The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting schedule. Contact the Conservation Office if you need assistance. Submitting an Application: Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2) Hardcopy filing dropped off or mailed to the Conservation Office including: 1 Administrative Checklist 1 complete NOI application WPA form 3 with original signatures. Typed signatures will not be accepted. Detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall include how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Regulations, delineation sheets (if BVW or vegetated wetlands are present) or other resource area calculations, and supporting information. 1 100’ radius map, current abutters list identifying the property owners who are to be notified per 310 CMR 10.00 and abutter notification form. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. All abutters must be notified via certified mail. Certified Mail Receipts (PS Form 3800) for all abutters. Green cards to be submitted at the hearing. 1 original and 6 copies of the plan, folded separately, right side out with title and project address visible. All plans shall reference NAVD1988 unless otherwise noted. All proposed structures must be staked, and all relevant resource areas and buffer zones must be staked or flagged. Please consult the Yarmouth Wetland Regulations, page 17. Notice of Intent 104 River Street South Yarmouth, MA PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project at 104 River Street in South Yarmouth, MA (the Site) consists of the permitting of a fixed pier over an existing wooden bulkhead, with an associated seasonal ramp and float (the Project). This application is being submitted in accordance with the Town of Yarmouth Wetlands Protection Bylaw (the Yarmouth Bylaw) and Massachusetts Wetlands Protection Act and associated regulations (the WPA). 2.0 SITE DESCRIPTION The property located at 104 River Street in South Yarmouth, is bordered by private residences to the north, south, and west and the Bass River to the east. The lot is currently developed with an existing deck and maintained lawn. The jurisdictional wetland resource areas that are protected under the Yarmouth Bylaw and the WPA includes: • Land Under Ocean (LUO) • Land Containing Shellfish • Bass River, Riverfront Area (RFA) • Coastal Bank • Land Subject to Coastal Storm Flowage (LSCSF) FEMA Flood Zone AE (elevation 11) and VE (elevation 13) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: Proposed Pier with Seasonal Ramp and Float: The proposed project at the site consists of the construction of a fixed, pile supported pier, with an attached kayak storage rack, and a seasonal ramp and float. The proposed fixed pier will be 4’ wide by 24’ long and will have a set of attached stairs above the wooden bulkhead. The ramp will be 3’ by 17’ long and the float will be 6’ by 28 long (168 sf). 12” pilings will be installed to support the pier and the seasonal float. The float will have 3 to 3.5’ of water at low tide beneath it and therefore will not rest on the bottom of the river at a typical low tide. Public access between MHW and MLW will be maintained beneath the pier, allowing for a minimum of 5’ clearance. New impacts to LUO, associated with the Bass River, and Land Containing Shellfish include 6 square feet (sf) of the 12” pilings. 12 square feet of the stairway will be installed above the existing wooden bulkhead. There is no salt marsh beneath or adjacent to the pier and the nearest mapped Eelgrass bed (according to DEP data layers shown in Mass Mapper) is over 400 feet to the southeast. The pier, ramp, float and associated pilings will be located outside of NHESP PH 2156, associated with the northern edge of the Nantucket Sound. Further, according to Shellfish Suitability Areas included on MassMapper, the nearest shellfish area is roughly 50’ away from the shore and is associated with soft-shelled clams, which put the nearest pilings outside of the limits of this area. The shellfish survey conducted on 3/26/2024 supports this shellfish mapping, as a very limited number of shellfish were located within the shellfish survey area, which contained mostly soft-shelled clams. The new piles will be installed outside of any time of year restrictions requested by the Division of Marine Fisheries, Yarmouth Harbor Master, and/or Yarmouth Shellfish Constable (if any) for in water silt producing work. Pilings will likely be installed via barge from mid to hightide to prevent scour. Pilings will be driven into the bottom of the river 10’-15’ or to refusal. The pier will be installed following the installation of the pilings via barge from mid to hightide. Access to the site from land will be gained from the paved roadway, River Street and no vegetation clearing will be necessary to gain access to the edge of the wooden bulkhead to conduct construction activities. Typically, the seasonal removal of the ramp and float is done by water. Waiver Request: The proposed pier system will comply with the Yarmouth Wetlands Protection Regulations under 3.01 performance standards for tidal and estuarine docks and pier, with the exception of the following 3.01 (12)(b)(c)(d). (b): The proposed float is located 85’ away from the edge of the channel of the Bass River. This is proposed to obtain safe berthing depths and to meet the -2.5 feet on the landward side of the float. However, the proposed pier will be located further from the channel than the neighboring pier (located 79’ from the channel), therefore the proposed pier should not result in a navigation issue for vessels within the Bass River. (c): Windmill Beach is located approximately 176’ away, however is separated from the proposed pier by another existing pier, as such the new structure should not have any impacts to the use of the beach. Notice of Intent 104 River Street South Yarmouth, MA (d): The proposed float is located 11 feet from the southern property line. However, the float is more than 75 feet from the adjacent existing float and as such, provides ample room for safe navigation. 