The work is to occur within land subject to coastal storm flowage. There are no other wetland resource areas within 100 feet of the property. Resource area In accordance with Town of Yarmouth Wetlands Protection Regulations, the boundary of LSCSF shall be the relevant 100 year storm elevation referenced within the latest available National Flood Hazard Layer (NFHL) Maps provided by the Federal Emergency Management Agency. The area of Moderate Wave Action (MoWa) is a sub -area of LSCSF, with wave heights between 1.5 and 3 feet, and said boundary shall be the Limit of Moderate Wave Action as referenced within the NFHL. The project site is located within Flood Zone AE, el. 11 feet, the boundary being the 11- foot contour. The elevations shown on the Site flan are based on NAVD 86, Proposed activity The Applicant proposes to raze and rebuild an existing single-family dwelling with a post -supported deck and pergola, and rinse station. The new house and the deck with pergola will be built in the same general location as the existing structures with modest increases in the structure footprint. The dwelling footprint will increase 344 square feet and the deck will increase 24 square feet. There is to be no increase in bedroom number, so the new three -bedroom house is to connect into the existing raised septic system that currently services the existing three -bedroom dwelling. The soil absorption system was designed to be elevated 5 feet above adjusted groundwater. Roof run-off is to be directed to stone trenches along the roof dripline. Elevation views of the proposed dwelling are attached. The planted vegetation immediately around the house is to be removed, but the large oaks are to remain. Care will be taken to locate the posts and sonotubes for the deck around the 46" oak that abuts it. The small property has been maintained historically as lawn. Disturbed areas are to be seeded with native grasses underlain with a minimum 4 inches of loam. The existing shed is to remain. Compliance with wetlands regulations Four of the Five house corners are at an elevation higher than the base flood elevation of the flood zone. However, if any part of the structure is located at an elevation within the flood zone, the entire house must conform to the Massachusetts State Building Code Flood Standards. The project requires approval from the Yarmouth Zoning Board of Appeals. That application will be filed by April 3, 2024. (a) General Performance Standards Any activity within land subject to coastal storm flowage which will result in the building upon, removing, filling or altering of land shall not have an adverse effect on the interests protected by the bylaw by: i. reducing the ability of the land to absorb and contain flood waters,• The developed property supports an existing single-family dwelling, deck with pergola, shed, subsurface septic system and gravel drive. The one-story house is to be replaced with a two-story structure. The 344 square -foot increase in the foundation footprint will not reduce the land's ability to absorb and contain flood waters. Roof run-off is to drain into stone drenches along the dripiine, L reducing the ability of the land to buffer more inland areas from flooding and wave damage; The locus is approximately .5 mile from Lewis Bay and almost a mile from Nantucket Sound. The modest project on the 11, 761 square foot lot will not increase flooding to more inland areas. il. increasing the elevation or velocity of flood waters, or by redirecting or increasing flows or causing channelfzation, in each case of the projectsite, adjacent or nearby properties, or any public or private way. The house occurs in a dense residential area between the Sound and Route 28 with the properties arranged in a more or less grid formation. The raze and rebuild of the single-family dwelling will not increase the elevation or velocity of flood waters, nor will it redirect or increase flows or cause channelization. ifidisplacing or diverting flood waters to other properties or resource areas. Fences and privacy walls, including walls separating one property from another, may obstruct or divert flood flow and waves toward buildings and protected areas. Solid fences (stockade andsimilar) must be constructed with b inches of clearance below to allow the passage of floodwaters and wildlife, The project will not result: in the displacement or diversion of waters to other properties. There is no other wetland resource area within 100 feet of the property. There are no fences or walls proposed. 2 iv. causing, or creating the likelihood of, damage to other structures on land within the flood plain as debris (collateral damage); The existing dwelling is to be razed and removed from the property. During construction of the new house, building debris is not to be left on the property. v. causing ground, surface or saltate pollution triggered by coastal storm flowage, There are no pollutants associated with the proposed project that would cause pollution in the resource area. vi. reducing the ability of the resource to serve as a wildlife habitat and migration corridor through activities such as, but not limited to the removal ofsubstantial vegetative cover and/or installation of fencing and other structures which prevent wildlife migration across property. The small property in a dense residential neighborhood does not provide significant wildlife habitat, nor is it a migration corridor. The property has been historically maintained as lawn with a few individual trees. There is no fencing proposed with the project. vii, prevention of the migration of resource areas such as salt marshes due to sea level rise. There are no other resource areas within 100 feet of the locus site. The property is at a significant distance from the coast. viii. If flood control andstorm damage protection functions have already been impaired, redevelopment must improve existing conditions by reducing impervious surfaces, restoring flood control and storm damage protection functions, installing native plantings, or by restoring or creating other wetland resource areas. And shall meet the following requirements; ix. Existing septic system and cesspool repairs will be allowed provided they meet all Title 5 and local Board of Health thresholds. The new dwelling, which will not have additional bedrooms, will tie into the existing raised septic system that was upgraded in 2006. x. All groundwater elevations shall incorporate seasonable adjustments if test holes and or leaching components are 100 feet or closer from major estuaries. The SAS was designed to be elevated S feet above adjusted groundwater. xi. Any proposed deck, shed, or other similar structure must be securely anchored to a footing or foundation. The new deck will be anchored as required by the MA State Building Code Standards for construction in a flood zone. The existing shed is proposed to remain. xii. Any activity shall preserve existing soils, vegetation, and other natural conditions that serve as buffers to coastal flooding and storm surges. The property is a developed residential site. The construction will occur over existing lawn, Disturbed Iawn areas are to be replaced with native grass seed underlain with a minimum of inches of loam. The existing native trees are to remain. (c) Additional Performance Standards within the MoWA Within the MoWA, in addition to the general performance standards set forth in Section 4.10 (3)(a), the following additional performance standards shall apply. L The new construction and footprint expansion of any building or other structure, road, impervious surface, or septic system shall be permitted, subject to the other provisions of the Bylaw and Regulations, provided that any building or occupied structure shall be elevated at least two (2) feet above the BFE.
