house wiring, at 9 Homer Ave., South Yarmouth. July 19, 2010 Town of Yarmouth 1146 Route 28 South Yarmouth, Ma. 02664 Mr. Lawton: (1) Please have Mr. Brandolini define `neighbor'. oD (2) Please explain why report(s)of code violations are only valid if reported by a `neighbor' and not by a passer-by, visitor, tourist, or other town department. (3) Is the `neighbor' only reporting policy uniform for police, fire, `911', D.P.W. reports? (4) Proximity is a valid argument for noise and noxious fumes as each dissipates over distance. Structural damage, pollution, and fire hazards do not dissipate with age or distance. The Yarmouth building department regurgitates a chronology of permits and inspections at 9 Homer Avenue, South Yarmouth. The prior inspections have been external reviews. Internal inspection would document ongoing violations. A more all inclusive inspection should be conducted by The Code Impact Enforcement Team. The necessary investigative instrument is an administrative search warrant. The listing real estate broker Coldwell Banker Joly Mcabee &Weinert, present "Needs `tic' but lots of charm". The previous broker Kinlin Grover advocated tear -down. It is critical to rectify the contaminated soil and potential ground water pollution emanating from the grease/oil drip pit in the free standing garage. The petroleum impregnated soil poses both health and fire hazards. Presently, the building is being used to store commercial landscape equipment, supplies, and associated fuel and oils The electrical panel within the garage comprises a patchwork of internal wiring, of various age, insulation, capacity, and wire gauges. The panel should be protected from the elements and should have been upgraded to code as part of the prior permitting processes. The garage was constructed during the Chase family's tenure at 9 Homer Avenue. Neighbors Robert C. Newell (269 Main Street), and Diane Benoit Ryan (1 Homer Avenue) will attest to the garage's existence during their respective childhood's (1950's). Previously the Chase House was erroneously presented as a preexisting non -conforming multi -family dwelling (#9 & #913). The current owner is once again confabulating. It is my pro -forma prediction the garage will be discreetly transformed into a preexisting non -conforming cottage. The metamorphous began with the removal of a `black top' driveway from Homer Avenue to the garage and a new tire track path from Pleasant Street to the side of the now isolated building. Future financial hardship will necessitate subdivision of the .97 acre lot and there will be two separate residences at the intersection of Pleasant Street and Homer Avenue. What is The Town Of Yarmouth's position on operating a business, specifically Leaves Of Grass from a residential historic site. Town of Yarmouth internal databases, excise tax and voter registration, would document my address; additionally January 2003, conversations between your office, Mr. Leiter, Mr. Allaire, and myself, regarding snow removal substantiated my street address. There are multiple competing telephone directories serving Cape Cod, each with distinct closing and delivery dates throughout the calendar year. It is unclear which directory, and year you relied upon. The Verizon, June 2006, `Hyannis area white pages' edition documents my residential listing (name and address 508 394 4040) on pg. 200. Further investigation of Verizon's 2006 telephone white pages directory documents a residential listing for (Crecco Richard 9 Homer Av. Yar 02664 508 398 6054) pg. 122, and a white pages business listing for (Leaves Of Grass 9 Homer Av. Yar 02664 508 398 4075) pg. 301, additionally there is a business yellow page listing for I (Leaves Of Grass 9 Homer Av. Yar 02664 508 398 4075 LANDSCAPE -DESIGN) pg. 223. The Verizon telephone directory has been an invaluable resource documenting a business operating from the "Chase House". Possibly Yarmouth's "Code Enforcement Impact Team" should be deployed to investigate multiple civil/criminal violations. Mary Claire (508-398-223 1 X292) suggested contacting Ms. Gloria Smith, of The Yarmouth Historical Society. Ms. Smith, presents she is aware of the "Chase House" and its historical significance. Ms. Smith, agreed to contact Ms. Priscilla Gregory, also affiliated with The Yannouth Historical Society, to initiate investigation of altered use and demolition of a building listed on The Historical Register. In addition to the building permit/demolition issue there is an ongoing predicament of a business operating from a residential historic site. Sunday, January 21, 2007, I observed two males removing asphalt shingles from the roof at 29 Venus Road. No building permit was displayed. I telephoned the Building commissioner's office January 22, 2007, leaving a voice message, in the early afternoon. Monday evening there was a dusting of snow; the re -shingling work was completed January 24, 2007, with sealer and shingles over wet plywood. January 12, 2007, I was driving on Pleasant St. and noticed the rear 113 of the garage at 9 Homer Av. had been removed. I spoke with `Jane' at the Yarmouth Building Department January 17, 2007 (approx. 9:33 am), she presented a building permit for re - shingling the garage roof had been issued January 16, 2007.1 explained 1/3 of the garage was removed, that the "Chase House" is on the Historical Register. January 18, 2007 ( approx. 9:40 am) again contacted `Jane', she agreed to having a building inspector visit 9 Homer Av. January 19, 2007 (approx. 3:20 p.m.), I again contacted the Yarmouth building inspector's office speaking with Ken Bates, who agreed section of the garage had been removed. The barn door's timber framing was on concrete block and mortar foundation with brick and mortar corner posts/foundation. The floor was construct DIb� n XE concrete slabs, inspector Bates, compared the concrete sections to patio blocks. In or D Bates, posed the question of having the demolished section of building reconstructed. Unquestionably the house and remaining garage would not conform to current building codes. The garage having a partial foundation and a concrete garage floor surrounding a `grease/oil drip pit'. The issue is not with current building codes; but with preservation of historic areas of Yarmouth. More specifically homes and buildings in South Yarmouth Village documented on The National Historic Register. A similar situation, occurred with a small out building located at 279 Old Main St. Ms. Acheson was denied a demolition pennit. A compromise was reached; the building was relocated to the Bass River Yacht Club property and Ms. Acheson, was granted a building permit for replacement of a garage/outbuilding. The Town of Brewster has taken both civil and criminal action(s) with clear cutting woodlands without proper permits. Provincetown presents a daily fine structure for building demolition under a remodeling permit. Unequivocally an individual applying for a building permit to re -shingle a roof understands Yarmouth's building codes and should be held responsible for intentionally misrepresenting the application to cover- up destroying part of an historic home site. The `Theophile Rose Garden House', 243 Old Main St., retains non -operating water tower, reinforcing the letter and spirit of the Yarmouth Historical District. The Town of Yarmouth has twice rebuilt the Judah Baker Windmill and is making strides to upgrade Packet landing. The former Bass River Savings Bank is being transformed into The Yarmouth Cultural Center. Possibly inspector Bates, is not familiar with historic home sites. Carabrant, Jr. January 10, 2010 South Yarmouth Association PO Box 533 South Yarmouth, Ma. 02664 Gentlemen; This letter is to chronicle my concern with the proposed sale of the `Chase House' 9 Homer Ave. South Yarmouth. The listing real estate broker, Kinlin Grover GMAC Real Estate (f.k.a. Harrison Associates), presents "tear down" as a selling point for the .93 acre lot. This option falls outside the mission of The South Yarmouth Association to "preserve and enhance the residential character of our neighborhoods" and preservation of structures/buildings on the National Historical Register. The Town of Yarmouth issued a building permit January 16, 2007, specifically to re -roof the free standing outbuilding/garage. The project expanded unilaterally into adding two skylights expanding the roof area, removing casement windows, side wall shingles, and the rear one third of the garage. The work perforated extraneous to the permit has never been completed. What is the status of the three year old building permit? Would a lien be an effective means to compel reconstruction? Unequivocally there is a pattern of premeditated misunderstanding(s) associated with the current tenure of this historic property. The Town of Yarmouth Building Department's selective enforcement of building codes appears to function as an enabler, to the detriment of the Association and the taxpayers. Physical inspection presents roof leaks in the residential dwelling, as evidenced by open sheet rock joints and tape hanging/drooping from the ceiling of second floor hall.
