This letter is a request to allow the properties that received decision from Old Kings Highway Historic
District Commission, and were subject to the Solar Wolf issues, to proceed with their projects under those
approvals.
Around May of 2022 it was discovered that Solar Wolf, a solar installation company, defrauded
approximately 70 households by requesting funds then not performing the installation. Of the 70 households,
19 households had received approvals through the Old Kings Highway District Committee. These approved
plans have not changed since that approval. Other households requiring further action are at the bottom of the
list.
Since May 2022, these homeowners have been moving through various legal matters to attempt recovery. The
State and Town have been working toward a solution to resolve the homeowners' issues. In October of 2023,
the Town, and MassCEC (Massachusetts Clean Energy Center) executed an agreement to work together
toward resolving the homeowner issues. The Town has been coordinating communications with the
homeowners, confirming the client list among other steps.
MassCEC, since October has been working with SunPower and Incite Energy toward providing relieve for the
households impacted by Solar Wolf. Described in its simplest form, the unique program titled "Yarmouth
Assistance Program" will provide installations and cover costs already paid to Solar Wolf.
Because of the Solar Wolf issues, and the resulting program interruption, none of the homes with valid OKH
approvals were able to proceed. Therefore, the request is that the households with previous OKH approvals
are exempt from the requirements for an extension and as a result will be extended for one year from April
11 m, 2024.
With your approval, the attached list of 19 homes that have permits regarding the Old Kings Highway
Commission will be allowed to proceed with the understanding of an Exemption that will allow a one-year
extension from April 11'", the beginning of the Yarmouth Assistance Program. Such extended approvals are
understood to be in keeping with the original approval with no planned changes.

On Tuesday, August 3, 2021, at 1:30 P. M. the Old King's Highway Regional Historic
District Commission, here in after called the Regional Commission, held a public hearing
at the West Barnstable Fire Station Meeting Room, 2160 Meetinghouse Way (Route
#149), West Barnstable, Massachusetts, on Appeal No. 2021-7 filed by Eduard Senteio
seeking reversal of the Old King's Highway Regional Historic District Committee for the
Town of Yarmouth, hereinafter called the Yarmouth Town Committee, decision to deny
application #21-A087 for a Certificate of Appropriateness for the installation of a rooftop
solar array system to the roof of the house located at 27 Winter Street, Yarmouth Port,
Massachusetts. Said property being shown on Town Map 132 as lot 68.
The Yarmouth Town Committee's decision was made on June 28, 2021, and notice filed
with the Yarmouth Town Clerk on June 29, 2021. A copy of the Appeal Petition form
was filed on Thursday, July 8, 2021, and was available for public viewing at the
Yarmouth Town Clerk's Office during regular business hours.
Present at the public appeal hearing for the Regional Commission were Vice Chairman
William Bohlin of Dennis, who presided over the proceedings; Richard E. Gegenwarth of
Yarmouth; Member James Trabulsie of Brewster; Member Paul Richard of Barnstable;
Member Ronald Mgrdichian of Orleans; and James R. Wilson, Commission
Administrative Counsel.
Absent was Commission Member Mary Foley of Sandwich.
Present were Eduard Senteio the Appellant/Applicant, his co-owner of the property, Lisa
McNeill, and the selling agent Solar Wolf Energy, Inc. represented by its C.E.O. Taylor
Bennett.
Background Information for Aaaeal No. 2021-7:
1.) The Regional Commissioners had reviewed the abutter's list, the Application with
specifications, images, and diagrams showing a westerly rear roof array with 8 solar
panels and the easterly street facing array with 22 solar panels submitted by Solar Wolf
Energy, Inc., written notice of the denial indicating that the easterly street facing array
was inappropriately visible from Winter Street, the Appeal Petition, and the Video of the
June 28, 2021, Yarmouth Town Committee public hearing.
2.) The Regional Commissioners had individually visited the site and observed the
Applicant's colonial style house and the Winter Street facing roof where the 22 solar
panel array is proposed to be located.
3.) The Regional Commissioners had observed the setting, vegetation, buildings, and
structures located in the immediate neighborhood of the proposed project.
Appellant/Applicant's Presentation:
Taylor Bennett of Solar Wolf Energy, Inc. addressed the Regional Commission on behalf
of the appeal. She introduced herself as being the C.E.O. of Solar Wolf Energy, Inc., the
representative for the purchasers of the of the rooftop solar panel array system to be
erected on their property located at 27 Winter Street, Yarmouth Port, Massachusetts.
