Protect Summary
Applicant is seeking to open a seasonal/temporary plant sale area during daytime, with 28 parking
spaces over existing pavement, and no other modification to the site other than the addition of a
temporary fence enclosure for the plants.
Comments
NAV Building: Use as proposed is identified H1. Use does not qualify as a Farmers Market by definition in the Town of
Yarmouth Bylaws.
Use requires a Variance from Table 202.5 Footnote 2 regarding outdoor display, the retail use would otherwise be
allowed. Applicant has stated that the use would be temporary for the summer season.
There are no street buffers at this time. It is not very clear to me as to the status of the parking reconfiguration which
would require a SP per section 301.2 of the Zoning Bylaw. Restroom facilities not identified.
This sight has had another temporary use proposed recently. That petition for relief included planters as part of the SP
request. Owner has been to SPR recently with a new permanent use and as part of that project will be installing
permanent buffers. The timeline on the project is not clear.
� _�Cammunity Development and Planning: This appears to be a good temporary use for the property until it can be
redeveloped. The property owners have submitted a ROAD application for a multi -use building. Any portable toilets
should be located away from Route 28 in a less visible location. Applicant will be modifying the existing free-standing
sign.
Conservation: The proposed work is outside conservation jurisdiction.
Design Review: Not Present.
Engineering:
• Confirm duration of 'season al'/tem porary plant sales. If extended into the fall or following years, Contract
5 of sewer will be procured and beginning construction.
• Deliveries will be handled in the rear within the existing paved area.
• Clean, inspect and repair as necessary existing catch basins to be operational.
Fire: 527 CMR 1 Ch.18 sec.18.2.3.5.4-- Dead-end fire apparatus access roads in excess of 150 ft (46 m) in
length shall be provided with approved provisions for the fire apparatus to turn around. 527 CMR 1 Ch.10 sec
10.14.2 gives the Fire Dept. such authority to regulate access, as well as request a life safety evaluation as it
pertains to Fire Dept. access and public egress from the fenced in area. Additional gate may be required for the
rear of the fence line.
