A. General Description: A Plus Real Estate LLC, Emad Zahran, has submitted a Revitalization
Overlay Architectural District (ROAD) Application #2024-1 for redevelopment of the 1.88 acre
parcel at 228 Route 28, West Yarmouth, MA (Assessor Map 37, Parcel 148). The Applicant seeks
to develop the project using Zoning Bylaw Section 411 – Revitalization Overlay Architectural District
(ROAD). This project would redevelop the currently vacant former restaurant site with a new
mixed-use building including retail on the first floor and 13 apartments on the second floor; and
associated site work including parking, loading dock, utilities, and landscaping. The existing septic
system for the former restaurant will be utilized until connected to the municipal sewer system.
Mixed-use developments are desired along Route 28 as they retain the use of our commercial
corridor while allowing for much need top-of-shop rental housing.
B. Process: Section 411 – ROAD Bylaw, allows for zoning flexibility in exchange for a high standard
of site and building design. The Planning Board serves as the Design Review Authority for ROAD
projects and is tasked with ensuring the project substantially adheres to the Yarmouth
Architectural and Site Design Standards (Design Standards). If the Planning Board approves
the ROAD District Development Plan, the applicant can submit for a Special Permit from the ZBA
for relief needed rather than requesting any Variances, which are more difficult to obtain.
Within 45-days of submission, the Planning Board needs to issue their decision on the ROAD
District Development Plan after having a Public Hearing. The application was submitted on May 9,
2024, and a 30-day extension was provided. With the modified 75-day deadline, the Planning
Board has until July 22, 2024. Failure to act by July 22nd results in disapproval without prejudice
unless the timeline is further extended. The Public Hearing is scheduled for June 26, 2024. The
attached Public Hearing Notice was published in the Cape Cod Times on June 11th and June 18th
and notification to abutters within 300’ was sent on June 13th. Approval of a ROAD District
Development Plan requires a majority vote (4 out of 7).
C. Review Criteria: When considering approval of a ROAD District Development Plan, the Planning
Board shall consider the following criteria, standards, objectives, and recommendations as outlined
in Section 411.5.1 and have been summarized below. Please note that a proposal need not satisfy
all criteria to receive approval.

1. Site Plan Review Objectives: related to adequate internal circulation/egress and traffic safety;
reasonable measures taken to reduce parking visibility from public ways; adequate fire and
service equipment access; adequate utilities, drainage, and fire protection; and minimize
removal of existing trees within the buffer zones.
2. Design Review Objectives: related to improving aesthetic quality of buildings and sites;
promote attractive and viable commercial districts; preserve the pattern of the neighborhood;
encourage public amenities; Cape Cod architectural styles using traditional building materials
and muted colors; and internal parking circulation to reduce curb cuts, improve landscaping and
traffic flow, allow for proper turning radius and parking space, encourage pedestrian uses and
access, screen trash receptacles, and minimize any accessory signage.
3. ROAD Goals, Purpose & Objectives: provides zoning flexibility and incentives to encourage
business opportunities and redevelopment while preserving and enhancing our historic
community; promotes quality redevelopment through design standards; requires the project to
substantially adhere to the Design Standards as determined by the Planning Board; and
adheres to the intent and purposes of the underlying zoning.
4. Economic Benefits of the Proposed Project.
5. SPR and CECD Recommendations.
6. Supplementary ROAD District standards: related to the quality of aesthetic and architectural
styles; color and materials; balances economic growth and employment with protection of the
natural environment; the benefits of the ROAD project shall outweigh its detriments; and the
benefits of any deviation or relief from the underlying zoning bylaw shall outweigh any
detriments as determined by the Planning Board.
D. Other Committee Comments:
1. Community & Economic Development Committee (CEDC): The CEDC reviewed this project at
their May 14th meeting and voted to recommend the project to the Planning Board based on its
economic benefits, including attractive redevelopment of a vacant site, employment
opportunities, housing, and a product that meets the niche needs of restaurant businesses
operating year-round. Refer to the attached May 15, 2024 Memo from CEDC.
2. Community Housing Committee (CHC): The CHC met with the Applicant on June 10, 2024 and
identified two (2) conditions as outlined in the attached June 21, 2024 Memo from Mary
Waygan. These conditions are related to having the two (2) required affordable units be one-
bedroom units with a minimum size of 700 square feet, and setting the maximum rent for the
affordable units. There is some question as to the size of the residential units and Staff has
requested a summary of the gross interior square footage for each unit and also the useable
square footage of the two different size storage units. The Town Planner followed up with Mary
Waygan on these two conditions and Ms. Waygan suggested including a condition that the two
affordable units be the two largest 1-bedroom units, rather than specifying a minimum size.
3. Site Plan Review (SPR): Most of the comments in the attached March 19, 2024 SPR Comment
Sheet are related to other permits or regulatory requirements that the Applicant needs to adhere
to and will be addressed during final design/permitting for the project, such as the Stormwater
Management Permit. The Applicant also made significant improvements to the project based on
the SPR Comments prior to submission to the Design Review Committee.
4. Design Review Committee (DRC) & Architectural and Site Design Standards (Design
Standards): The DRC reviewed this project on June 6, 2024 in an advisory capacity (see the
attached DRC Comment Sheet). The DRC denoted all the Siting and Building Strategies as
either Not Applicable (N/A) or Meets Standards (substantially as presented, or if specific
improvements were made). Below is a brief summary of the DRC comments and in bold italic,
a summary of the modifications made to the revised submission made to the Planning Board.

