The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting schedule. Contact the Conservation Office if you need assistance. Submitting an Application: Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2) Hardcopy filing dropped off or mailed to the Conservation Office including: 1 Administrative Checklist 1 complete NOI application WPA form 3 with original signatures. Typed signatures will not be accepted. Detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall include how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Regulations, delineation sheets (if BVW or vegetated wetlands are present) or other resource area calculations, and supporting information. 1 100’ radius map, current abutters list identifying the property owners who are to be notified per 310 CMR 10.00 and abutter notification form. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. All abutters must be notified via certified mail. Certified Mail Receipts (PS Form 3800) for all abutters. Green cards to be submitted at the hearing. 1 original and 6 copies of the plan, folded separately, right side out with title and project address visible. All plans shall reference NAVD1988 unless otherwise noted. Copies of Checks 60 Grand View Drive 3 Property Description The property is located on the middle section of the Bass River South of High Bank Road in Yarmouth, MA; a tidal river on Nantucket sound. The project site is approximately 2.8 miles inland from Nantucket Sound. The property is located on the Northern section of the channel facing South and subject to Southwest winds. The area of direct flow for the channel is South of the dock at a distance of approximately 700’ and subject to current from both flood and ebb tides. The site has an existing single-family dwelling which is in disrepair and has a large amount of invasive species overgrowing the original plantings that enhanced the property. The area upland of MHW is a coastal bank with remnants of the existing pier an existing stairway and grass lawn mainly in the 50’ Buffer Zone from the top of coastal bank. The Coastal Bank consists of a rock revetment. It appears that the property has been poorly maintained and was an eyesore for the community. The area along the shoreline consists of a coastal beach, revetment and salt marsh to the East that prevents erosion from the river waters. The site consists of an existing single family dwelling that was recently purchased in 2022 by the current owner. There is an existing house and shed, overgrown landscaping and a stone patio behind the house. Based on the latest MORIS maps, the scope of this project is not located within NHESP jurisdiction for estimated or rare wildlife (see below). 60 Grand View Drive 4 Project Description Project Description This Notice of Intent filing proposes the re-construction of the exterior of the dwelling and adding a second floor along with a garage and two overhead deck additions. In addition, a portion of the back yard will be replaced with a pool surrounded by hardscape. In order to offset the increased area of hardscape, the trees and shrubs along with the vegetation along the water front that have large amounts of invasives will be removed and the areas are to be planted with healthy native plants. The type and density of the plants will be over 3,300 s.f., more than a 2:1 ratio of the proposed increase in hard scape of 1,500 s.f. in the 50’ to 100’ buffer zone. The additions to the garage and front porch are minimal and on the front of the house over the driveway and walkway and will have little affect on the property. All roof pitches and the pool area will be run into dry wells thus reducing the sheet flow run off into the river. Resource Area Determination The project site is located on Bass River, a tidal river which flows to and from Nantucket Sound. Mean High Water and Mean Low Water elevations were obtained from survey utilizing an rtk gps and referencing the conversions from NAVD88 in the project area. Please note that the project is well above the coastal resource areas and existing coastal bank that is 100% a rock revetment and no longer acts as a sediment source for downstream beaches. The top of the coastal bank is evident at the top of the rock bank which transitions to the buffer plantings and lawn. There is a salt marsh on the East side of the property along the water as shown on the plans. The project is also in the riverfront area as identified in the application and impact areas are identified in the buffer zone section. 60 Grand View Drive 5 Performance Standards 310 CMR State Performance Standards Coastal Bank 10.30 CMR – “When a coastal bank is determined to be significant to storm damage prevention or flood control because it supplies sediment to coastal beaches, coastal dunes or barrier beaches, 310 CMR 10.30 (3) through (5) shall apply: Not applicable, it is our interpretation that the coastal bank on site acts as a vertical buffer and not a sediment source. “When a coastal bank is determined to be significant to storm damage prevention or flood control because it is a vertical buffer to storm waters, 310 CMR 10.30 (6) through (8) shall apply: (6) Any project on such a coastal bank or within 100 feet landward of the top of such coastal bank shall have no adverse effects on the stability of the coastal bank. The stability of the bank will not be affected and will be preserved with a Natural Vegetated Buffer Strip (NVBS) that is outlined in the Order of Conditions that will enhance the stability of the coastal bank and enhance wildlife habitat. (7) Bulkheads, revetments, seawalls, groins or other coastal engineering structures may be permitted on such a coastal bank except when such bank is significant to storm damage prevention or flood control because it supplies sediment to coastal beaches, coastal