ALBERT BASSETT Lyman Lane South Yarmouth, Massachusetts DECISION The petitioner requests a variance and/or approval of the Board of Ap- peals to allow the construction of four metal buildings, approximately 2,400 feet, on land owned by petitioner. The land is northeast of Summer Street, Yarmouth Port, consisting of 28 industrial zoned lots recorded in earstable County Registry of needs in Book 246, Pago 106. STUDLEY It appearing that notice of said hearing has been given by sending notice thereof to the petitioner and all those owners of property deemed by the Boaid to be affected thereby, and that public notice of such hearing having been given by publication in the Cape Cod Standard Times on January 28, 1974 and February 4, 1974, the hearing was opened and held on the date first above written. Albert Bassett The following appeared in opposition: NONE REASON FO'R DECISION: Petition No.: 1249 It appeared that the request for a metal building was in violation of the Building Code, as the Building Code'as it presently exists, makes no provision for metal buildings. .however, the Board finds that the four buildings that were the subject of this request, are of a type of construction which has been previously approved by the Board and which substantially meets the special requirements called for in the present Building Code. I it is noted that through inadvertence this decision had not previously been rendered as it was approved the night of the hearing but in fact, through inadvertence, was not officially signed by the Board of Appeals and therefore it is being granted at this time. Therefore, a request for a variance from the Building Code is granted and a request for the construction of four metal buildings is hereby approved. All abutters were notiibd by Certificate of mailing and the necessary, correspondence wag made in the Cape Cod Standard Tunes and the Dennis -Yarmouth Register. Mr. Bassett, Jr.: 4 buildings here - each 2490 sq. ft.. Package Steel Buildings, which are standard. We have leases where we can go on the grounds and inspect the buildings at all times. We have control over the looks of the places. . Studley: I am afraid at some time we will be sorry if we don't put in some condition where th W should have to landscape the place and keep it looking neat.
