Dear Commission Members and Conservation Administrator DiRienzo: Our firm represents who are direct abutters to the Subject Property. On their behalf, I attended the Commission meeting of June 6th during which the first session of the public hearing on the Project took place. After presentation of the application, questions by Commission members and some public comment, the matter was continued to June 20, 2024. I plan to attend again on the 20th. During the public comment period at the June 6th public hearing, I spoke briefly to let the Commission know that my clients have some concerns about the Project and to express interest in working with the applicant and his engineering firm, Down Cape Engineering, to improve upon what is proposed in the application. I have had some communication since the June 6th meeting with Craig Ferrari at Down Cape, which my clients appreciate. At the same time I am sending this to the Commission I am sending to Down Cape. On behalf of our clients’, I ask that the Commission consider the following approval conditions: 1. The septic system (whether I/A or tight tank) will be placed underground, not elevated with structural walls surrounding. [My clients understand that there might be some modest mounding of earth to cover the system that will make the area look a bit like a berm, but we also understand that much of the system will be below existing grade.] Yarmouth Conservation Commission Re: SE83-2430 June 18, 2024 Page 2 2. The property owner shall be obligated to connect to the municipal sewer system within 1 year of when the same becomes available to residents at Malfa Road, and once connected to the Town sewer the septic system shall be removed. 3. That any fencing of the area near the septic system shall be split rail and leave sufficient room for the neighbor to the north (at to access for maintenance of that structure the side of their garage facing the applicant’s property 4. No certificate of completion will be issued until the applicant completes all work required under the open Order of Conditions SE-83-2282 (seawall construction and associated landscaping) and qualifies for and has a certificate of completion for SE-83-2282.