1. Architecture:
a. The columns should be modified to be proportional to the building and include trim
detail at the base and top of the column. The panels between the columns need
more detailing such as shadow boards. The Applicant provided dimensions on
the entrance columns and panel boards.
b. Expand the width of the covered porch over the rear main residential entrance. The
width of the covered porch over the rear entrance was widened.
2. Landscaping:
a. Clearly show existing buffer trees to remain and protect during construction. Trees
to remain have been shown on C-6 – Landscape Plan, but should also be
included on C-2 – Demolition & Erosion Control Plan.
b. Extend side buffer trees to the end of the parking and truck turn around in the rear.
Existing trees to remain, or new trees have been shown on C-6.
c. Add 3 additional in-lot trees (3” caliper). Three additional, for a total of the 4
required in-lot trees have been provided at 3” caliper.
d. Side/rear buffer trees to be 3” caliper native species (trees in front of buildings along
a way can be 2.5” caliper as part of a comprehensive landscape plan). Side/rear
tree sizes have been modified to 3” caliper.
e. Include irrigation. Note 6 on C-6 denotes irrigation.
3. Provide a solid fence/gate around the dumpster. Wooden trash enclosure detail
shown on D-3 – Site Landscaping Details.
4. Consider a bus shelter. No bus shelter is shown, but it would make sense to gauge
the need prior to inclusion.
5. Try to have Eversource relocate the overhead line and utility poles off the property. The
Applicant is working to have Eversource relocate the lines, but this may be
somewhat out of their control.
E. Bylaw Relief: Although the Planning Board is not granting any waivers, they need to review the
benefits of any relief requested compared to any detriments. Per the SPR Comments, and
subsequent review with the Building Commissioner on the latest revised plans, the following relief
in the form of a Special Permit will be required providing all mandatory sections of 411 are met.
• A12, multifamily use, table 202.5 and Section 411 (with no more than 50% of total building
floor area being used for residential).
F. Options: Depending upon the deliberations of the Board, they may wish to approve, approve with
conditions, or deny the ROAD Application #2024-1, but will need to provide some findings or
reasoning for whichever decision is made.
Approval: The Planning Board could make a motion to Approve ROAD Application #2024-1
submitted for a mixed-use development at 228 Route 28, West Yarmouth with the following
conditions:
1. Existing trees which are to be retained, and protected during construction, shall be identified
on C-2 - Demolition & Erosion Control Plan.
2. Provide two (2) affordable units as follows:
a. The affordable units shall be the two largest 1-bedroom units.
b. The maximum rent for the affordable units shall be no more than the current Federal
Fair Market Rents; and no more than the affordable rents allowed by the Executive
Office of Housing and Livable Communities.

