O’Connor 20 Seaside Village Road, Yarmouth MA Map 25, Parcel 280 On behalf of the Applicant Mariana O’Connor, Bracken Engineering, Inc. respectfully submits this Notice of Intent (NOI) for work within Land Subject to Coastal Storm Flowage (LSCSF). The project consists of the construction of a new garage structure with living space to the north of an existing single-family dwelling with any and all associated utility work, grading, landscaping, and appurtenances. Wetland Resource Areas The parcel lies within the FEMA Special Flood Hazard Zone “AE” (El.11) as shown on the FEMA Flood Insurance Rate Map No. 25001C-0589-J dated July 16, 2014. The parcel is located more than 500 feet from Mean High Water and there are no Coastal Banks associated with the flood zone on or adjacent to the parcel. There are no estimated habitats of rare wildlife or priority habitats of rare species located on the parcel as designated by the Natural Heritage and Endangered Species Program 15th edition. Existing Conditions The property is a developed parcel located in a densely populated residential neighborhood. The property is abutted by single-family dwellings to the north and south, Seaside Village Road to the west, and a vacant parcel to the east. There currently exists on the parcel, a single-family dwelling with associated paved driveway, deck, stoops, and patio. A dilapidated bocce game court lies in the rear yard. The parcel is generally flat, with topography ranging from approximately 8.5 to a maximum elevation of approximately 10.5 (NAVD88). Proposed Project The Applicant proposes to build a proposed 722± square foot structure to the north of the existing dwelling. The proposed structure shall contain a garage bay as well as living space on the first and second floors. The project is located within the FEMA special flood hazard AE el.11 zone. The proposed structure is to be constructed in compliance with all FEMA and building code Flood Zone regulations. The top of the foundation shall be elevation 12.0 with a first floor elevation (for living space) at el. 13.3. Crawl space area below the first floor, as well as the garage area, shall be provided with flood vents. The crawl space elevation shall be set at the lowest adjacent grade (approximately elevation 9.0). An asphalt driveway expansion is proposed to extend the existing driveway to the proposed garage. The proposed work includes all other minor grading, utilities and landscaping associated with the proposed structure. Performance Standards Protection of Public and Private Water Supply and Ground Water Supply The site is not located within a DEP defined wellhead protection area and there are no private wells in the vicinity of the proposed project. The project will have no adverse impacts on ground water supply. Therefore, the public and private water supply and groundwater supply protection interests of the Act and the Bylaw will be upheld. Flood Control and Storm Damage Prevention The proposed work lies within land subject to coastal storm flowage. Flood conscious design of the proposed foundation and garage structure, including flood vents and slab grade, will not impede the ability of the landform to receive and naturally disperse floodwaters. Therefore, the flood control and storm damage prevention interests of the Act and Bylaw will be upheld. Prevention of Pollution Erosion control measures (silt fence) shall be employed as deemed necessary by the engineer and/or Conservation Agent at the time of construction. Therefore, the pollution interests of the Act and Bylaw will be upheld to the maximum extent practicable. Protection of Fisheries, Shellfisheries, Wildlife Habitat and Riverfront Areas The Site does not contain mapped NHESP designated areas (Estimated or Priority Habitats) or any certified or potential vernal pools. All work is within developed areas on the lot and is not anticipated to adversely impact an adjacent wildlife habitat. No work is proposed below the Mean High Water. Therefore, the fisheries, shellfisheries, wildlife habitat and riverfront interests of the Act and Bylaw shall be protected. Summary The Applicant seeks to construct a proposed flood compliant garage structure including with all associated (minor) grading, landscaping, utilities, and appurtenances. The project is located within LSCSF. Appropriate measures are proposed to be employed to minimize adverse effects and prevent erosion and migration of sediment that may otherwise impact resource areas. As proposed, the project has met the burden of proof established under the Act and Bylaw.
