As homeowners/abutters to the proposed Definitive Subdivision #2936A by the Davenport
Companies, we wish to declare our objections to the location of the proposed access curb-cut onto
Route 6A. Not only is the location not in compliance with existing by-laws regarding intersection
spacing, but also seems totally unnecessary since the existing roadways of Outward Reach and
Eileen Street provide safer access to the proposed subdivision. Further, having the new roadway
directly across from Hockanom Road creates an inherently unsafe condition for cross-traffic
attempting to enter Route 6A within a 45 MPH speed zone. Hockanom at 6A is also a stop for
several school busses throughout the day.
I read the traffic statement, but I don’t believe it takes into account those instances when you have
vehicles from each direction on the side streets vying for entrance onto a busy, 45 MPH Route 6A,
each trying to “read the mind” of the other as to when to make their move. This is the time to avoid
having the roads directly across from each other while in the planning stages!
We request that the granting of the waiver regarding street spacing be denied. If access to 6A is
absolutely necessary, the curb-cut for the new roadway should be relocated ENE of Hockanom Road
rather then directly across from it. Current law regarding spacing and addressing safety concerns
should take precedence over convenience for the benefit of the Davenport Companies.

Dear Kathy and Planning Board Members,
I am a resident of Yarmouth Port, 10 Kencomsett Circle and direct abutter of this Proposed Subdivision
and am opposed to the curb cut on Route 6A proposed for this development.
1) Per: Application For Special Permit Waiver;
A) Street Intersection Spacing
Rt 6A currently has a designated speed limit of 45MPH and is already difficult to exit Kencomsett Circle
in a safe manor on a slow traffic day. The added burden of another road access being placed just 240 ft
on the same side of Kencomsett Circle and directly across Hockanom Rd, I feel, will increase the chance
of a motor vehicle accident not only during peak tourist/traffic times but also in inclement weather
periods such as snow and rain. I realize that a traffic study was done but wonder what time of day,
length of period and weather conditions were considered including time of year and if the peak tourist
season was studied. The solution to improve sight distance to the East by removing native vegetation
and tremendous grading that is proposed in Cover Letter Pg 2, under Project Description Para. 5, seems
to me to be an extreme solution that would permanently disfigure and disturb a section which is now
part of a Historic Scenic road. The proposed shrubs at entrance to Miracle Way, as shown on proposed
Landscape Plan, will certainly make it more difficult for a driver leaving Kencomsett Circle to visualize
oncoming traffic. I feel, that despite this alteration area of road, that it will still be a dangerous set up of
three roads intersecting in a small area of a heavily traveled scenic road. There is a more natural and
safer access, Eileen Road. I respectfully request that this curb cut on Rt 6A be denied for the safer
alternative of Eileen Rd and protect Yarmouth Ports’ Scenic Roadway from an unnecessary destruction.
B) Easements
The proposed sewer easement along the back of Lots 1‐4 will directly affect my property as it proposed
to be behind Lot #2. I respectfully request that this waiver for easement of 15ft from 20ft be declined.
After viewing the page titled Landscape Plan, the sewer easement seems to run right thru an important
drainage basin located directly adjacent to proposed Lot #1. Per page titled; Site Plan Review Comment
Sheet, under #5 Drainage heading; the two drainage basins located along 6A at entrance to Miracle
Way proposed appear to be an after‐thought. Given the fact the property will be heavily graded and
removal of most of the old trees will be removed, I fear that the water run off alone from the property
will dramatically affect all the homes on Kencomsett Circle directly abutting Lots 1‐4 and that this has
not been considered. For instance, how will water run off affect the septic systems already in place of
the homes on Kencomsett Circle behind proposed Lots 1‐4?
C) Landscape Plan
Of note Kencomsett Circle is not a private way.
The landscape plan seems to no way replace what will be taken from the area. The majority of plantings
will only benefit the new subdivision and I feel that more could be done to soften the landscapes along
the Kencomsett Circle abutters. The proposed plan to leave a 10ft undisturbed vegetation area behind
the new homes would be better served to plant new evergreens that would absorbed groundwater
runoff more efficiently and sound barrier during an expected lengthy build period. The existing trees are
now already in various stages of disease and poor state.

As abutters, we have two issues with the plan to develop this lot: (1) clear cutting the land and (2) the Route
6A access road.
Why would anyone think its a great idea to clear cut forested lots and build 14 houses in a field? Is it not
possible to leave a buffer zone of tree cover on the periphery? It would make sense environmentally and
aesthetically. It would also act as a noise buffer for houses inside the development and outside. for the noise
of traffic on Rt. 6A, which is considerable. It seems it would be a win-win situation to save some trees on the
periphery. I'm sure for the contractor, its just easier to level everything, but that isn't in anyone else's best
interest. Please reconsider the clear cutting. As for the contractor planting 1 tree per lot, that is just a token
gesture, not a replacement for what would be lost.
Regarding the planned entrance/exit onto Rt. 6A, that will create a hazardous intersection. Presently, it can
be very difficult for residents of Kencomsett to turn onto Rt. 6A. When taking a right turn in the summer, it is
necessary to accelerate rapidly to join the flow of traffic and that would mean we are accelerating directly
toward the exit for this development. I don't know if those people would even have a good view of people
exiting Kencomsett since there is a curve in the road. Please reconsider the placement of this new road. while
all options remain open. If the current plan is implemented, no one should be surprised that a dangerous
situation has been created. This is the time to reconsider the placement of this road.

