The site consists of a developed 15,017 s.f. lot, improved with a five-bedroom single family dwelling which was constructed in 1987 according to the assessor's records. The site is surrounded by residences and bordered to the east by a Bordering Vegetated Wetland. A portion of the site is also within Land Subject to Coastal Storm Flowage (LSCSF) Flood Zone X (500 year). The site does not lie within Priority or Estimated Habitat in accordance with the latest Natural Heritage map {2017). This property is subject to a recent enforcement order for unpermitted vegetation removal and re- grading within the buffer zone to the BVW. As part of this filing the full 50' buffer to the BVW is proposed to be revegetated. Crawford Land Management has been retained to develop a mitigation/restoration planting plan and narrative which is included as part of this filing. A work limit line of staked silt fence is proposed as shown on the plan. Bordering Vegetated Wetland {310 CMR 10.55) The Bordering Vegetated Wetland was flagged by Brad Hall of BLH Environmental Consulting and located by Down Cape Engineering. All hardscape is proposed outside of the 50' buffer to the BVW. A trench drain is proposed along the low side of the sport court that leads to a 3'x15' leaching trench to help capture any stormwater runoff. No adverse effects from the work are expected, as the work limit line shall remain staked in place until all work is complete and the site is stabilized. The BVW will continue to act fully in its capacity to provide habitat and food sources for wildlife. The proposed mitigation/restoration plantings will help offset the increase in hardscape within the buffer and will provide expanded protection for the BVW. land Subject to Coastal Storm Flowage A portion of the property is within Flood Zone X {500 year). Most of the work will take place outside the flood zone. The sport court area is proposed to be raised 2-3' on the low side to allow for a level playing area. Approximately 80 cubic yards of fill is proposed. A trench drain is proposed downgradient of the court to capture and infiltrate the runoff. No adverse impacts are expected during any flooding event. Resource areas on the property include the buffer zones to a Bordering Vegetated Wetland, which is located just off-property to the southeast, and Flood Zone X. An Enforcement Order was issued to the property owners for completing alterations within the buffer zone to the wetland, including vegetation removal and regrading work. This Restoration Plan was completed to remedy the Enforcement Order issued to the property owners as well as to legally permit some of the desired site improvements, including the addition of a sport court and patio as well as any associated retaining walls, landscape planting beds or regrading work. 2 EXISTING CONDITIONS This property is a developed single-family residence in West Yarmouth. There is an existing dwelling, paved driveway, elevated deck, and associated steps, pathways, fencing, and retaining walls. Resource areas on the property include the buffer zones to a Bordering Vegetated Wetland, which is located just off-property to the southeast, and Flood Zone X. Naturalized areas are primarily located around the perimeter of the property, and are characterized by almost entirely invasive or non-native aggressive vegetation including Oriental bittersweet (Ce/astrus orbicu!atus), Sh rub honeysuckle (Lonicera morrowit), Japanese knotweed (Fallopia japonica), and brambles (Rubus sp.). At the time the Enforcement Order was issued to the property owners in August 2023, some vegetation removal work had been completed, as well as regrading within the buffer zones to the wetland. The Enforcement Order required the following remediative measures: A straw wattle must be installed for erosion control along the fence and secured with wooden stakes All stone dust/base/gravel must be removed from the disturbed area and returned to the previous grade with appropriate fill/loam material and seeded for stabilization A restoration plan by a landscape/wetlands professional for the entire 35 ft buffer must be submitted for approval by the Conservation Administrator Plantings must be installed according to the approved plan prior to May 30, 2024 A straw wattle and silt fence have already been installed along the edge of the chain -link fence for erosion/ sedimentation control. 