5.0 MITIGATION All required time of year restrictions from the Division of Marine Fisheries and the Natural Resource Department of Yarmouth will be complied with. Activities associated with piling installation and pier construction will occur from mid to high tide to prevent the barge from resting on the subsurface. Only minimal ground disturbance associated with the installation of the stairway for the pier is anticipated. Soil from the installation of the stairway will be backfilled around the stairway and any disturbed areas will be loamed and seeded with grass seed immediately following construction. No natural vegetation or tree removal will be associated with the proposed project or for gaining access to the Site. All construction materials will be staged as far from neighboring properties and the edge of the Bass River as possible. All debris from the construction process will be contained in within appropriate receptacles and will be removed from the Site in a timely manner. Shellfish Survey 104 River Street Yarmouth, MA 1 SHELLFISH SURVEY DESCRIPTION 1.0 INTRODUCTION On March 26th, 2024, Paul Mancuso and Conor Gilbertson, Wetland Scientists of BSC Group (BSC) conducted a shellfish survey from MHW into Land Under the Ocean within the Bass River at 104 River Street in Yarmouth (the Site). The purpose of the survey was to evaluate shellfish habitat, shellfish species, and shellfish population density within the proposed project area. This shellfish survey accompanies a Notice of Intent application for a proposed pier, ramp, and float at the Site. 2.0 SITE DESCRIPTION The Site is located on the western bank of the Bass River near the mouth of the river which drains into Nantucket Sound. Single-family homes line Bass River to the north and south of the Site and also to the west. The Bass River is an estuary with numerous existing residential piers, ramp, and float systems. The proposed project involves the construction of a pier, ramp, and float system at 104 River Street to allow for access to the water and a place for boat storage. The Bass River is recognized as suitable habitat for quahogs, soft-shell clams, and bay scallops. The following resource areas are located onsite: • Coastal Bank • Land Under the Ocean • Land Containing Shellfish • Land Subject to Coastal Storm Flowage (LSCSF) 3.0 SHELLFISH INVENTORY In order to evaluate existing shellfish habitat at the site, BSC conducted a shellfish survey from the Mean Highwater (MHW) line (the wooden bulkhead) out approximately 50’. The proposed pier extends 43’ beyond MHW so the survey included areas ~7’ beyond the pier, ramp, and float system. The weather during the survey was overcast with light rain and wind with temperatures around 40F. The survey commenced at approximately low tide at 8:00 am. In order to sample for shellfish within the project area, 5 transects, located ~10 feet apart, with plots located ~10 feet apart were surveyed as follows… Transect 1 – Located ~20 feet to the south of the center line of proposed pier, ramp, and float. Extending ~50 feet seaward from MHW. Transect 2 – Located ~10 feet to the south of the center line of proposed pier, ramp, and float. Extending ~50 feet seaward from MHW. Transect 3 – Located along center line of proposed pier, ramp, and float. Extending ~50 seaward of MHW. Table 1 on the next page details the shellfish inventory observed in the waters of Bass River adjacent to 104 River Street. Quahog clams were recorded based on size. Sizes of quahogs are as follows ; seed (<1.5”), littleneck (1.5” -2”), cherrystone (2”-4”), chowder (>4”). In total, 30 plots were surveyed for the presence of shellfish. Shellfish were found within 11 of the 30 (36%) plots. Shells of deceased individuals were found within some of the plot and observed on top of the sediment. In total, 4 living quahogs, 7 soft-shell clams, and 2 oysters were observed. Also found within the shellfish survey plots were numerous slipper snails. Along the wooden bulkhead there are healthy populations of barnacles and some oysters as well . Numerous jelly fish were observed floating through the survey area. Shellfish Survey 104 River Street Yarmouth, MA 4 4.0 TEMPORARY IMPACTS The proposed work includes construction of a pier, ramp, and float out into the waters of Bass River. This work will only have minor impacts to the intertidal area, Land Under Ocean, and Land Containing Shellfish. To minimize impacts to shellfish, the project will adhere to any time-of-year restrictions recommended by DMF. Specifically, the work could occur during the fall/winter/early spring months when shellfish life cycle activity is reduced. During the winter, shellfish live at increased depths in the tidal bottom with reduced metabolism. This would reduce potential impacts to shellfish compared to performing the work during the summer. The pile driving will occur at high tide to prevent the barge from resting on the sediment surface. If necessary , the shellfish can be relocated prior to the work. 5.0 SUMMARY BSC’s shellfish survey identified the following: ▪ 4 Quahogs (Mercenaria mercenaria) were found within the 30 shellfish plots surveyed. ▪ 7 Soft-shell clams (Mya arenaria) were found within the 30 plots. ▪ 2 Eastern oysters (Crossostrea virginica) were found within the 30 plots and more growing along wooden bulkhead.
