Scott This letter is a request to allow the properties that received decision from Old Kings Highway Historic District Commission, and were subject to the Solar Wolf issues, to proceed with their projects under those approvals. Around May of 2022 it was discovered that Solar Wolf, a solar installation company, defrauded approximately 70 households by requesting funds then not performing the installation. Of the 70 households, 19 households had received approvals through the Old Kings Highway District Committee. These approved plans have not changed since that approval. Other households requiring further action are at the bottom of the list. Since May 2022, these homeowners have been moving through various legal matters to attempt recovery. The State and Town have been working toward a solution to resolve the homeowners' issues. In October of 2023, the Town, and MassCEC (Massachusetts Clean Energy Center) executed an agreement to work together toward resolving the homeowner issues. The Town has been coordinating communications with the homeowners, confirming the client list among other steps. MassCEC, since October has been working with SunPower and Incite Energy toward providing relieve for the households impacted by Solar Wolf. Described in its simplest form, the unique program titled "Yarmouth Assistance Program" will provide installations and cover costs already paid to Solar Wolf. Because of the Solar Wolf issues, and the resulting program interruption, none of the homes with valid OKH approvals were able to proceed. Therefore, the request is that the households with previous OKH approvals are exempt from the requirements for an extension and as a result will be extended for one year from April 1 l uh, 2024. With your approval, the attached list of 19 homes that have permits regarding the Old Kings Highway Commission will be allowed to proceed with the understanding of an Exemption that will allow a one-year extension from April l I'b, the beginning of the Yarmouth Assistance Program. Decision for Appeal No. 2021-8 Old King's Highway Regional Historic District Committee for the Town of Yarmouth On Tuesday, August 3, 2021, at 3:30 P. M. the Old King's Highway Regional Historic District Commission, here in after called the Regional Commission, held a public hearing at the West Barnstable Fire Station Meeting Room, 2160 Meetinghouse Way (Route #149), West Barnstable, Massachusetts, on Appeal No. 2021-8 filed by Christine and Elaine Brennan seeking reversal of the Old King's Highway Regional Historic District Committee for the Town of Yarmouth, hereinafter called the Yarmouth Town Committee, decision to deny application #21-A103 for a Certificate of Appropriateness for the installation of a rooftop solar array system to the roof of the attached garage located at 67 Merchant Avenue, Yarmouth Port, Massachusetts. Said property being shown on Town Map 127 as lot 35. The Yarmouth Town Committee's decision was made on July 12, 2021, and notice filed with the Yarmouth Town Clerk on July 14, 2021. A copy of the Appeal Petition form was filed on Thursday, July 16, 2021, and was available for public viewing at the Yarmouth Town Clerk's Office during regular business hours. Present at the public appeal hearing for the Regional Commission were Vice Chairman William Bohlin of Dennis, who presided over the proceedings; Richard E. Gegenwarth of Yarmouth; Member James Trabulsie of Brewster; Member Paul Richard of Barnstable; Member Ronald Mgrdichian of Orleans; and James R. Wilson, Administrative Counsel. Absent was Commission Member Mary Foley of Sandwich. Present were Christine Hammond and Elaine Brennan the Appel lant/Applicants, and the selling agent Solar Wolf Energy, Inc. represented by its C.E.O. Taylor Bennett. Background Information for Appeal No. 2021-8: 1.) The Regional Commissioners had reviewed the abutter's list, the Application with specifications, images, and diagrams showing a southwesterly street facing roof array with 18 solar panels submitted by Solar Wolf Energy, Inc., written notice of the denial indicating that the street facing array was fully visible from a public way, the Appeal Petition, and the Video of the July 12, 2021, Yarmouth Town Committee public hearing. 2.) The Regional Commissioners had individually visited the site and observed the Applicant's one-story traditional style house with an attached garage and the public way facing roof on the attached garage where the 18 solar panel array was proposed to be located. 