108.2 No person shall retrt or lease, or offer to rent or lease, any building or any portion ofa building to be used for human
habitation rvithout first registering with the Board ol Health, rvhich shall determine rhe number ofpersons such buitding or ponion
ofa building may larvfully accommodate under thc provisions ofthe Massachusetts Statc Sanitary Code, and without first
also conspicttously posting within such building or portion of a building a certificate ofrcgistration provided by thc Board of
Health spccifying the number ofpersons such a building or portion ofa building may lawfully accommodate.
108.4 There shall be a fee to procure a certificate of registration, rvhich shalt be valid for one ( | ) year or to December 3 I of each
year, whichever is sooncr. Therealler thc permit shall be annually rcnewed.
108.5 A pernrit issued under this chapter shall be revoked if, at any time, the Iicensing authoritics are satisficd thar the licensce is
unfit to hold the license. They may suspend and make inoperative, for such period of time as they may deem proper, the
penrit mentioned hercin for any cause deemed satisfactory to lhcnl. The revocation and suspension shall not be made
until after investlgation and a hearing or after giving the liccnscc an opportuniry to be hcard. Notice of the hearing shall
be delivered to the permittee not less than three (3) days before the time of the said hearing.
108.6 Any pcrson or tenant violating any provision ofthis chaptcr shall be punishcd by a fine ofnot more than two hundred dollars
($200.00). Each day's violation constitutes a separate offense.
108.8 Thc owners of all rental units, as defined in 108.2, shall be required to certify annually that operating smoke
dctectors have been placcd in the rental unit. The smoke detectors and locations thcreof shall be satisfactory to
the Yarnrouth Fire Depanmcnt.
NOTE: Carbon Monoxide Detectors are required in any dwelling with Oil, Gas, Coal. or rvood-buming equipment and <.rra structurally cnclosed or attached gamge in accordancc with MGL l4g. sec. 26F l2 and 527cMR3 1.00
