All filings must be made on Town of Yarmouth forms. The filing deadline is two weeks prior to the next
scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall
result in an Administratively lncomplete Application and will not be advertised for a Public Hearing. Refer to
the meetino schedule. Contact the Conservation Office if you need assistance.

Project Narrative
Project Description
The purpose of this project is to provide a small amount of shorefront protection for an existing boathouse on the
waterfront, and relocate and replace two deteriorated timber piles with fiberglass piles. The boathouse is located
approximately 8 feet from the water's edge, with a scarp atthat location. There is some thin saltmarsh fronting
the shoreline. As expected, erosion has caused the scarp to move closer to the boathouse foundation. Thi
homeowner is now concerned that the erosion could de-stabilize the outer edges of the boathouse foundation
which could result in cracked walls and a much larger repair. Any crack repairs would be a large scope of work
to excavate the slope, straighten flre wall, and then put everything back. Therefore, the homeowner is proposing
a minor amount of shorefront protection which can stop the advance of the erosion. The proposed "softsolutioni'
is viable for this area, and with maintenance will provide the desired level of protection at this site.
There are two timber piles that secure the float which are in need of replacement. The homeowner would like to
replace the timber piles with fiberglass piles, and relocate them to the ends ofthe float as shown on the plan. This
will spread out the load to anchor the piles more effectively, and will be a permanent solution.
Description of Proposed Work
The area is first prepped by some minor regrading. Any larger stones in the soil would be removed. The fiber
rolls are placed next and secured. Manufactured fill suitable for planting is placed on top ofthe rolls, graded, and
secured with jute matting, twine and stakes. The area is then planted with Spartina Patens to hold the soil.
The old piles will be removed and replaced when the float and ramp are installed for the season. That work is
from a barge with a crane and hammer to pull and drive the piles. Standard protocols are included to prevent the
barge from grounding at low tide. Refer to the construction protocol at the end of this narrative.
All of the work is within the resource areas, and in previously disturbed areas. The fiber roll work can be
accomplished with hand tools, with no large equipment necessary. The materials can be brought in by hand,
installed by hand, etc. Materials and tools can be stored on the dock or in the boathouse. No portion of the
surrounding resource areas will be disturbed or altered as a result of the proposed work. The proposed work can
be accomplished without any negative effects to the resource area; in fact, the additional Spartina Paten plantings
will provide a benefit to enhance the resource area.
Resource Area Determination
The project site is located in Follins Pond, the most upstream location of Bass River, a tidal river which flows to
and from Nantucket Sound. Mean High Water and Mean Low Water elevations can be obtained from the Army
Corps Profiles, (Tidal Profile #9), and indicate the elevations in NGVD which exist at the mouth of the river.
The further you travel upstream, the more impact the river bottom, land restrictions, etc. impact the flow of
water and reduce tidal flow, limiting the tidal elevations. The MHW and MLW elevations for this project were
taken from another project on Merchant Ave across the pond, and from historical data from previous projects
along this portion of Follins Pond. Since the pond is not in the direct flow of the "river", properties irrthis basin
are not considered to be in ttre Riverfront Area. This project is consistent with the same determination for the
Merchant Road project.
Navigation
The location of the proposed work fiber roll work is not within navigable waters. The pile replacement work is
for exiting piles, which is categorized under general maintenance. Therefore, there will be no impact to navigation
in the pond.
Alternatives Analysis @iscussion of Options)
The project as proposed protects ttre coastal bank from erosion that would eventually de-stabilize the boathouse
foundation. the introduction of unwanted sediments into an area of the river that is shallow with a swift current.
The project also manages the vegetation on the bank to improve light and promote understory growth. As such,
the following analysis is offlered to describe the available options for this project.