3.) The Regional Commissioners had observed the setting, vegetation, buildings, and structures located in the immediate neighborhood of the proposed project. Appellant/Aaalicant's Presentation: Taylor Bennett, C.E.O. of Solar Wolf Energy, Inc., addressed the Regional Commission on behalf of the appeal. She identified her company as the seller/contractor for Christine Hammond and Elaine Brennan the buyer/customers of the proposed rooftop solar panel array system that was to be placed on the front roof of an attached garage located at 67 Merchant Avenue, Yarmouth Port, Massachusetts. She submitted copies of pages 30 & 31 from the O.K.H.R.H.D.C. Bulletin's Guidelines, pictures of 9 properties that had been previously approved for rooftop solar panel arrays, a supporting statement signed by 5 nearby neighbors, a memo dated November 3, 2020, from the Chairman of the Yarmouth Town Committee to the Chairman of the Board of Selectmen regarding a Special Town Meeting Article concerning the Solarize Yarmouth Plus Program. Ms. Bennett began her presentation by advocating a new policy for the administration of the historic district law. A policy that she readily acknowledged is not shared or being used by the Yarmouth Town Committee or Regional Commissioners as the administrators of the Historic District Act. Under the policy each approval or disapproval of a specific exterior architectural feature, i.e., a rooftop solar panel array system, would be viewed as setting precedent for future determinations and would require future Town Committees and Regional Commission judgements for appropriateness of features to be based upon a factor or criteria not set forth in the Historic District Act or its Guidelines. As noted in her submitted and yellow highlighted page 30 Guideline: Section 3. Style: "... the Act does not require that design be limited to repetition of existing or previous architectural styles," She advocated that instead of reviewing each application with a case -by -case review process that considers the merit of each application by the factors and features set forth in Section 10 of the Historic District Act and by adhering to all the specific criteria listed for solar panel installations under the Guidelines for Energy Conscious Design, she strongly advocated a blanket approval for the Solar Wolf Energy, Inc. applications without any modification to its design features or location within the historic district. She accused the Yarmouth Town Committee of inconsistency by approving other applications and not approving the subject application. She inferred that all solar panel applications are the same and therefore the denial of the application must indicate the N members are acting in an arbitrary, capricious, and erroneous manner in denying the application. Addressing the specific application, she used the applicant's drafted statement to indicate that the Merchant Avenue subdivision was built in the late 1960s and in the opinion expressed in the statement the house provides no historic value to the neighborhood. She claimed that the subject lot was located in a remote part of the historic district and that while the solar panels could be seen from Merchant Avenue, very few people would be driving by the property or observing the solar panel array located on the front roof of the garage. She dismissed a suggestion to locate the solar panels on the less visible rear side of the house. She claimed that the rear roof would face in a Northeast direction and that it would be more expensive and less efficient for the production of solar energy. She ended her presentation by requesting that the Regional Commission reverse the judgement of The Yarmouth Town Committee and issue the Certificate of appropriateness for the proposed street facing project. Yarmouth Town Committee's Presentation: Richard Gegenwarth, Chairman of the Yarmouth Town Committee, disputed the accuracy of the representations being put forth by Applicants and their Agent. He stated that from a solar energy perspective the claim that the rear roof was facing Northeast or that it would be less energy efficient than the Solar Wolf Energy, Inc. front roof proposal was inaccurate. Dr. Gegenwarth, who has extensive expertise and experience in the use of solar and geothermal energy systems, defended the Yarmouth Town Committee's decision with a technical analysis pointing out that the rear roof would face Follin's Pond and had a potential to produce a greater annual solar energy advantage than Solar Wolf Energy, Inc. 