Some findings of the Board to support an Approval could include:
1. Results in economic benefits to the Town and recommended by the Community & Economic
Development Committee.
2. The Design Review Committee and the Planning Board have both determined that the
project substantially adheres to the applicable sections of the Yarmouth Architectural and
Site Design Standards.
3. Improves the aesthetics of the commercial corridor by using cape cod style architecture,
traditional looking building materials and muted colors.
4. Mixed-use promotes an attractive and viable commercial district while providing much
needed rental housing.
5. Parking located to the sides and rear and landscaping reduce the visibility of parking from
the public way.
6. Better defines the curb cuts, allowing for more landscape buffer along Route 28.
7. Provides fire access, internal circulation/egress, and sprinkler system.
8. Utilities and drainage provide functional service for the site and structures.
9. Project work limits are outside wetland resources, floodplains, or drinking water recharge
areas.
10. The benefits of the project outweigh the detriments resulting from the requested relief being
through a Special Permit as the project provides much needed rental housing, two of which
will be Affordable, with a higher design standard.
Denial: The Planning Board could make a motion to deny ROAD Application #2024-1 submitted
for 228 Route 28, West Yarmouth. However, the Board would need to clearly document the
reasons why the application is being denied based upon the review criteria.

The Yarmouth Community and Economic Committee met on May 14, 2024 to discuss the ROAD
Application #2024‐1. Representatives for the applicant provided an overview of the proposed
project, a new two‐story mixed‐use building with retail on the first floor and thirteen rental units
on the second floor. Noting a number of economic benefits, including attractive redevelopment
of a vacant site, employment opportunities, housing, and a product that meets the niche needs
of restaurant businesses operating year‐round, the Committee voted 6‐0 to recommend support
for the project to the Planning Board.

On June 10, 2024, at their regular meeting, the Community Housing Committee met with A Plus
Real Estate and the ConServ Group regarding the proposed redevelopment of 228 Route 28,
West Yarmouth, MA into a mixed-use development with ground floor retail space and 13-
apartments on the second floor.
After review of the proposal, the Community Housing Committee voted to recommend the
following conditions be part of any approval of the project:
1. All affordable units shall be one-bedroom units with a minimum size of 700 square feet;
and
2. The maximum rent of all affordable units shall be:
a. no more than the current Federal Fair Market Rents; and
b. no more than the affordable rents allowed by the Executive Office of Housing and
Livable Communities*.

* Typically 30% of the target Area Median Income, which in this case is 80% of the Barnstable
County Area Median Income as adjusted for household size and published annually by US HUD.

Dear Ms. Crowley and members of the Board:
On behalf of our client, ConServ Group Inc., we are submitting an application under the provisions of
Zoning Bylaw Section 411, the Revitalization Overlay Architectural District (“ROAD”) for the
referenced project. Our client is proposing to construct a new building at the referenced location to
house a retail business, an A Plus Market. The second floor of the building will be residential
apartments. This construction is shown on the attached Site Plans and Building Plans.
These plans have been prepared in reference to Zoning Bylaw Sections 103.3.1, Site Plan Review and
Section 103.3.4, Plans. The applicant believes that these plans are consistent with and substantially
comply with the Yarmouth Architectural and Site Design Standards.
Project Description
The property was previously occupied by a restaurant which has since been demolished. The
applicant proposes to construct a new 2-story mixed-use building as shown on the plans submitted.
The building style, color, and materials are in keeping the Standards and have been revised to
respond to comments from Planning staff. Under the proposal the site will be landscaped in
accordance with the bylaw and standards, which represents a substantial improvement of the
existing condition of the site. New paved parking will be provided, with sufficient parking to address
the bylaw requirements. Lighting and stormwater controls will be provided, to include a “rain
garden” that will provide attractive plantings in addition to the stormwater function.
None of the proposed work is within 100 feet of a vegetated wetland. We understand that the
Stormwater Management Regulations are administered by the Conservation Department and
stormwater calculations and reports will be submitted to them as part of that process.
The septic system serving that restaurant is still in place, and as shown on the Site Plans, the client
intends to connect the new building to it. The site is located in Phase 1 of Sewer Contract 6, which is
anticipated to be completed in 2026. As shown on the plan, a new force main from the existing

