108.2 No persou shall rent or lease, or offer to rent or lease, any building or any portion ofa building to be used for human
habitation without Iirst registering with the Board of Health, which shall determine the number ofpersons such building or portion
of a building may lawfully accommodatc undcr the provisions of the Massachusetts State Sanitary Code, and without first
also conspicuously posting within such building or portion of a building a certificate ofreeistration provided by the Board of
Hcalth spccifying thc number of pcrsons such a building or ponion of a building may lawfully accommodatc.
I 08.4 Therc shall be a fee to procure a certi llcate of registration, rvhich shall be r alid for one ( I ) year or to December 3 I of each
ycar, whichcver is sooner Thereaftcr the permit shall be annually rencwed.
108.5 A pcrnrit issucd under this chapter shall be revoked if, at any time, the licensing authorities arc satisfied that thc licensec is
unfit to hold the license. They may suspend and make inoperative. for such period oltime as they may deem proper, the
permit mentioned herein for any cause deemed satisfactory to them. The revocation and suspension shall not be made
until aftcr invcstjgation and a hcaring or after giving thc licensee an opportuniry to be hcard. Notice of the hearing shall
be delivered to the pemlittee not less than three (3) days before the time of the said hearing.
108.6 Any person or tenant violating any provision ofthis chapter shall be punished by a finc ofnot more than two hundred dollars
(5200.00). Each day's violation constitutes a separate ot'fense.
108.8 The owners of all rental units, as defincd in 108.2, shall be required to ccrti! annually that opcrating smoke
detectors have bccn placed in the rental unit. Thc smoke detectors and locations thercof shall be satisfactory to
thc Yarmoulh Fire Depannrent.
NOTE: Carbon Monoxide Detectors are required in any dwelling with Oil, Gas. Coal, or wood-buming equipment and./or
a structurally enclosed or attached garage in accordance with MGL 148. sec. 26F12 and 527CMR3 l.O0