Option 1- Do nothing
If nothing is done at this site, the scarped edge will continue to erode, leading towards the boathouse foundation.
As previously stated, the de-stabilization of the boathouse foundation, subsequent wall cracking, etc. would
r.qrrire large disturbances to the surrounding coastal bank slopes. This is a condition that should be avoided, and
the applicant is being accordingly proactive. Therefore, the Do Nothing option is not a viable option because of
the risk of increased disturbance to the resource areas if nothing was done.
OPTION 2:Place small boulders at the water's edge and then place the fiber rolls behind the rocks. This type of
shorefront protection has been used where the site is more vulnerable to wave action, but not so much as to be in
direct wave energy from storms. Follins Pond is shallow, without a lot of fetch, and the likelihood of waves
crashing on the biach in this location is unlikely or certainly not frequent. Boat wakes are likely to be the most
"o--o, source of wave energy. The shoreline exhibits erosion along its length in this location, but it isn't severe
enough to warrant the boulders. In addition, the boulders would make transit of kayaks and such from the
boathouse more difFrcult. Therefore, this option was not chosen.
OpTION 3: Install the shorefront protection along more of the site frontage. The site was evaluated for shorefront
protection along the entire base of the slope. While there is a defined scarp along the waterfront, the slope appears
io be stable at ihis time. The vegetation appears to be sufficient to hold the slope, and there doesn't seem to be
any other areas that would benefrt from more of the soft solution. This option can be re-evaluated at such time
that the bank slope starts to move. In that case, it may be prudent to install some protection at the base to protect
the slope from slippage, which would eventually destabilize the bank and the upper retaining walls. The existing
conditions Oo nof appear to warrant that level of protection at this time. Therefore, the option for the increased
shorefront protection was not chosen at this time.
OpTION 4: Replace the existing piles with pressure treated piles. While pressure treated piles are allowed for in-
kind replacement, their lifespan is defined. Relocating the piles will better distribute the anchor forces for the
float. Fiberglass piles do noileach any chemicals, and are a permanent replacement. Therefore, pressure treated
piles were not chosen as replacements for this project.

all of the construction

tutirg place from the land. The shoreline will be stabilized, avoiding a much larger
disturbance and repair of the boathouse. The plantings can be maintained, and will provide more nitrogen uptake
from the surrounding areas. The fiberglass replacement piles benefit the resource area because they don't contain
any chemicals that will leach into the environment. Overall, the project will enhance the resource areas without
significant or permanent impacts. For these reasons, this option is the preferred option.
Performance Standards
The project proposes the stabilization of a small section of shoreline to protect the boathouse foundation. The
areas a{iect"a Uy tt "
project include Coastal Bank, Coastal Beach, and Land Under A Salt Pond. Each resource
area is addressed below ieparately. The project as proposed will not have any significant or permanent adverse
effects to the surrounding resource areas.
Coastal Bank - The area of work over the coastal bank extends along the 20-foot length of the fiber rolls. The
work in this area is limited to minor regrading and the installation of the manufactured frll and plantings. The
project will be conditioned to prevent negative impacts to the bank. No negative impacts are anticipated. In fact,
it "iu"t will be improved because of the restoration and stabilization. Under the Yarmouth Wetlands protection
regulations (12/lll2r, section 4.05,3 (b); the project as proposed does not have an adverse effect due to wave
u"tio, on the movement of sediment from the coastal bank to the coastal beach, and does no have an adverse
effect on the stability of the coastal bank. The soil cover on the bank and over the fiber rolls can still transit to the
beach area under more severe erosive conditions. The soil cover serves to stabilize the bank slope in this location,
and therefore does not have an adverse effect on the stability ofthe slope. Therefore, the project as proposed can
be permitted under 310 CMR 10.30 (6) through (8), and the Yarmouth Wetland Protection Regulations, section
4.0s(3)b.