septic system to a proposed sewer manhole near the frontage will be installed to facilitate
connection to municipal sewer when that becomes available.
We understand that the Massachusetts Department of Transportation (MassDOT) is planning on
corridor improvements to Route 28. Their current design will need to be modified to address the
improved driveway locations on the proposed site plan. We will coordinate with them during the
curb cut approval process, after all zoning permits are issued by the Town of Yarmouth (MassDOT
will not initiate plan review until all local permits are issued.)
The existing driveways are separated by 79.3 feet. The proposed driveways will substantially
improve the separation, increasing it to 167.3 feet. These driveways cannot meet the separation
requirements in Section 301.4.7, and are not required to, as the Section states: “… shall observe
minimum separations as follows, unless precluded by lot configuration in existence on the date of
adoption of this bylaw”. The Yarmouth Zoning Bylaw was adopted on April 11, 1978, and
Massachusetts adopted zoning in 1954. The records on file in the Barnstable Registry of Deeds
indicate that this lot configuration hasn’t changed since 1945 or earlier. Regardless, MassDOT has
jurisdiction over driveways on State Highways.
Economic and Other Benefits to the Town of Yarmouth
The project will provide economic benefit to the Town of Yarmouth in many ways. As is stated in
the Site Plan Review report, mixed-use developments along the Route 28 corridor benefit the town
in that they preserve the commercial corridor while also providing much needed apartment rental
housing. In this case, approximately 9,985 square feet of retail is proposed on the ground floor. The
retail use will be a local provider of food-related items, supporting restaurants and community
residents. It will also provide employment, and the presence of new workers will bring more activity
to nearby businesses for such things as eating out, auto service, shopping, etc. This applies both to
the short-term construction workers and the workers who will run the business.
A total of 13 new dwelling units are proposed on the second floor, to include ten 1-bedroom units
and three 2-bedroom units. The addition of these units can support housing for an estimated 32
persons. In accordance with Section 412.2.3, two of these units will qualify as affordable. These
dwellings are conveniently located near businesses that can provide employment, shopping, local
library and other services for the residents. As stated above, local businesses will benefit from the
increased activity provided by more residents located within the community.
The previous restaurant building was demolished. According to the Yarmouth Assessor’s office, the
property is taxed only on the land value and the small value of the asphalt paving that remains.
Constructing the new building will result in substantially increased property value, which provides
an economic benefit to the town in the form of increased ongoing tax revenue.
Replacing a vacant parcel without access controls with a new, occupied building will provide
additional value to the community. The attractive building and site proposed will improve aesthetics

along this corridor. A new mixed-use building, occupied with active business and housing is a more
productive use of the property than a single-use active business or vacant land. This is true in terms
of increased property taxes and also year-round occupied space with a healthy mix of commerce
and residential use, which is beneficial to abutters, the Town of Yarmouth and its residents.
There will be tax revenue benefits from this mixed-use project. The annual Real Estate Taxes for the
vacant land are approximately $3,600.00. This is based upon the 2024 total valuation of
$496,200.00 for the land and paving-asphalt improvement and the tax rate for the Town of
Yarmouth for Fiscal Year 2024 of $7.38 per thousand. The annual Real Estate Taxes for this mixed-
use project are estimated to be $36,600.00. This is a $33,000 increase over the current real estate
tax paid and is based upon the estimate that the mixed-use property will be valued at approximately
$5,500,000.00. Additionally, this is a $20,000 increase over an alternate single-use property with
approximately 9,985 square feet of retail proposed on the ground floor. The annual Real Estate
Taxes for an alternate single-use project are estimated to be $16,600 based upon the estimate that
the single-use property estimated will be valued at approximately $2,500,000.
The project was subject to Site Plan Review. The report arising from that review is attached. The
plans have been revised to address that review, in our opinion. There are several review comments
that warrant some explanation:
Photometric plan. A photometric plan has been added to the Site Plan.
Snow Storage. A designated snow storage area, along with a description of snow removal,
has been added to the Site Plan.
In-lot trees. The provision of in-lot trees has been modified to meet the interpretation of
the bylaw requirement, in part by adding substantial new landscaped areas.
Pavement area for truck turning has been reduced substantially to accomplish
this.
Rain garden. The proposed rain garden in front of the building has been reduced in depth
and reconfigured to allow for more tree plantings.
Front buffer trees. Additional trees have been added to the site frontage, in excess of the
minimum required.
Architecture. Suggested changes to the design have been considered and some changes
made. No front facing entrance has been provided, the side entrance is closer
to parking and a front entrance will require walkways and compromise the
front landscaping when few pedestrians are expected.
Plantings. Tree plantings have been revised to specifically address bylaw requirements.
Dumpster. The dumpster has been relocated to allow for more landscaping.
Pedestrian access. Concrete sidewalk from Route 28 to the retail entrance and near the dwelling
entrance has been added to the Site Plan.
Pavement. Delivery truck and fire equipment simulations have been included in the Site
Plan.
Curb cut access. MassDOT will not review or approve curb cuts until all local zoning approvals
have been issued. Since the site has two long-established curb cuts, and the

