Re: 405 Route 6A, Yarmouth Port— Ell Chimney and Other Construction Work
Dear Mr. & Ms. Hagopian,
It has come to the attention of this office that you have undertaken work on the property located at 405 Route 6A in the form
of,at least,demolishing an ell chimney and installing an asphalt shingle roof where it once stood. This work was completed
without the required building permit from this office or the required application and approval from the Old Kings Highway
Historic District Committee.
You are hereby notified that you are to Cease and Desist with any and all work, interior or exterior that requires a Building
Permit and is also a violation of the OKH regulations on the above-referenced property until you have applied for and been
issued a building permit by this office.
OKH Bulletin Section 12 reads as follows:
Section 12—Enforcement
Any person who violates any provision of this Act shall be guilty of as a misdemeanor and upon conviction thereof shall be
fined not less One Hundred Dollars ($100) nor more than Five Hundred Dollars ($500). Each Day of violation of this Act
shall constitute a separate violation.
This office understands that the work was undertaken between December 6,2023,and December 10,2023,with demolition
being witnessed by several passersby on December 8,2023.On December 9,another resident witnessed a hole in the ell roof
where the chimney had been located.Any fines imposed as allowed by the OKH Bulletin will begin on December 8,2023,and
continue daily until the work undertaken without the proper permitting has been reversed or been granted permits.
Violations of 780 CMR, MA State Building Code will be addressed in a separate notice.
You are hereby directed to make proper application for the required approvals and permits.
Per MGL. CH. 143 Sec. 91, violations of the MA State Building Code, can result in fines of up to $1000.00 per day.
You are required to respond within 7 days of the date of this letter