Regarding the proposed subdivision on Route 6A in Yarmouth Port,
Definitive Subdivision No. 2936A and Special Permit #116:
Dear Members of the Yarmouth Planning Board,
I would like to note that with 14 4‐bedroom houses that are to be built and rented, the
volume of sewerage could be quite hefty, beyond what one would think is average.
With two people to a bedroom, that could be 8 people per house, especially in this tight rental
market where staying on the Cape during this housing shortage means many people are taking
roommates, or becoming roommates.
Given that, I believe that even though the “estimated” flow of nitrogen into the headwaters of
Bass River (Mill Pond) is stated to be about 2%, that is bringing our numbers in the wrong
direction. We need to be subtracting nitrogen loading, not adding to it, and the 2% guesstimate
could well be lower than reality.
With nitrate loading approaching 75‐80 percent in the upper waters of Bass River, the additional
2% estimate (or more) is sending the numbers in the wrong direction, i.e., adding to the problem.
Why not place the septic systems for these homes closer to Route 6A, where the flow is in the
opposite direction, away from the Mill Pond, head of the Bass River System? This will also allow
for easier hook‐up when town sewer lines finally arrive several decades into the future.

I live at the end of Gooseneck Road, near Mill Pond, and am as concerned as the state is about the
nitrogen loading from septic systems, and the resulting algae growth and low oxygen levels. If we
have the means to direct sewerage flow in another direction, we should take that route.
As noted in MA Estuaries Project Executive Summary, p. 11
“Unfortunately, the upper reaches of the Bass River System are at or beyond their ability to assimilate additional nutrients
without impacting their ecological health. The MEP analysis clearly indicates that the system is presently impaired by
nitrogen overloading and does not meet the Commonwealth's Water Quality Standards. “

Good evening. This board has a duty to the general public to always rule on the side of SAFETY.
The applicant will say changes will be made to the property, none of which makes this roadway any
safer. This access will only make a very dangerous area even worse. Please rule against this access
and do not forget the applicant can come in off of Eileen Road which is far safer. Please note
Yarmouth Police Chief Frank Frederickson's last sentence in his letter to this board said "MAXIMUM
SAFETY FOR ALL ." Please deny any Highway Access on to Rt 6A.
Please see two attached petitions with 123 signatures as well as a copy of Chief Frederickson's letter.
If possible, please read as the last public comment because I cannot be in attendance.

To the Town of Yarmouth Planning Board
Regarding the proposed project, a development of a 14 homes in a cluster subdivision at
293 6A.
I am writing with extreme concern for the following aspects of this project:
1) That the entrance to this project would be considered to be through
Outward Reach and Eileen St. Allowing this vehicular path through Outward
Reach will deteriorate an existing neighborhood. Using this road as an entrance
to the new development would increase traffic, making a peaceful neighborhood
road into a heavily used one. Diverting the new traffic through an existing
neighborhood via Outward Reach and Eileen will negatively alter an established
neighborhood, with families that use Outward Reach and Eileen to play, exercise,
walk pets and gather. It will be very unsafe.
2) The concern about a new dedicated entrance on to 6A from the development
focuses on how long of a wait there is to get out on to 6A and how many cars go
by before there is a break, and how people speed on 6A. These things are hardly
specific to any one entrance onto 6A. The condition is the same, if not worse, at
Outward Reach. We already have backups and major safety issues on Outward
Reach due to exiting on to 6A and drivers cutting through to avoid the Union St /
6A intersection. These issues will be made worse by allowing the exit to the
development to be through Eileen/ Outward Reach.
3) The septic systems as designed will significantly impact the health of the Bass
River. Community efforts to clean the River to make it healthier will be thwarted
by this project. Please provide proposals for optional systems.

Greetings,
I have been contacted by a resident of Hockonom who indicates that he is the spokesperson for others in the
area. He indicated that there is a neighborhood consensus that the proposed development would create unsafe
conditions for vehicles turning onto Rt. 6A , particularly those who will be traveling West on Rt.6A. He suggested that a
better solution would be to enter the development from Eileen Street.
I have viewed the area and can certainly understand his concerns. Without knowing all the work that has been done
thus far in order to plan the development, I can only ask that the development access to Rt.6A be thoroughly reviewed
with all options considered for maximum safety for all.
