108.2 No person shall rent or lease, or offer to rent or lease, any building or any portion of a building to be used for human
habitation without first registering with the tsoard of Health, which shatl determine the number ofpersons such building or portion
ofa building may lawfully accommodate under the provisions ofthe Massachusetts State Sanitary Code, and without first
also conspicuously posting within such building or portion ofa buikling a certificate ofregistrarion provided by the Board of
Hcalth spccifying the number ofpcrsons such a building or ponion ofa building may lawfully accommodate.
108 4 There shall be a fee to procure a certificate of registration, which shall be r alid for one ( I ) year or to Dccember I I of eachycar, whichever is sooner Thereaftcr the pcrmit shall be annually renewed.
108.5 A pemrit issucd undcr this chapter shall be revoked if, at any time, the licensing authoritics arc satisficd that the licensec is
untlt to hold the license. They may suspend and make inoperative. for such period of time as they may deem proper, thepermit mentioned herein for any cause deemed satisfhctory to them. The revocation and suspension shall not be made
until after investlgation and a hcaring or after giving the licensce an opportunity to be hcard. Notice of the hearing shall
be delivered to the permittee not less than three (3) days before the time of the said hearing.
108 6 Any pcrson or tenant violating any provision of this chapter shall bc punished by a fine ofnot nrore than two hundred dollars
(5200.00). Each day's violation constitutes a separate ot'fense.
108.8 Thc owncrs of all rental units, as defincd in 10g.2, shall bc required to certifiz anuually that operating srnokedetectors have bcen placed in the rental unit. The smoke detectors and locations thcrcof shalt be satisfactory tothe \hrmouth Fire Dcpanmcnl.
NOTE: carbon Monoxide Detectors are required in any dwelling with oil, Gas, Coal, or wootl-buming equipment and,/ora structurally cncloscd or attached garage in accordance witil HlcL tq-s, ,".. 26F l2 and 52 7CVR3 l .00