3 PROPOSED PROJECT ACTIVITIES To remedy the Enforcement Order, this project proposes several land management activities: Remove all base material placed in the area of disturbance Place compatible fill material to restore grades to their condition prior to disturbance Seed and vegetate the entire 35' buffer to the Bordering Vegetated Wetland with native shrub specimens In addition to the restoration work required by the Enforcement Order, this project also seeks to legally permit some of the site improvements originally desired by the owners, which was the reason for completing the unpermitted alterations prior to understanding the wetland regulations pertaining to their property. Primarily, the applicants would like to add a Sport Court or similar court for playing volleyball and/or basketball and patio space. The proposed plan includes a 25' x 50' Sport Court to serve that function, as well as a 12' x 16' patio and any retaining walls and steps necessary to keep the grade of the court level. The entire court and its associated retaining walls are located outside of the 0-50' buffer to the wetland, with portions located within the 50-100' buffer zone. As mitigation for the proposed site improvements, the entire 0-50' buffer zone to the wetland is proposed to be naturalized. 4 PROJECT ACTIVITY TIMELINE WINTER/EARLY SPRING 2024 RESTORING GRADES IN AREA OF PREVIOUS DISTURBANCE Base material to be removed down to original soils remaining underneath using track equipment to reduce soil compaction potential. A compaction meter will be used to determine if underlying soils are over-compacted. If so, soils will be ripped to the appropriate depth to de-compact soils. Once it is determined that underlying soils are not over-compacted, native fill will be placed to re- establish pre-existing topographic profile. A 4-6" layer of clean, free-draining loam may be placed at the top of the soil profile, if necessary. MITIGATION AND RESTORATION AREA ESTABLISHMENT Install new siltation barrier at the 50' buffer/edge of restoration area so that construction of site improvements can continue without disturbing the mitigation or restoration areas. Hydroseed the mitigation and restoration areas with ProGanics biotic soil media and the FlexTerra erosion control system to increase seed to soil contact, improve germination, and decrease erosion potential. SPRING OR FALL 2024 RESTORATION/MITIGATION PLANTINGS Restoration plantings within the 35' buffer are to be installed immediately after fill material has been removed and grades have been restored. Mitigation plantings within the 35-50' buffer are to be installed once construction activities are complete or as soon as feasible. Install a temporary, above-ground irrigation system to provide supplemental water to all plantings for 2-3 growing seasons or until plants are fully established. 2024-2026 GROWING SEASON ANNUAL MAINTENANCE Monitor mitigation/restoration area and perform maintenance cut and wipe treatments or hand weed invasive, non-native, or aggressive species. No work is proposed within the Bordering Vegetated Wetland. (4)(b) Notwithstanding the provisions of 310 CMR 10.55(4)(a), the issuing authority may issue an Order of Conditions permitting work which results in the loss of up to 5000 square feet of Bordering Vegetated Wetland when said area is replaced in accordance with the following general conditions and any additional, specific conditions the issuing authority deems necessary to ensure that the replacement area will function in a manner similar to the area that will be lost: No loss of Bordering Vegetated Wetland will occur as a result of proposed work. (4)(c) Notwithstanding the provisions of 310 CMR 10.55(4)(a), the issuing authority may issue an Order of Conditions permitting work which results in the loss of a portion of Bordering Vegetated Wetland when; No loss of Bordering Vegetated Wetland will occur as a result of proposed work. (4)(d) Notwithstanding the provisions of 310 CMR 10.55(4)(a),(b) and (c), no project may be permitted which will have any adverse effect on specified habitat sites of rare vertebrate or invertebrate species, as identified by procedures established under 310 CMR 10.59. No habitat site of rare vertebrate or invertebrate species is identified on the property. (4)(e) Any proposed work shall not destroy or otherwise impair any portion of a Bordering Vegetated Wetland that is within an Area of Critical Environmental Concern designated by the Secretary of Energy and Environmental Affairs under M.G.L. c. 21A, § 2(7) and 301 CMR 12.00: Areas of Critical Environmental Concern. 310 CMR 10.55(4)(e): No Area of Critical Environmental Concern is identified on the property. 10.57: Land Subject to Flooding (b) A proposed project in Isolated Land Subject to Flooding shall not result in the following: 1. Flood damage due to filling which causes lateral displacement of water that would otherwise be confined within said area. A portion of proposed work is located within Flood Zone X, which has a 0.2% chance of flooding in a given year. Hazardous flooding is unlikely, and the amount of alteration within Flood Zone Xis not significant enough to displace flood waters so as to cause flood damage. 