dunes, and barrier beaches. Not applicable to this project. (8) Notwithstanding the provisions of 310 CMR 10.30 (3) through (7), no project may be permitted which will have any adverse effect on specified habitat sites of rare vertebrate or invertebrate species, as identified by procedures established under 310 CMR 10.37. According to the latest MassMapper GIS data, there are no specified habitat sites of rare vertebrate or invertebrate species within the project area. Town of Yarmouth Wetlands Regulations (a) Bordering Land Subject to Flooding i. “Bordering Land Subject to Flooding” is an area with low, flat topography adjacent to and inundated by flood waters rising from creeks, rivers, streams, ponds, lakes or water courses. It extends from the banks of these waterways and water bodies; where a vegetated wetland occurs, it extends from said wetland. ii. The topography and location of Bordering Land Subject to Flooding specified in the foregoing section 5.04 (2) (a) (i) are critical to the protection of the interests specified in section 5.04 (1) (a). (3) Performance Standards: Any proposed work, permitted by the Commission, on land subject to flooding shall not result in the following: 60 Grand View Drive 6 (a) Flood damage due to filling which causes lateral displacement of water that would otherwise be confined within said area. (b) An adverse effect on public and private water supply or ground water supply, where said area is underlain by pervious material. (c) An adverse effect on the capacity of said area to prevent pollution of the ground water, where the area is underlain by pervious material, which in turn is covered by a mat of organic peat or muck. (d) An adverse effect on wildlife or wildlife habitat. (e) An adverse effect on state listed rare and endangered vertebrates and invertebrates as identified by DFW (Mass Division of Fisheries and Wildlife). Not applicable, there are no coastal engineering structures proposed as part of this order of conditions that will affect the performance standards as the structure is not in the flood zone and the rest of the project is at grade. PART 6 BUFFER ZONE REQUIREMENTS 6.01 Setbacks and Buffer Zones (1) Notwithstanding section 6.01(2) below, no new structures, including swimming and spa pools (with the exception of water dependent structures), will be allowed within 50 feet of the following Resource Areas: (a) Any freshwater or coastal vegetated wetlands, salt marshes, banks, lakes, ponds of any size, beaches, dunes, estuaries, the ocean, lands under water bodies, and intermittent and perennial rivers, streams, brooks and creeks, and Isolated or Bordering Land Subject to Flooding (2) Minor structures up to 140 square feet total coverage such as sheds, decks, and pervious patios may be allowed closer than 50 feet to a Resource Area but no closer than 35 feet. With the exception of “Vista Pruning” as outlined in section 6.03, a 35-foot undisturbed natural vegetative buffer shall be maintained between all projects and Resource Areas mentioned in 6.01 (1), above to insulate wetland resource areas from adverse impacts stemming from development elsewhere in the buffer zone. In cases where the slope of an undisturbed buffer exceeds 18%, or in any instance where the scope or nature of the project is likely to require a greater spatial offset to wetland resource areas, the Commission reserves the right to increase buffer zone width to a more suitable dimension. (3) The following are prohibited within resource areas listed in 6.01 (1) and their 35-foot buffer zones: (a) Lawn grasses including “Cape Cod Lawns” (b) Landscaping (c) Fertilizers (d) Pesticides (unless part of an approved invasive species removal program) (e) Irrigation except for temporary irrigation for establishment of native plantings (f) Mulch, other than for temporary ground stabilization for one growing season. Groundcover plantings are to be used for permanent stabilization and weed 60 Grand View Drive 7 control. (4) The following are prohibited within resource areas listed in 6.01(1) and their 50-foot buffer zones: (a) Fertilizers (b) Pesticides (unless part of an approved invasive species removal program) (c) Irrigation except for temporary irrigation for establishment of native plantings (5) Lawns Turf lawns may be a significant source of nutrients to wetlands, coastal embayments, and other bodies of water through surface runoff and leaching to the groundwater. Excessive nutrient loading of water bodies may lead to eutrophication. Indications of eutrophication include nuisance algal blooms, oxygen depletion, fish kills and foul odors. To minimize potential adverse impacts due to fertilization, the Conservation Commission requires that turf lawns be minimized or even eliminated from landscaping plans; particularly in lots adjoining surface water bodies and wetland resource areas. No new turf lawns shall be permitted in the 50-foot buffer zone on an undeveloped lot. On lots where turf lawn currently exists and has for a long period of time, the Commission may require that turf lawn area to be reduced or eliminated when an application for a new project on that lot is brought before them. Buffer zones of native plants may be required to reduce surface runoff. (a) New lawns may be irrigated for 2 growing seasons after planting but not thereafter. (b) New lawns in buffer zones shall be or mimic Cape Cod Lawns. A Cape Cod Lawn is an area that is not irrigated, fertilized, or otherwise treated with chemicals that is diverse with species including native sedges, mosses, grasses, and other low-growing plants that are well adapted to the conditions of the Cape. Cape Cod Lawns can be established by seeding with a mix of drought tolerant grasses and forbs and weeding to remove invasive species as needed. There are no new coastal engineering structures, pools, or other amenities proposed within the 50’ buffer zone to the coastal bank as part of this filing. Existing replanted lawn and planting will meet the requirements set forth in the performance standards listed above. 