She submitted pictures of the purchaser's property and other properties that appear to
have been approved for rooftop solar panel arrays. She argued that the Yarmouth Town
Committee had set a precedent by approving other applications and therefore must have
been acting in an arbitrary, capricious, and erroneous manner in denying the application.
She claimed that the rear roof would face northwest and indicated that according to Solar
Wolf Energy, Inc. calculations, only a small portion of the rear roof location would be
acceptable for a rooftop solar panel array. She stated that the house was built in 1976 and
was not listed on the National Register of Historic Places or visible from Route 6A. She
described the house as being the most set back house on Winter Street and greatly
obscured from view by large sets of evergreen trees, vegetation, and a garage. She
suggested that traffic was light on Winter Street and that the house was often missed by
persons traveling by the property.
Reading from a written script, Ms. Bennett launched into a series of degrading and
demeaning personal attacks upon the volunteer members of Yarmouth Town Committee
asserting bias, prejudice, and unfairness in the review of the rooftop solar panel systems
that Solar Wolf Energy, Inc. was selling to the people residing within the Old King's
Highway Regional Historic District.
She aggressively dismissed the Yarmouth Town Committee's concern for the visual
impact of solar panel arrays as being reflective of a personal bias against solar panels,
Solar Wolf Energy, Inc., Solar Plus Yarmouth Program, and the Yarmouth Energy
Committee. She implied that the members of the Yarmouth Town Committee did not
have the ability, expertise, or capacity to suggest alternative less visible locations and
designs for the placement of solar panel arrays within the designated historic district area.

She ended her presentation by requesting that the Regional Commission reverse the
judgement of The Yarmouth Town Committee and issue the Certificate of
appropriateness for the proposed street facing project.
Yarmouth Town Committee's Presentation:
Richard Gegenwarth, Chairman of the Yarmouth Town Committee, disputed the
accuracy of the representation being put forth by Ms. Bennett. He challenged the claim
that the rear roof was facing northwest and would be only 50% productive in comparison
with the proposed front roof orientation.
Dr. Gegenwarth, who has extensive expertise and experience in the use of solar and
geothermal energy systems, defended the Yarmouth Town Committee's decision with an
in-depth technical presentation pointing out that the percentage projections appearing in
the thirty -one -page application were incorrect and possibly distorted to support Solar
Wolf Energy, Inc. 's claim that the street facing solar panel array was the only suitable
location for the 27 Winter Street property.
He pointed out that the ridgeline of the houses located at 21 Winter Street and 27 Winter
Street were identically aligned with the street and shared a direct solar south orientation.
He indicated that the front and rear roofs of both houses with similar roof pitch would
have similar Tilt and Orientation Factors (TOF). He stated that Wolf Solar Energy, Inc. 's
submitted calculations did not reflect this fact.
He reported that Solar Wolf Energy, Inc. had filed an application seeking approval for a
solar panel array next door located at 21 Winter Street. He stated that the design layout
for that project called for the entire rooftop solar panel array to be located out of sight on
the rear roof that had an identical Tilt and Orientation Factor (TOF) that had been
criticized and incorrectly represented by Solar Wolf Energy, Inc. as facing northwest.
He claimed that the Solar Wolf Energy, Inc. weather projections submitted in the 27
Winter Street application for monthly solar access were locally inaccurate and inflated.
Dr. Gegenwarth explained that each application is reviewed by the Yarmouth Town
Committee on its own objective merits under the Historic District Act which will include
the energy advantage as reflected in the projected efficiency and possible alternative
designs and locations to be considered against the visual impact of the proposed rooftop
solar panel array.
He indicated that in this particular application for 27 Winter Street, the Yarmouth Town
Committee believed that there are better alternative locations on the property than the
requested front roof solar panel array. He claimed that a less visible system could match
or exceed the solar energy production for the applicant while having a less visual impact
on the preservation of the surrounding neighborhood.
He claimed the use of the rear roof in combination with the flatter garage roof would
provide a more efficient design solution for a rooftop solar panel system and would better
preserve the traditional visual character of the historic district.
Public Comment:
Mr. Bohlin asked for public comment on the appeal that was before the Regional
Commission.
Joyce Flynn identified herself as the Chairperson of the Yarmouth Energy Committee.
She described her efforts to promote the purchase of solar panel systems through the
Solarizing Plus Yarmouth Program and the efforts to increase the sale of solar panels
with a "huge" discount in price and other initiatives. She expressed personal concern that
people were being recruited and encouraged by Yarmouth Energy Committee program to
purchase solar panel systems from Solar Wolf Energy, Inc. and were finding uncertainty
and approval problems with the Yarmouth Town Committee. She expressed frustration
that she could not change the Old King's Highway Regional Historic District law and
hoped that the appeal could bring change to the situation.