's claim that the street facing solar panel array would produce for the 67 Merchant Avenue property. He indicated that the ridgeline of the house had a direct solar south orientation giving the rear roof a due East direction. He indicated that the front and rear roofs of both houses with similar roof pitch would have similar Tilt and Orientation Factors (T.O.F.). He claimed that the Solar Wolf Energy, Inc. weather projections submitted in the 67 Merchant Avenue application for yearly solar access appeared to be locally inaccurate and inflated. Dr. Gegenwarth indicated that the application was reviewed by the Yarmouth Town Committee on its own specifications under the Historic District Act which includes the energy advantage as reflected in the projected efficiency and possible alternative designs 3 and locations to be considered along with the visual impact of the proposed rooftop solar panel array. He indicated that in this particular application, he believed that there are better alternative locations on the property than the requested front roof solar panel array. He claimed that a less visible system could match or exceed the solar energy production for the Applicants while having a less visual impact on the preservation of the surrounding neighborhood. Commissioner Trabulsie of Brewster asked why the Yarmouth Town Committee did not ask to continue the matter to the next meeting to give the Applicants a chance to come back with alternative less visible design plans for the placement of the solar panel array. Dr. Gegenwarth indicated that statements being made during and outside the public hearing indicated that it was an all or nothing proposal and that there was no room for a compromise on the visibility issue but only an appeal. Public Comment: Mr. Bohlin asked for public comment on the appeal that was before the Regional Commission, Mike Duffy identified himself as a member of the Yarmouth Energy Committee and the Coach for the Solarizing Plus Yarmouth Program. He stated that he spent the last five years at the National Renewable Energy Laboratory in Golden, Colorado and indicated that he had a lot of experience in the country's national climate change issues and the many available government incentive programs. He stated that he wrote the December 2019 proposal to the Clean Energy Center of Massachusetts to get a grant for the Solarizing Plus Yarmouth Program. He indicated that the grant would probably be the last one as the source for the funding had run out of money. He described his job as the Solar Coach for the Solarizing Plus Yarmouth Program. He indicated that his job is not to design a solar panel system or stand before the Yarmouth Town Committee or Regional Historic Commission to defend an applicant or the application. He stated that his job was to identify prospective customers and turn their name, email address, and contact information over to Solar Wolf Energy Inc. He reported that the role of Solar Wolf Energy Inc. was to work with the customer to develop a site assessment, design plan, and if the person lived within the historic district, prepare the application for the Yarmouth Town Committee. Mr. Duffy indicated that after observing the Old King's Highway Regional Historic District proceedings he would, if asked, advise a prospective customer that lived in the historic district: "If you don't live on a cul-de-sac don't bother because under the Solarize Plus Yarmouth Program, the people are putting money up front and if they get denied they might end up losing their money which he felt would be unfair and not equitable." 4 Commissioner Trabulsie asked Mr. Duffy if he were an employee or being paid by Solar Wolf Energy, Inc. ? Mr. Duffy stated that he was not being paid for his referrals, but that he was working as a volunteer like everyone else on the Yarmouth Energy Committee. Joanne Kelly identified herself as a good friend of the Applicants and a historian that believed strongly in wind and solar power and wanted to express support for the appeal. Appellant/Applicants' Rebuttal & Conclusion: Ms. Bennett denied that Solar Wolf Energy, Inc. was pushing appeals. She stated that placement on the rear roof were considered and rejected because of tree shading and other factors. She reported that there was another situation where Solar Wolf Energy, Inc. was working with the owner to move the solar panel array to a ground mounted system at the request of the Yarmouth Town Committee. Yarmouth Town Committee Rebuttal & Conclusion: Dr. Gegenwarth announced that he had received an email from Ted Strzelecki, Chair & Founder of Solar Wolf Energy, Inc., who apologized for the aggressive approach being taken before the Yarmouth Town Committee and that their team would be taking a less offensive approach going forward. Closure of Public Hearing: Vice Chairman Bohlin suggested that that would be a step in the right direction and announced the closure of the public hearing. He stated that the Regional Commissioners would attempt to decide the