O'Connell 302 Route 6A Yarmouthport, MA 02675 RE: Overflowing Sewage at 302 Route 6A, Yarmouthport, MA Dear Mr.O'Connell: It was observed, during an inspection of the abutting property, that the sewage disposal system located at the above address was, or had been, overflowing onto the surface of the ground. According to the State Environmental Code: Title V: Minimum Requirements for Subsurface Disposal of Sanitary Sewage: Regulation 15.000 and the Town of Yarmouth Amendments— Section 2.19: Maintenance: "Every owner or agent of premises in which there are any private sewers, individual sewage disposal systems, or other means of sewage disposal shall keep the sewers and disposal systems in good repair. Should the owner or agent of any premises fail to keep the disposal facility in proper working condition, the agent of the Board of Health shall cause the disposal facility to be cleaned, or repaired, with all expenses incurred to be paid by the owner or agent of the premise(s) so involved. Title V 15.303 — Section (1) (a): Systems Failing to Protect Public Health and Safety and the Environment states: "There is a discharge of effluent directly or indirectly to the surface of the ground through ponding,surface breakout or damp soils above the disposal area or to a surface water of the Commonwealth." The system appears to be in failure and must be repaired as per engineered plan. You must have the system pumped upon notice of this letter and contact an engineer to design a plan for the needed repair.
