108.8 Thc owners of all rcntal units, as defined in 108.2, shall be rcquired to ccrtify annually that operating smoke
detcctors have bcen placed in thc rental unit. Thc smoke detcctors and locations thcreof shall bc sarisfactory to
thc Yarmouth Fire Dcpanmenl.
NoTE: Carbon Monoxide Detectors are required in any duelling with Oil, Gas, Coal, or rvood-buming equipment an<Uora structurally cncloscd or attached garage in accordancc with MGL l4g, sec. 26F12 and 527cMR3 1.00

108.2 No person shall rent or lease, or offer to rent or lease. any building or arry portion ofa building to be used for human
habilation without first registering wilh the tsoard ofHealth, which shall determine the number ofpersons such building or portiorl
ofa building may lawfullv accommodatc under thc provisions ofthe Massachusetts State Sanitary Code. and without first
also conspicuously posting within such building or portion ofa building a certificate ofregistration providcd by thc Board of
Hcalth specifying thc numbcr ofpersons such a building or portion ofa building may lawfully accommodatc.
101i.4 There shall be a fee to procure a certificate of registration, which shall be valid for one ( I ) year or to December 3 I of each
year, rvhichcver is sooner Thereafter the permit shall bc annually renewcd.
108.5 A pernit issucd undcr this chaptcr shall bc revokcd if, at any time, the licensing authorities arc satisfied that the licensee is
unfit to hold the license. They may suspend and make inoperative, for such period oltime as they may deem proper, the
permit mentioned herein for any cause deemed satisfactory to them. The revocation and suspension shall not be made
until aftcr investjgation and a hcaring or after giving thc liccnsee an opportunity to be heard. Notice of the hearing shatl
be delivered to the permittee not less than three (3) days before the time ofthe said hearing.
108.6 Any person or tenant violating any provision of this chaptcr shall be punished by a fine of not morc than two hundred dollars
(5200.00). Each day's violation constitutes a separate offense.
