It appearing that notice of the hearing has been given by sending notice to the petitioners and all
of those owners of property deemed to be affected thereby, and to
the public by posting notice of

the hearing and published in The Register, the hearing was opened and held on the date stated
above.
The petition was presented by Ray Castano, the proposed building contractor, on behalf of the
property owners, Gary and Karen Jones. The property is a 20,012 square foot lot improved with
the petitioners' single family home. The petitioner proposes to construct a Family Related
Apartment at the Northerly end/side of the house, and to do so seeks a special permit under §407 0
and §203.5 (A-10), and a special permit for this use in the Aquifer Protection District, per §406.
The necessary referrals to other Town Bodies have been made prior to the hearing.
The proposed apartment is shown on the petitioner's architectural plans (4 sheets). As confirmed
by the Site Plan Review, the apartment unit satisfies the physical limitations and specifications of 3\
its bylaw. The petitioners are aware of the limitations for family related apartments, and have `
executed the required affidavit of intended occupancy of the House and Apartments, and the
Covenant to comply with the Bylaw.
The A.P.D. reviewing Bodies gave no adverse recommendations.
The only additional concern expressed by the Board was with the layout and design of the
Apartment Unit (sheet 4 of the plans). The plans, as filed, suggest that the apartment would
include the area adjacent to the "covered porch", including the laundry area. The petitioner

confirmed that the plan should have included a lockinglexterior (to the unit) door separating the
hallflaundry area, and that it would in fact be installed at the opening shown on the plan. The
hall/laundry area would not be or become part of the "apartment", but would remain as part of the
main dwelling.
After discussion, a Motion was made by Mr. Robertson, seconded by Mr. Richards, to Grant a
Special Permit per §202.5 and §407 for a Family Related Apartment, and a Special Permit per
§406 for the Family Related Apartment, both as shown'on the submitted plans, on the conditions
that the petitioners (homeowners) execute and record, in the Registry of Deeds, the required
covenant, affidavit, and notice of decision, prior to the issuance of an occupancy permit ( and
present proof thereof to the Building Department), and on the condition that the plans be
corrected to show the separating doorway, as discussed, so that the "apartment" is not more than
the 21'6" x 23' as requested.
The members voted unanimously in favor of this Motion.
Appeals from this decision shall be made pursuant to c40A §17 and must be filed within 20 days
after the filing of this noticeldecision with the Town Clerk.