6.02 Mitigation and Restoration (1) At a minimum, a 35-foot undisturbed buffer zone shall be retained between the landward-most wetland resource area and the limit of proposed site disturbance. Landward of the 35-foot no-disturb zone, work shall be designed to minimize the area of disturbance, to preserve as much undisturbed vegetation within the one- hundred-foot buffer zone as is practicable for the proposed use. (2) Where a 50-foot undisturbed buffer zone exists prior to the proposed work, and shall remain intact upon project completion, further buffer zone enhancement shall not be required. (3) Where a 50-foot undisturbed buffer zone does not exist prior to the proposed work, any work proposed within the 100-foot buffer zone shall be subject to mitigation planting requirements intended to restore, in so far as is possible, both the dimensions of a 50-foot undisturbed buffer and its vegetation. For work proposed within the 100-foot buffer zone, the calculation of mitigation is set forth as follows: 60 Grand View Drive 8 (a) For proposed, new or replacement hardscape or structure, whether pervious or impervious, within the 50-100-foot buffer zone, mitigation shall be 2:1. (b) For proposed new or replacement hardscape or minor structure, whether pervious or impervious within the 35–50-foot buffer zone, mitigation shall be 3:1. (c) Where a variance is sought for proposed work within the 35-foot buffer, mitigation shall be determined at the commission’s discretion. (d) In no case shall the total area of mitigation plantings required be greater than that which is necessary to restore a 50-foot undisturbed buffer in its entirety. (e) If structures or hardscape already exist within the 35-50 foot buffer, then additional structures or hardscape may not be allowed within the 100 foot buffer until the 50 foot buffer and its vegetation have been fully restored. (4) Planting requirements Where mitigation or restoration of buffer zone vegetation is proposed or required under a notice of intent, it shall meet the following requirements: (a) Locally native and climate adapted plant species suited to the local growing conditions will be used. Mitigation areas should contain a diversity of woody species with varying heights sufficient for the space (at least 3 species when the required mitigation area is <300 sqft) and may be supplemented by an understory of native grasses and forbs (including ferns, herbs, groundcovers, and perennials). Native grasses and forbs alone cannot be used as mitigation. (b) The recommended plant spacing and densities will be used as shown on the approved plant lists available on the conservation website (c) Only temporary use of mulch may be applied under the drip line of each plant at the time of planting for moisture retention, soil stabilization, and weed control during establishment. Native groundcovers will be utilized in the spaces between larger plantings. At no time shall a mitigation or restoration area be sheet mulched. Hand weeding is allowed. (d) Foundation landscape beds within the buffer zone: Proposed foundation landscape bed plantings should appear on all plans if within resource areas and the 100-foot buffer zone. Foundation beds are defined as directly abutting a dwelling/structure and are a maximum of 5 feet in width. These areas may be planted with native species, native cultivars, or non-invasive non-natives with approval from the Commission or the Conservation Administrator. There are no coastal engineering structures or other amenities proposed as part of this order of conditions that will affect the performance standards as improvements including the pool and hardscape are outside the 50’ Buffer Zone. A restoration factor of greater than 2:1 is proposed to offset the hardscape and pool in the 50’ to 100’ buffer zone. 6.03 Trees and other Vegetation (1) “Vista Pruning” may be allowed on a case-by-case basis subject to the following provisions: (a) A discussion with the Conservation Commission or their Staff is required. (b) A “Notice of Intent” application may be required. (c) Canopy areas shall not be pruned by more than 30 percent. 60 Grand View Drive 9 (d) Portions of dense understory, no more than 20 percent, may be removed provided they are replaced by suitable native vegetation. (e) If adverse impacts occur to the adjacent Resource Area(s) as a direct result of the “Vista Pruning”, the Commission will require immediate mitigation in order to correct such impacts. This provision shall be noted within the “Order” issued to the applicant. (2) Any trees removed in a resource area (excluding LSCSF) or buffer zone must be replaced with native and climate resilient trees, caliper inch for caliper inch as determined by the Diameter at Breast Height (DBH) of the tree. The same tree species should be planted unless otherwise approved by the Commission or Conservation Administrator. Example-if a 10-inch oak is removed, the trees planted must total 10 inches such as five 2-inch caliper trees. (3) If the parcel is mitigation constrained, the Commission may require that the trees remain, or 16 square feet of native shrubs may be planted directly abutting the existing vegetated buffer in lieu of trees for each caliper inch that space is insufficient. (4) Trees > 3 inches DBH removed within Land Subject to Coastal Storm Flowage should ordinarily be replaced for each tree removed at a 2:1 ratio with native and climate resilient trees from the approved plant list at a size of at least 1.5 caliper inches. Shrubs may not be substituted unless approved by the Commission or Conservation