MA 0266,1 GROSBEAK IOWHEE #48 - 2024 RENEWAL RESTRICTIO\S: TOWN OF YARMOUTH HOUSING AND SPACE.USE BYLAW CHAPTER 108 108.2 No person shall rent or lease, or offer to rellt or lease, any building or any portion ofa building to be used for human habitatioo without first registering with the Board of Health, rvhich shall determine the number ofpersons such building or portion of a building may lawfully accommodate under thc provisions of the Massachusetts State Sanitary Code, and without first also conspicuously posting within such building or potion ofa building a certificate ofregistration provided by thc Board of Health specifying tltc number ofpersons such a building or portion ofa building may lawfulty accommodate. 108.4 There shall be a fee to procure a certificate ofregistration, which shall be valid for one (l) year or to December 3l ofeach year, whichever is sooner. Thereafter the permit shall bc annually renewed. 108.5 A pemrit issued under this chaptcr shall be revoked if, at any time, the Iicensing authorities are satisfied that the licenscc is unfit to hold the license. They may suspend and make inoperative, for such period of time as they may deem proper, the pernrit mentioned hcrcin for any cause deemed satislactory to them. The rcvocation and suspension shall not be made until after investigation and a hcaring or after giving the liccnsee an opportunity to bc heard. Noticc ofthe hearing shall be delivered to the permittee not less than three (3) days before the time of the said hearing. 108.6 Any person or tenant violating any provision of this chaptcr shall be punished by a fine ofnot more than two hundrcd dollars (5200.00). Each day's violation constitutes a separate offense. 108.8 Thc owners of all rental units, as defined in 108.2, shall be required to ccrtify annually that operating smoke detectors have bccn placcd in the rental unit. Thc smoke detectors and locations thereof shall be satisfactory to the \hnnouth Fire Department. NOTE: Carbon Monoxide Detectors are required in any dwelling with Oil, Gas, Coal, or rvood-buming equipment and/or a structurally cnclosed or attached gange in accordance with MGL 148, scc. 26F12 and 527CMR3 1.00 MUST BE POSTED ON PREMISES Certificate Number: BHR-24-27 3