proposal increases their separation and conforms with their written
requirements, MassDOT approval is expected.
Loading bay pump. The configuration and pumps are required to discharge runoff to the
stormwater system.
O&M report. A stormwater Operations & Maintenance Report was included in the
Stormwater Report.
Stormceptor. The stormwater sizing calculations in the Report confirm that it can
accommodate the small watershed served. The model chosen works with a
grate installed.
Fire lanes. Fire lane markings have been added to the Site Plan.
Grease trap. The Site Plans include an inspection schedule.
Domestic supply. The 1 inch domestic water supply has been changed to PE tubing.
Kindly advise us if you need additional copies of these documents, or if there are any other
requirements not addressed in this submittal. We look forward to reviewing this project at the next
available Planning Board meeting.

THE SITE CONSTRUCTION FOREMAN SHALL BE RESPONSIBLE FOR THE DAILY INSPECTION AND MAINTENANCE OF ALL SEDIMENT AND EROSION CONTROLS AND SHALLIMPLEMENT ALL NECESSARY MEASURES TO CONTROL EROSION AND PREVENT SEDIMENT FROM LEAVING THE SITE.2. THE CONTRACTOR SHALL INSTALL ALL SEDIMENT AND EROSION CONTROL MEASURES AS SHOWN ON THE PLANS AND AS DETERMINED NECESSARY IN THE FIELD BY THEENGINEER BEFORE ANY CONSTRUCTION ACTIVITIES ARE TO BEGIN. THECONTRACTOR SHOULD PROVIDE APPROPRIATE STABILIZATION PRACTICES ON ALL DISTURBED AREAS AS SOON AS POSSIBLE BUT NOT MORE THAN 14 DAYS AFTER THECONSTRUCTION ACTIVITY IN THAT AREA HAS TEMPORARILY OR PERMANENTLY CEASED, TEMPORARY AREAS HAVING A SLOPE GREATER THAN 4:1 SHALL BE REINFORCEDWITH EROSION BLANKETS OR APPROVED EQUAL UNTIL THE SITE IS PROPERLY STABILIZED. TEMPORARY SWALES MAY ALSO BE REQUIRED IF DETERMINED NECESSARY INTHE FIELD BY THE ENGINEER.11. THE CONTRACTOR SHALL INSTALL A SILT SACK OR APPROVED EQUIVALENT IN EACH EXISTING CATCH BASIN RECEIVING RUNOFF FROM THE SITE. UPON THE INSTALLATIONOF ANY NEW CATCH BASIN, THE CONTRACTOR SHALL INSTALL A SILT SACK OR APPROVED EQUIVALENT. THESE ARE TO BE INSPECTED AFTER EACH SIGNIFICANT STORMEVENT AND EMPTIED AS NEEDED DURING THE ENTIRE CONSTRUCTION PERIOD.12.