Jim Wolf reported that he had purchased solar panels from Solar Wolf Energy, Inc. and
had been approved by the Yarmouth Town Committee. He spoke in favor of the appeal
and expressed the opinion that Solar Wolf Energy, Inc. was a good company and that he
supported the comments by Joyce Flynn. He asked that the Regional Commission adopt a
policy that would allow everyone to be able to put up a rooftop solar panel array.
Appellant/Applicants' Rebuttal & Conclusion:
Ms. Bennett defended the computer shading software that Solar Wolf Energy, Inc. had
used in preparing the design and projecting the calculations for the project. She indicated
that it was one of four programs approved by the Commonwealth of Massachusetts for
qualifying to receive the financial benefits from the State's solar incentive programs.
She denied that Solar Wolf Energy, Inc. calculations were inflated and stated that the
designers will factor in adjustments that will underestimate the energy return on the
investment in an effort to not disappoint the customer after the installation.
She claimed that the type of rooftop solar panel system that was being used in the
application was a high -end product and that the discount was based upon a special group
rate price.
She asked Lisa McNeill, a co -purchaser of the rooftop solar panel array to make her
statement to the Regional Commissioners.
Lisa McNeill stated that she found the conduct of the members of the Yarmouth Town
Committee unprofessional and offensive. She criticized the comments made by the
individual members of the Yarmouth Town Committee. She indicated that she and her

husband felt insulted and disrespected during the review of their application. She
expressed the opinion that their application was treated differently than those that were
submitted by other Sellers that had been granted Certificates of Appropriateness.
She expressed support for their provider, Solar Wolf Energy, Inc., and the Yarmouth
Energy Committee's Solarize Plus Yarmouth Program. She declared that their
application was the first purchased under the Solarize Plus Yarmouth Program.
Eduard Senteio supported his wife's observations and reported that the people around
them share their feeling that their project was attacked in a disrespectful and
unprofessional manner during the June 28, 2021, hearing.
Vice Chairman Bohlin suggested that in all these applications there are less visible
alternative plans that are available and can be implemented to produce solar energy.
Mr. Senteio agreed with Mr. Bohlin that there were alternatives to the Solar Wo rEnergy,
Inc. plan of placing the panels on the front street facing roof. However, he expressed the
opinion that they might be more expensive and less efficient.
He concluded by suggesting that he ought to be able to determine how he spends his
money, not somebody else.
Yarmouth Town Committee Rebuttal & Conclusion:
Dr. Gegenwarth insisted that the Yarmouth Town Committee had acted properly in
reviewing the solar panel applications that came before it. He disputed the accusations of
unfairness or bias in the rejection of the submissions being put forth by Solar Wolf
Energy, Inc., and the apparent political support being generated against the denial of any
solar panel applications by the Yarmouth Energy Committee and its Solarize Plus
Yarmouth Program.
He pointed out the many differences in the two Tesla solar roof applications that were
approved at the June 28, 2021, Meeting that the subject application was judged to be
inappropriate.
He concluded by indicating that he continues to support the Yarmouth Town
Committee's decision to deny the application for a Certificate of Appropriateness for
front roof of the house located at 27 Winter Street, Yarmouth Port.
Closure of Public Hearing:
Vice Chairman Bohlin announced the closure of the public hearing and stated that the
Regional Commissioners would attempt to decide the appeal. He stated that the parties
and public could remain to observe and hear the deliberations but would not be allowed
to comment or participate in the procedure.
Regional Commission Discussion:
Vice Chairman William Bohlin of Dennis began the discussion by asking each of the
Regional Commissioners to comment on the appeal.
Commissioner Mgrdichian of Orleans began the review by indicating the importance of
his visit to the site and the observation of the dwelling as seen from the Winter Street. He
noted the importance of the visibility of a rooftop solar panel array when it is to be sited
on a street facing front roof of a house. He pointed out that pictures and photographs can
give many different kinds of perspectives because they can be taken from many different
distances and angles but cannot replace the significance of an actual site visit in judging
the visibility factor in determining appropriateness under the Historic District Act. He
indicated that if he were judging the appropriateness of the proposed project on the
visibility factor, he would have agreed with the Yarmouth Town Committee and denied
the application for the same stated reason.