2. An adverse effect on public and private water supply or ground water supply, where said area is underlain by pervious material. Proposed work will not have an adverse effect on public or private water supply or ground water supply. Restoration/mitigation plantings will be better able to support groundwater infiltration and filtering of pollutants or excess nutrients. 3. An adverse effect on the capacity of said area to prevent pollution of the ground water, where the area is underlain by pervious material which in turn is covered by a mat of organic peat and muck. Proposed work will ultimately improve the capacity of the resource areas to prevent ground water pollution as the root systems of restoration/mitigation plantings will be better able to support groundwater infiltration and filtering of pollutants or excess nutrients. 7 4. An impairment of its capacity to provide wildlife habitat where said area is vernal pool habitat, as determined by procedures contained in 310 CMR 10.60. No vernal pool habitat is identified on the property. (c) Notwithstanding the provisions of 310 CMR 10.57(4)(a) or (b), no project may be permitted which will have any adverse effect on specified wildlife habitat sites of rare vertebrate or invertebrate species, as identified by procedures established under 310 CMR 10.59. No habitat site of rare vertebrate or invertebrate species is identified on the property. 8 Town of Yarmouth Wetland Protection Regulations 5.02: Vegetated Wetlands (3)(a) Any proposed work, permitted by the Commission, in a vegetated wetland or within 100 feet of a vegetated wetland shall not destroy any portions of said vegetated wetland (except when allowed under section 5.06), nor shall the proposed work impair in any way the vegetated wetland's ability to perform any of the functions in section 5.02 (1). No work is proposed within the vegetated wetland, and no hardscape is proposed within the 0-50' buffer to the wetland. Proposed work will not impair the wetland's ability to perform its essential functions; restoration/mitigation plantings will enhance the vegetated buffer to the wetland and improve soil stability, groundwater infiltration and wildlife habitat. 5.04: Land Subject to Flooding (both Bordering and Isolated Areas) (3) Any proposed work, permitted by the Commission, on land subject to flooding shall not result in the following: (a) Flood damage due to filling which causes lateral displacement of water that would otherwise be confined within said area. Proposed work will ultimately enhance wildlife habitat by expanding the naturally vegetated buffer strip to the wetland and adding native shrubs, grasses and herbaceous plant material. (e) An adverse effect on state listed rare and endangered vertebrates and invertebrates as identified by DFW (Mass Division of Fisheries and Wildlife). No habitat site of rare vertebrate or invertebrate species is identified on the property. 6.01: Setbacks and Buffer Zones (1) Notwithstanding section 6.01(2) below, no new structures, including swimming and spa pools (with the exception of water dependent structures), will be allowed within 50 feet of the following Resource Areas: No structure is proposed within 50' of the resource area. (2) Minor structures up to 140 square feet total coverage such as sheds, decks, and pervious patios may be allowed closer than 50 feet to a Resource Area but no closer than 35 feet. With the exception of "Vista Pruning" as outlined in section 6.03, a 35-foot undisturbed natural vegetative buffer shall be maintained between all projects and Resource Areas mentioned in 6.01 (1), above to insulate wetland resource areas from adverse impacts stemming from development elsewhere in the buffer zone. 9 No structure is proposed within 35' of the resource area. A 35' undisturbed natural vegetative buffer will be created as a result of proposed work. (3) The following are prohibited within resource areas listed in 6.01 (1) and their 35-foot buffer zones: (a) Lawn grasses including "Cape Cod Lawns" (b) Landscaping (c) Fertilizers (d) Pesticides (unless part of an approved invasive species removal program) (e) Irrigation except for temporary irrigation for establishment of native plantings (f) Mulch, other than for temporary ground stabilization for one growing season. Groundcover plantings are to be used for permanent stabilization and weed control. None of the above are proposed, except for temporary irrigation for establishment of native plantings. Pesticides may be used as part of maintenance activities to control invasive vegetation that may have spread