March 28, 2024 C19505.00 Yarmouth Conservation Commission Email & Hand Delivery Attn: Brittany DiRienzo, Agent Yarmouth Town Hall 1146 Route 28 South Yarmouth, MA 02664 Re: Statement of Compliance Certificate of Compliance Request Proposed Culvert Reconstruction Town of Yarmouth Sea Gull Beach Road Yarmouth, MA DEP File No: SE 83-2284 Dear Ms. DiRienzo and Commission Members: We have made final observation of the referenced property and find the work to be completed and in substantial conformance with the approved plans dated 05-19-2021, specifications and Restoration Order of Conditions issued on 06-08-2021. Minor deviations from the approved plans are as follows: 1. The areas on the plans labeled, “PROPOSED AREA OF VEGETATION RESTORATION” were planted with a coastal seed mix rather than the approved mix of bayberry, beach plum, American beach grass, and switch grass. 2. On the East Culvert, rip-rap was installed around the concrete wing walls to dissipate the discharge flow of water coming from the culvert. The rip-rap will also dissipate the runoff erosion coming from the roadway. The rip-rap was installed in a portion of the area on the proposed plans labeled, “PROPOSED AREA OF VEGETATION RESTORATION”. 3. A portion of the existing salt marsh was impacted with the installation of the rip-rap. The area of salt marsh that was impacted amounts to 12.4 sf. Therefore, on behalf of The Town of Yarmouth, we respectfully request a Certificate of Compliance be issued for this project.