appeal. He announced that the parties and public could remain to observe and hear the deliberations but would not be allowed to comment or participate in the procedure. Regional Commission Discussion: Vice Chairman William Bohlin of Dennis began the discussion by asking each of the Regional Commissioners to comment on the appeal. Commissioner Mgrdichian of Orleans stated that if he had voted on the application, he would have voted to approve it, because it did not appear to have that much visibility. Commissioner Trabulsie of Brewster expressed reluctance to substitute his judgement for that of the Yarmouth Town Committee and felt that the aggressive behavior shown by the Applicant's agents during the July 12, 2021, hearing was appalling and deserved the apology that Dr. Gegenwarth had received from the Chair & Founder of Solar Wolf 5 Energy, Inc. He indicated that he thought that Vice Chairman Robert Wilkins did a good job of keeping order during the July 12 public hearing, but he also felt that his observation of the proposed location for the solar panel array did meet the criteria of having a minimum visual appearance. He felt that in traveling by the attached garage on Merchant Avenue one would not notice the display because of its set back distance and screening vegetation. Commissioner Richard of Barnstable stated that looking at this particular location, he found it to be very remote, screened by vegetation and having a minimal public visibility. He indicated that he felt that the Yarmouth Town Committee made an error, and the application ought to have been approved. Vice Chairman Bohlin indicated that he agreed with his fellow Commissioners about the proposed solar panel array appearing to have a minimal visual impact. He expressed concern about the temperament of the proceedings and felt that there was fault on both sides. He suggested that both sides needed find a better way to move forward and resolve their differences. Commission Counsel asked the Regional Commissioners if they were ready to consider and adopt a set of facts on the appeal. The Commissioners indicated that they were prepared to make a set of findings. After review and editing, the following facts were adopted. Commissioner Richard moved, seconded by Mr. Trabulsie, that the following finding of facts be adopted and incorporated into the Regional Commission's decision. The motion was adopted by a vote of 4-0-1. (Bohlin, Richard, Trabulsie, & Mgrdician, in favor; None, opposed; Gegenwarth, abstaining) The Regional Commission findings: l . The project consists of a request to install a solar panel array of eighteen solar panels on the roof of an attached garage located at 67 Merchant Avenue, Yarmouth Port, Massachusetts being shown on Town Map 127 as Lot 35. 2. The attached garage is located within the Old King's Highway Regional Historic District and the proposed solar panel array will be visible from Merchant Avenue which is a public way. 3. The Yarmouth Town Committee had jurisdiction and the authority under the Old King's Highway Regional Historic District Act to determine the appropriateness of the proposed rooftop solar panel array. 4. The attached garage is set back from the road with screening from trees and other vegetation that would appear to obscure some of the rooftop solar panels thereby minimizing their visual impact on the surrounding neighborhood. 5. The Yarmouth Town Committee made an error in denying the submitted application for the proposed solar panel array. 6 6. The Yarmouth Town Committee decision denying approval of the proposed solar panel array should be annulled and a Certificate of Appropriateness issued for the application as submitted. Regional Commission's Determination: Commissioner Richard moved, seconded by Commissioner Trabulsie that the Regional Commission vote to annul the Yarmouth Town Committee's determination and issue the Certificate of Appropriateness to Christine Hammond and Elaine Brennan for the installation of 18 smooth matte black solar panels on an attached garage located at 67 Merchant Avenue, Yarmouth Port, Massachusetts, which is shown on Yarmouth Town Map 127 as Lot 35. It is hereby noted that we find that the Yarmouth Town Committee made an error in denying the application and that the Certificate of Appropriateness in Application #L21-A103 is hereby issued to the Applicants. The motion carried by a vote of 4 - 0 - 1. (Richard, Trabulsie Bohlin, & Mgrdichian, in favor; None, opposed; Gegenwarth abstaining) Any person aggrieved by this decision has a right to appeal to the District Court Department, Barnstable Division, within 20 days of the filing of this decision with the Yarmouth Town Clerk.