In regard to the allegations of the members being arbitrary, capricious, or erroneous in
reviewing the application and other alleged personal mistakes by the individual members
of the Yarmouth Town Committee, he indicated that he did not hear or observe
persuasive evidence or support for the accusations. He acknowledged that sometimes it
can be hard to follow Dr. Gegenwarth's lengthy explanations about the highly technical
features of a proposed rooftop solar panel array application and the possible alternatives.
Commissioner Trabulsie of Brewster expressed concern for the need to have the
Yarmouth Energy Committee and the Yarmouth Town Committee come together to
develop a viable solution to their apparent competing and conflicting interests. He
indicated that he did not observe in the June 28, 2021, video support for the degrading
and demeaning personal attacks on the members of the Yarmouth Town Committee. He
indicated that he felt that the Yarmouth Town Committee's Vice Chairperson did a very
good job of keeping order in a highly emotionalized clashing of ideas and opinions.
He noted the importance of keeping local control over the character and appearance of
each of the six member towns. He suggested that each town has its own character and
that he does not like to substitute his judgement of appropriateness for that of a local
town committee.
He referenced the criteria contained in the specific Guidelines for solar panel
installations, and the importance of considering the visual impact that the solar panel
array will have on the surrounding neighborhood and weighing it against the energy
advantage of the proposed rooftop solar panel system. He indicated that in this particular
case, he felt that the Appellant/Applicant did a better job in presenting the facts
supporting a conclusion that the solar panel array would have a minimum visual impact
on the neighborhood than the Yarmouth Town Committee did in defending its decision to
deny the application.

Commissioner Richard agreed with Mr, Trabulsie's observations. He reported that he
reviewed the complete video of the June 28, 2021, hearing and felt that there had been a
procedural error by the Yarmouth Town Committee in the reviewing the application. He
suggested that the Applicant ought to have been given a greater opportunity at the
beginning of the hearing to present the facts supporting the application.
Vice Chairman Bohlin indicated that he agreed with Mr. Trabulsie and Mr. Richard's
opinion about the possible error by the Yarmouth Town Committee in not allowing the
Applicant a greater opportunity to present the application at the beginning of the review
process.
Commission Counsel asked the Regional Commissioners if they were ready to consider
and adopt a set of facts on the appeal. The Commissioners indicated that they were
prepared to make a set of findings. After review and editing, the following facts were
adopted.
Commissioner Richard moved, seconded by Mr. Trabulsie, that the following finding of
facts be adopted and incorporated into the Regional Commission's decision. The motion
was adopted by a vote of 3-1-1. (Bohlin, Richard, & Trabulsie, in favor; Mgrdician,
opposed; Gegenwarth, abstaining)
The Regional Commission findings:
1. The project consists of a request to install a solar panel array of thirty solar panels on
the roof of a dwelling located at 27 Winter Street, Yarmouth Port, Massachusetts being
shown on Town Map 132 as Lot 68.
2. The house is located within the Old King's Highway Regional Historic District and
portions of the proposed solar panel array will be visible from Winter Street which is
public way.
3. The Yarmouth Town Committee had jurisdiction and the authority under the Old
King's Highway Regional Historic District Act to determine the appropriateness of the
proposed rooftop solar panel array.
4. The dwelling is set back from the road with screening from trees and other vegetation
that would appear to obscure some of the rooftop solar panels thereby minimizing their
visual impact on the surrounding neighborhood.
S. The Yarmouth Town Committee made an error in denying the submitted application
for the proposed solar panel array.
6. The Yarmouth Town Committee decision denying approval of the proposed solar
panel array should be annulled and a Certificate of Appropriateness issued for the
application as submitted.
Regional Commission's Determination:
Commissioner Richard moved, seconded by Commissioner Trabulsie that the Regional
Commission vote to annul the Yarmouth Town Committee's determination and issue the
Certificate of Appropriateness to Eduard Senterio for the installation of 30 smooth matte

black solar panels on a dwelling located at 27 Winter Street, Yarmouth Port,
Massachusetts, which is shown on Yarmouth Town Map 132 as Lot 68. It is hereby noted
that we find that the Yarmouth Town Committee made an error in denying the
application and that the Certificate of Appropriateness in Application #21-A087 is hereby
issued to the Applicant.
The motion carried by a vote of 3 - 1 - 1. (Richard, Trabulsie Bohlin, in favor;
Mgrdichian, opposed; Gegenwarth abstaining)
Any person aggrieved by this decision has a right to appeal to the District Court
Department, Barnstable Division, within 20 days of the filing of this decision with the
Yarmouth Town Clerk.
