Dear Ms. Ferreira,
On May 26, 2016, the Town of Yarmouth Zoning Board of Appeals granted the former owner(s)
Josimary F Pires a special permit to allow the construction and use of a Family Related
Accessory Apartment, via Petition No. 4639. That petition was granted pursuant to the
provisions of Zoning Bylaw Section 407.
Section 407.3.1 item #3 provides that "The Special Perm it.for a family related accessory
apartment shall terminate upon the sale of the property or transfer of title to the dwelling unless
the new owners file a new Declaration of Covenants at the Barnstable Registry of Deeds at the
time of transfer or within 45 days of the sale.
If no action is taken by the new owner(s) at the time of transfer or within 45 days of the sale, then
the new owners) must apply for re -approval of the Special Permit by the Board of Appeals for a
family -related accessory apartment, stating that the conditions at the time of the original
approval remained unchanged. "
The Assessors records indicate that you took ownership of the property on May 24, 2022.
At;cordingly, you are required to apply with the Board of Appeals in order to reestablish the use
of the Accessory Apartment.
