CHAPTER I08 108.2 No person shall rent or lease, or offer to rent or lease. any building or any portion of a building to be used for hunran habilation without first registering with the tsoard olHealth, rvhich shall determine the nunrber ofpersons such building or portion ofa building nray lawfully accommodatc undcr thc provisions ofthe Massachusetts Statc Sanitary Code, and without first also conspicr.lously posting within such building or portion of a building a certificate of rcgistration provided by the Board of Health spccifying the number ofpersons such a building or portion ofa building may lawfully accommodate. 108.4 There shall be a fee to procure a certificate of registration, which shall be valid for one ( I ) year or to December 3 I of each .vcar. rvhichever is sooner. Thereafter the permit shall bc annually renewed. l0ll.5 A pcmtit issucd under this chapter shall be rcvokcd it', at any time. the licensing authoritics arc satisfied that the licensee is unfit to hold the license. They may suspend and make inoperative. for such period of time as they may deem proper, the permit mentioned herein for any cause deemed satisl'actory to them. The revocation and suspension shall not be made until aticr invcstigation and a hearing or aftcr giving thc licensee an opportunity to bc hcard. Notice of thc hearing shall be delivered to the permittee not less than three (3) days belore the time ofthe said hearing. 108.6 Any pcrson or tcnant violating any provision ofthis chaptcr shall be punished by a tinc ofnot more than two hundred dollars (5200.00). Each day's violation constitutes a separate of'fense. 108.8 The owners of all rental units, as defined in 108.2, shall be required to ccrtify amually that operating smoke detectors have been placed in the rental unit. The smoke detectors and locations thereof shall be satisfactory to the Yarmourh Fire Dcpartment. NOTE: Carbon Monoxide Detectors are required in any dwelling with Oil, Gas.