from the adjacent naturalized areas to the project area. (4) The following are prohibited within resource areas listed in 6.01 (1) and their 35-foot buffer zones: (a) Fertilizers (b) Pesticides (unless part of an approved invasive species removal program) (c) Irrigation except for temporary irrigation for establishment of native plantings None of the above are proposed, except for temporary irrigation for establishment of native plantings. Pesticides may be used as part of maintenance activities to control invasive vegetation that may have spread from the adjacent naturalized areas to the project area. Pesticide applications will only be completed by MA licensed and insured pesticide applicators. (5)(a) New lawns may be irrigated for 2 growing seasons after planting but not thereafter. No new lawn is proposed; only existing lawn may be repaired. (5)(a) New lawns in buffer zones shall be or mimic Cape Cod Lawns. A Cape Cod Lawn is an area that is not irrigated, fertilized, or otherwise treated with chemicals that is diverse with species including native sedges, mosses, grasses, and other lowgrowing plants that are well adapted to the conditions of the Cape. Cape Cod Lawns can be established by seeding with a mix of drought tolerant grasses and forbs and weeding to remove invasive species as needed. No new lawn is proposed; only existing lawn may be repaired. 6.02: Mitigation and Restoration (1) At a minimum, a 35-foot undisturbed buffer zone shall be retained between the landward-most wetland resource area and the limit of proposed site disturbance. Landward of the 35-foot no-disturb zone, work shall be designed to minimize the area of disturbance, to preserve as much undisturbed vegetation within the one hundred-foot buffer zone as is practicable for the proposed use. A 35' undisturbed natural vegetative buffer will be created as a result of proposed work. (2) Where a 50-foot undisturbed buffer zone exists prior to the proposed work, and shall remain intact upon project completion, further buffer zone enhancement shall not be required. A 50' undisturbed buffer zone does not exist. Proposed mitigation will vegetate the entire 50' buffer zone. (3) Where a 50-foot undisturbed buffer zone does not exist prior to the proposed work, any work proposed within the 100-foot buffer zone shall be subject to mitigation planting requirements intended to restore, in so far as is possible, both the dimensions of a 50-foot undisturbed buffer and its vegetation. For work proposed within the 100-foot buffer zone, the calculation of mitigation is set forth as follows: Mitigation plantings will vegetate the entire 50' buffer zone. 10 (4) Where mitigation or restoration of buffer zone vegetation is proposed or required under a notice of intent, it shall meet the following requirements: (a) Locally native and climate adapted plant species suited to the local growing conditions will be used. Mitigation areas should contain a diversity of woody species with varying heights sufficient for the space (at least 3 species when the required mitigation area is <300 sqft) and may be supplemented by an understory of native grasses and forbs (including ferns, herbs, groundcovers, and perennials). Native grasses and forbs alone cannot be used as mitigation. All species are locally native and suited to the site conditions. Proposed species are of varying heights and sizes, and the understory will be seeded/planted with supplemental grasses/ herbaceous species. (b) The recommended plant spacing and densities will be used as shown on the approved plant lists available on the conservation website. Plants are shown at an appropriate spacing for the selected species based on their size at maturity and the conditions on site. (c) Only temporary use of mulch may be applied under the drip line of each plant at the time of planting for moisture retention, soil stabilization, and weed control during establishment. Native groundcovers will be utilized in the spaces between larger plantings. At no time shall a mitigation or restoration area be sheet mulched. Hand weeding is allowed. No mulch is proposed. Areas for planting will be seeded/planted with native grasses/ herbaceous material to provide a native vegetated groundcover. (d) Foundation landscape beds within the buffer zone: Proposed foundation landscape bed plantings should appear on all plans if within resource areas and the 100-foot buffer zone. Foundation beds are defined as directly abutting a dwelling/structure and are a maximum of 5 feet in width. These areas may be planted with native species, native cultivars, or non-invasive non-natives with approval from the Commission or the Conservation Administrator. No foundation landscape beds are proposed.
