The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting schedule. Contact the Conservation Office if you need assistance. Submitting an Application: Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2) Hardcopy filing dropped off or mailed to the Conservation Office including: 1 Administrative Checklist 1 complete NOI application WPA form 3 with original signatures. Typed signatures will not be accepted. Detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall include how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Regulations, delineation sheets (if BVW or vegetated wetlands are present) or other resource area calculations, and supporting information. 1 100’ radius map, current abutters list identifying the property owners who are to be notified per 310 CMR 10.00 and abutter notification form. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. All abutters must be notified via certified mail. Certified Mail Receipts (PS Form 3800) for all abutters. Green cards to be submitted at the hearing. 1 original and 6 copies of the plan, folded separately, right side out with title and project address visible. All plans shall reference NAVD1988 unless otherwise noted. Notice of Intent 19 Crowell Road Yarmouth, Massachusetts PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project located at 19 Crowell Road (the Site) in Yarmouth, MA involves the construction of a single-family home. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. 2.0 SITE DESCRIPTION The property located at 19 Crowell Road contains a vacant wooded lot. The property is bordered by single family homes to the north, south, east, and west. The wetland resource areas and areas of conservation jurisdiction on the site that are protected under the Wetlands Protection Act and the Town of Yarmouth’s Wetland Protection Bylaw include: • Land Subject to Coastal Storm Flowage, Zone AE (El. 11) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following activities: Construction of Single-Family Home: The proposed project involves the construction of a single -family home on the vacant lot at 19 Crowell Road. The only wetland resource area on Site is the Land Subject to Coastal Storm Flowage; FEMA Flood Zone AE Elevation 11. The entire property falls w ithin the flood zone. There are no other wetlands or associated buffer zones that affect the subject property. In total, the construction of the proposed home will have 16,200 sf of disturbance within LSCSF. A 600-gallon drywell is proposed in the west side yard, a 200-gallon dry well is proposed in the east side yard, a rain garden is proposed in the northeast corner of the lot, and a trench drain is also proposed at the front of the driveway. The trench drain will flow to the rain garden. These four features will improve stormwater management on Site. The existing lot is wooded with mature pitch pine and oak trees. To construct the single-family home approximately 21 pine trees and 12 oak trees will need to be removed. Fill is being brought in for grading in accordance with FEMA regulations. 4.0 PERFORMANCE STANDARDS The Massachusetts Wetlands Protection Act (310 CMR 10.00) does not include any performance standards for work within Land Subject to Coastal Storm Flowage. The Town of Yarmouth Wetlands Protection Regulations Section 4.10 does include performance standards for work within LSCSF. As such, below we have included a discussion of how the proposed project meets these performance standards. Section 4.10: Any activity within land subject to coastal storm flowage which will result in the building upon, removing, filling, or altering of land shall not have an adverse effect on the interests protected by the bylaw by: i. reducing the ability of the land to absorb and contain flood waters; The proposed project includes multiple stormwater improvements on Site (multiple dry wells, a trench drain, and rain garden) which will improve the Site’s capacity to absorb and contain flood waters. i. reducing the ability of the land to buffer more inland areas from flooding and wave damage; The proposed project includes multiple stormwater improvements on Site (multiple dry wells, a trench drain, and rain garden). Therefore, the proposed project will not reduce the ability of the land to buffer more inland areas from flooding. ii. increasing the elevation or velocity of flood waters, or by redirecting or increasing flows or causing channelization, in each case at the project site, adjacent or nearby properties, or any public or private way. The proposed project will not cause an increase in elevation or velocity of flood waters or by redirecting or increasing flows or causing channelization at the project site, adjacent or nearby properties, or pubic or private ways. The proposed project improves stormwater management on Site. Notice of Intent 19 Crowell Road Yarmouth, Massachusetts iii. displacing or diverting flood waters to other properties or resource areas. Fences and privacy walls, including walls separating one property from another, may obstruct or divert flood flow and waves toward buildings and protected areas. Solid fences (stockade and similar) must be constructed with 6 inches of clearance below to allow the passage of floodwaters and wildlife; The proposed project will not displace or divert flood waters to other properties or resource areas. The proposed stormwater features on Site will improve the Site’s ability to manage stormwater/floodwaters. No solid fences or walls are proposed. iv. causing, or creating the likelihood of, damage to other structures on land within the flood plain as debris (collateral damage); The proposed project will not cause of create the likelihood of damage to other structures within the flood plain. The proposed project includes multiple stormwater features that will improve stormwater management on Site, therefore reducing the likelihoo d of damage to other structures within the adjacent flood plain. v. causing ground, surface or saltate pollution triggered by coastal storm flowage; The proposed project includes multiple stormwater features that will improve stormwater management on Site. Therefore, the proposed project will not cause ground, surface, or saltate pollution triggered by coastal storms. vi. reducing the ability of the resource to serve as a wildlife habitat and migration corridor through activities such as, but not limited to the removal of substantial vegetative cover and/or installation of fencing and other structures which prevent wildlife migration across property. The proposed project does not include any fencing or other structures that would prevent wildlife migration across the property. The project does include some removal of existing trees on Site but will retain a number of mature trees along the perimeter of the property. vii. prevention of the migration of resource areas such as salt marshes due to sea level rise. The proposed project is not located near any salt marshes, as such will not affect the ability of any local salt marsh to migrate landward due to sea level rise. viii. If flood control and storm damage protection functions have already been impaired, redevelopment must improve existing conditions by reducing impervious surfaces, restoring flood control and storm damage protection functions, installing native plantings, or by restoring or creating other wetland resource areas. The Site is not currently developed, and the functions of flood control and storm damage prevention have not been impaired. As such, this performance standard does not apply. However, the proposed project includes significant stormwater management improve ments which will improve the Site’s ability to provide flood control and storm damage protection. And shall meet the following requirements; ix. Existing septic system and cesspool repairs will be allowed provided they meet all Title 5 and local Board of Health thresholds. The proposed project does not include existing septic system repairs. However, the proposed single - family home will have a Title V septic system installed. x. All groundwater elevations shall incorporate seasonable adjustments if test holes and or leaching components are 100 feet or closer from major estuaries. The project Site is not located within 100’ of a major estuary. The Site is ~0.5 miles from Lewis Bay. xi. Any proposed deck, shed, or other similar structure must be securely anchored to a footing or foundation. The proposed project does not include any deck or shed. xii. Any activity shall preserve existing soils, vegetation, and other natural conditions that serve as buffers to coastal flooding and storm surges. The proposed project will preserve existing soils and vegetation as much as feasible. Mature trees will be removed from the area where the single-family home is proposed but mature trees along the perimeter of the Site will remain. Existing soil will say on Site. Notice of Intent 19 Crowell Road Yarmouth, Massachusetts 5.0 MITIGATION MEASURES Prior to the start of work a line of sediment controls (e.g. straw wattles) will be installed along the limit of work to prevent sediment migration off Site. Upon completion of construction all disturbed areas will be stabilized and seeded with an upland grass lawn mix. A roll off container will be stored in the ar ea of the proposed driveway to collect construction debris.