Administrator at the ratio described in Section 6.03(3). The trees being removed in the buffer zone are unhealthy and or have invasive species to an extent that removing them would be prohibitive. The large pine at the coastal bank is to remain if determined it is health by an approved arborist. PART 7. VARIANCE 7.01 Text The Conservation Commission may at its discretion, waive one or more of these regulations when the proposed work potentially represents a significant ecological improvement when compared to existing conditions, or will not adversely affect any areas subject to the protection of these regulations. In addition, the Conservation Commission may, at its discretion, waive one or more of these regulations when there is an overriding public benefit or safety issue at hand and there is no feasible alternative to the proposed work. A variance is requested for trees being removed in the buffer zone are unhealthy and or have invasive species to an extent that removing them would be prohibitive. 60 Grand View Drive 10 Alternatives Analysis for project This Notice of Intent filing proposes the re-construction of the exterior of the dwelling and adding a second floor along with a garage and two overhead deck additions. In addition, a portion of the back yard will be replaced with a pool surrounded by hardscape. the following analysis is offered to describe the available options for this project. OPTION 1: Do Nothing – If nothing is constructed the house and landscape will continue to fall into disrepair. Invasive species will continue to advance and the lack of ground cover will run off into the river with no pre-treatment. Therefore, this is not the preferred option. OPTION 2: Just rehabilitate the existing structure in the same footprint. At this point the house does not meet current building codes for coastal areas and it needs to be totally rehabilitated to get up to code. In order to get this done substantial moneys needs to be invested into the property. To make this a viable project for the investment required an upgrade to the house and property needs to be similar to the other properties in the neighborhood. Therefore, this is not the preferred option. OPTION 3: Reconstruct the house and property up to the similar properties in the area including removing all the old shrubs and trees that have invasives including the waterfront. The new house with no increased living area, only a slightly larger garage and a porch that was over an existing brick patio has no or little bearing on the existing lot coverage. The area that the pool and hardscape will now cover was mostly shrubs and grass that did not assist in the filtration of run off going into the river. By capturing all the clean run off and recharging it into the aquifer so its filtered instead of running off into the river is a positive aspect of the project. The rehabilitation of the 50’ to 100’ buffer zone with invasive removal and new healthy plantings will contribute to the filtering of run off entering the river. Therefore, this is the preferred option. CONSTRUCTION PROTOCAL The proposed work shall be performed with the minimum amount of equipment required to obtain the project objectives. The staging area for materials will be from the upland of applicant’s property. All equipment shall be stored on the upland of applicant’s property when not in use. Erosion control measures shall be always in effect in accordance with the plan, plan notes, protocols and permit. Pre-construction Meeting Prior to construction, a pre-construction meeting shall be held on-site with the Contractor, Property Owner, Conservation Commission and/or agent, and the Project Manager (WRS Engineering LLC). The purpose of the meeting is to clearly delineate the limits of work and access, as well as the staging area. The Contractor will describe the proposed means and methods for performing the work within the requirements of the plans, order of conditions and 60 Grand View Drive 11 construction protocol. The contractor will comply with mitigation measures as established by the Conservation Commission. To be discussed at the meeting: - Existing property conditions, necessary precautions to be taken by the Contractor; - Means and methods for construction and erosion control; - Necessary post-construction remedial efforts - Procedure for post construction inspection; - WRS Engineering’s responsibilities for inspections and project coordination During construction, the site shall be accessible for inspection during reasonable hours by all parties, members of the conservation commission and their agents, and the Project Manager. No work will commence until an erosion control barrier is put in place and inspected by the engineer. The barrier shall be inspected daily and maintained as required. Post-construction meeting Upon completion of construction, but prior to equipment being removed from the site, a post- construction meeting shall be held on-site with the Contractor, Property Owner, Conservation Commission and/or Agent, and the Project Manager (WRS Engineering LLC). The purpose of this meeting is to determine that the project has been satisfactorily completed in accordance with all permits, and that no additional work or mitigation is required by the Contractor. Restoration of Project Area Upon completion of construction any and all areas disturbed by the construction effort shall be returned as much as practical to their pre-construction conditions to the satisfaction of the property owner and conservation agent. All disturbed areas that are re-vegetated with indigenous or grass vegetation to as shown on the project plans, or as determined during the preconstruction meeting. The vegetation shall be monitored for a minimum of two years to ensure that it has taken and is being maintained properly.
