MA 0266] GROSBEAK IOWHEE #44 - 2024 RENEWAL TOWN OF YARMOUTH HOUSING AND SPACE.USE BYLAW CHAPTER I08 108.2 No person shall rent or lease, or offer to rent or lease, any building or any portion of a building to be used for human habitation without llrst registering with the Board ofHealth, which shall determine the number ofpersons such building or portion ofa building may lawfully accommodate undcr lhe provisions ofthe Massachusetts Statc Sanitary Code- and without first also conspicuously posting within such building or portion ofa building a certificate ofrcgistrarion provided by thc Board of Health specifying the number ofpcrsons such a building or portion ofa building may lawfully accommodate. I 08.4 There shall bc a fee to procure a certificate of registration, which shall be valid for one ( I ) year or to Decembcr I I of each year, whichever is sooner. Thereafter thc permit shall be annually renewed. 108.5 A pemrit issued undcr this chaptcr shall be revoked it', at any timc. the licensing authorities are satisfied that the licensee is unfit to hold the license. They may suspend and make inoperative, for such period of time as they may deem proper, the pemit mentioned hcrein for any cause decmed satisfactory to thcnr. The revocation and suspension shall not be ma{e until afler investi€ation and a hearing or aftcr giving the liccnsec an opportuniry to be heard. Notice ofthc hearing shall be delivered to the permittee not less than three (3) days before the time ofthe said hearing. 108.6 Any pcrson or tenanl violating any provision of this chapter shall bc punished by a finc olnot more than two hundred tlollars (5200.00). Each day's violation constitutes a separate oflfense. 108 8 The owncrs of all rental units. as defined in 108.2, shall be requircd to certify annually that operating smoke delectors have becn placed in the rental unit. Thc smoke detectors and locations thereof shall be satisfactorv to the lirmouth Fire Dcpartnrent. NoTE: Carbon Monoxide Detectors are required in any dwelling with oil, Gas, Coal, or wood-burning equipment and./ora structurally enclosed or attached garage in accordance wilh MGL l4g, sec. 26Ft2 and 52?CMR-j r.00 MUST BE POSTED ON PREMISES Certificate Number: BHR-24-273