Coastal Beach - The area of coastal beach extends only in front of the eroded area. Most of the remaining
shorefront beach area is cobble based. The 20-feet of fiber rolls will protect the area, but also allow sediment to
be removed from the installation area. Any work to install the fiber rolls and plantings is accomplished by hand
and without equipment on the beach. Under the Yarmouth Wetlands protection regulations (12/11/23), section
4.02,3(a-f); the project as proposed does not affect the ability of waves to remove sediment from the beach (waves
are not prevented from redching the shoreline), will not disturb the vegetative cover (it will add to it), cause any
modification ofthe beach or downdrift beach (none at this location) that would increase the potential for storm of
flood damage, interfere with the natural movement of the beach, or cause artificial removal of sand from the
beach. Accordingly, there is no seaweed in this location proposed for removal.
The construction will not change the role for the beach in storm damage prevention, flood control, or protection
of wildlife habitat. The fiber rolls and any associated construction effort will also not change the volume or form
of the beach sediments. The configuration will also not change the ability of the beach (seaward of the fiber rolls)
to respond to wave action, or have any negative effect for any downdrift beach (none exist). The fiber rolls and
work to install them, as designed will have no adverse impacts to the coastal beach, and therefore meets the
performance standards for work on a Coastal Beach. Therefore, the project as proposed can be permitted under
310 CMR 10.27 (I) through (7), and the Yarmouth Wetland Protection Regulations, section 4.05 (3) a-f.
Land Under a Salt Pond - The only work for this resource area is limited to the replacement of two pressure
treated piles with fiberglass piles. The work will be performed from a working barge,where protocolJwill
prevent grounding of the barge. This type of work is considered minor maintenance as allowed under the
regulations. This type of work may be approved administratively, but is included in the NOI for completeness.
For 310 CMR 10.33 (3), The proposed work will not have an adverse efilect on the marine fisheries or wildlife
habitat of such a salt pond caused by:
(a) alterations of water circulation;
(b) alterations in the distribution of sediment grain size and the relief or elevation of the
bottom topography;
(c) modifications in the flow of fresh and/or salt water;
(d) alterations in the productivity of plants, or alterations in water qualrty, including, but not limited to, other than
normal fluctuations in the level of dissolved oxygen, nutrients, temperature or turbidity, or the addition of
pollutants.3l0 CMR 10.33(4) does not apply since no dredging is proposed. 310 CMR 10.33 (5); The project
will have no adverse impact to specified habitat sites of rare vertebrate or invertebrate species, as identified by
procedures established under 310 CMR 10.37.
Under the Yarmouth Wetland Protection Regulations, section 4.07 (3) a and b (section b does not apply); the
project will not have an adverse effect on the wildlife, wildlife habitat, marine fisheries
or shellfish habitat of such a salt pond because there will be no modification to the following:
i. alterations of water circulation;
ii. alterations in the distribution of sediment grain size and the relief or elevation
of the bottom topography:
iii. modifications in the flow of fresh and or salt water;
iv. alterations in the productivity of plants, or
v. alterations in water quality, including, but not limited to, other than normal
fluctuations in the level of dissolved oxygen, nutrients, temperature or turbidity,
or the addition of pollutants.
Therefore, the project as proposed can be permitted under 310 CMR 10.33 (3) through (5), and the yarmouth
Wetland Protection Regulations, section 4.07 (3)aand b.

prior to construction, a pre--construction meeting shall be held on-site with the Contractor, Property Owner (or
owner,s representativey,^and the Conservation Commission and/or agent. The purpose of the meeting is to clearly
delineate tie limits of work and access, as well as the staging area. The Contractor will describe the proposed
means and methods for performing the work within the requirements of the plans, order of conditions and
construction protocol. Thi Contractor will comply with mitigation measures as established by the Conservation

During Construction, the site shall be accessible for inspection during reasonable hours by all parties, members
of the conservation commission and their agents, and the Project Manager.
Post-construction meeting
Upon completion of construction, but prior to equipment being removed from the site, a post-construction meeting
shall be hild on-site with the Contractor, Property Ov er (or owner's representative), and the Conservation
Commission and/or agent. The purpose of this meeting is to determine that the project has been satisfactorily
completed in accordance with ali permits, and that no additional work or mitigation is required by the Contractor.
Restoration of project area
Upon comptetion of construction, the staging areas, vegetated areas, and any other areas disturbed by the
construction effort shall be returned as much as practical to their pre-construction conditions to the satisfaction of
the property owner and conservation agent.
