In accordance with paragraph 2(a) of section 1.03(General Procedures) of the OKH 972
CMR Rules and Regulations: Only minor changes may be approved by the Committee
without the Bing of a new application and a new hearing. minor changes include
alterations that can be done without a detrimental Impact on the overall appearance of
the project such as altering a single window or door change or a minor change of

designee's approval.
All changes to previously OKH approved plans require notification to and approval
from the local OKH Committee. Change requests must be submitted to the Committee

To Whom It May Concern,
I intend to rebuild the rear chimney at 405 Route 6A Yarmouth Port using General Shale's Old
Brick Originals thin brick Train Station variety that matches the exact dimension of the brick size
from the chimney that was recently removed. White lime mortar will be used for the pointing and
the thin brick will be placed on wire mesh over concrete board using Ardex X 90 mortar
providing excellent long term durability. I have installed several of these veneer historic
chimneys over the course of my 50 year career and never had one fail.
The chimney will be placed in the exact location of the original center ridge chimney in the
opening as observed from the roof sheathing repair in the attic. I plan on removing the exterior
shingles from the ridge and build a frame fitting the existing cutout on the ridge. The height will
match the height from the ground of the chimney that was recently removed. The general
design will match the ridge top chimney on the Friday Club building at 385 Main St.

Chairman Wilkins and Yarmouth Old Kings Highway Committee,
The chimney described in the Application does not meet the reconstruction requirements from the
February 12 Hearing. The February 12 decision has not been vacated and remains in effect.
The currently proposed material is a sliced modern brick on a concrete board frame rather than whole
historic brick. It does not replicate the cap on the demolished chimney and it is not in the location of
the chimney that was demolished without a permit. Architectural drawings showing the size, scale, and
structural integrity of the proposed chimney have not been provided.
Evidence that a chimney used the framed opening at the ridge line does not exist. Homes were, and are
today, framed and sheathed before masonry is built. Photos show the foundation of the chimney
removed is 4'to the west of the center of the room, in line with the stove pipe opening to the rear.
The Committee will have to decide if it will vacate its previous ruling and consider this alternate proposal
for a faux chimney in a different location than specified on February 12, 2024.

The Old King's Highway Historic District Committee (OKHHDC) received an anonymous complaint about
the property you own at the above -referenced address, accompanied by photographs that show the existing
ell chimney has recently been demolished and patched over with a new asphalt shingle roof. As you must
be aware, the OKHHDC has review authority over all property north of Route 6, and is particularly
interested in historic properties that exist on the Route 6A corridor.
The property is listed as contributing in the "Northside Historic District" as established in the
Commonwealth of Massachusetts on May 1, 1973, and as established by the National Register of Historic
Places on November 24, 1987. Within the district, the house is individually listed as the Henry Mathews
House, Ca. 1800, and as "contributing" to the district. The garage is listed as "non-contributing".
Chimneys, whether on the main house or ells, are important architectural features, are subject to review and
approval by the OKHHDC, and are not to be removed/demolished without prior authorization by the
Committee.
As such, you are hereby notified that you are currently in violation of the OKH Act for the following
reason(s):
1. Altering exterior architectural features by way of demolition of the ell chimney.
2. Altering the exterior appearance of the property by installing a roof patch and asphalt
shingle roofing.
3. Any other exterior work that is not currently known to the OKHHDC that has been
completed without submitting a Certificate of Appropriateness (COA).
You therefore must apply to the OKHHDC for a Certificate of Appropriateness prior to the next available
meeting to explain the work you have already completed, documented with before and after photographs
as well as describe any exterior work you that intend to perform with the required drawings and other
materials as listed on the COA application. Please note that you will not be issued a building permit for
any work on the exterior of this property until you first apply for and obtain a COA from the OKHHDC.
Further, should the Committee find that the demolished chimney is an important and character -defining
architectural feature, you will be required to rebuild/restore it to its original configuration and appearance
using the same materials.
Additionally, as you are now in violation of the Old King's Highway Regional Historic District Act, you
are now subject to the following provision of the Act:

SECTION 12 Enforcement
Any person who violates any provision of this Act shall be guilty of a misdemeanor and upon
conviction thereofshall befined not less than One Hundred Dollars ($100.00) nor more than Five
Hundred Dollars ($500.00). Each day of violation of this Act shall constitute a separate violation,
The building inspector in the affected town shall have the power and ditty to enforce the provisions
of this Act.
As such, we have referred this matter to Mr. Mark Grylls, Building Commissioner for the Town of
Yarmouth. Any objection or inquiry in reference to this notice should be filed in writing and addressed to:
