I was dispatched with Officer Golden to 4 Glenwood for a report of a Town Inspector and the owner of 4
Glenwood (Nicholas Fiorilla)having an issue over trespassing on the property.
I arrived and found the town inspector(Tim Sears) leaning on the rear of his town vehicle which was
parked in the driveway of the property. He reports that the town and owner(Fiorilla)have had an on going issue
with inspections and occupancy permits and he arrived today to ensure the "cease and desist" stickers were still
affixed on the property. He observed the rear doors sticker was missing and had to walk to the front of the house
to see the sticker for the front door which was propped open with a large doorstop. He leaned in (which would
be required to see the front door) and observed a torn but still affixed sticker dated July 14, 2021. The
notice/sticker had a line indicating its purpose "details of violation" which read, "no occupancy permit".
Sears states he was met at the door by the owner and was invited in but Sears declined saying I don't need
to go in I'm just checking the sticker". He walked away as the owner was yelling and affixed another sticker on
the rear door which the owner promptly ripped off a portion and threw it toward Sears. The yelling continued
and he was told by Fiorilla that the police had been called. Sears waited at his vehicle for YPD to arrive.
Fiorilla states he met Sears at the door and immediatly told him to leave the property and to not enter. He
states Sears forced his was in and affixed a sticker to the door. (He later recanted this and said he just forced his
way in). Fiorilla states he was in fear and felt uneasy. Sears then walked toward the rear door and Fiorilla states
he followed and placed himself in the way of Sears path but Sears again forced his way by and affixed the
sticker to the rear door. Fiorilla added he asked Sears to leave the property many times. Sears'demeanor was
loud and very insistent that charges for tresspassing be charged.
Fiorilla wife (Tracy) did not want to speak but Fiorilla insisted I take her statement. He continuously
interrupted her and told her what to say as I was taking the statement. She did state the inspector entered the
house to put a sticker on the door.
Fiorilla also wanted another witness to give a statement. Jake Phelan was working inside the house and
heard the commotion but did not witness anything at the front door. He did see the sticker being affixed to the
rear door.
I interviewed a neighbor who lives directly across the street. He (Ron Wackrow) states he was inside his
house when he heard his neighbor yelling. He went outside to observe Fiorilla yelling very loudly at Sears in
front of 4 Glenwood. Wackrow adds Fiorilla was very aggressive and it escalated to the point he was worried
about Sears' safety.

I returned to the front door to take a photo of the sticker and Fiorilla asked what they had said. I informed
him I would note what all persons had reported and he , if he chose, could go to court and request charges be
pulled. He insisted I do that right now. I informed him again of the procedure but he spoke over me. I
photographed the door with the torn sticker. I asked why the date was not from today and reminded him that he
and Tracy had said the inspector had pushed his way in to put a sticker on the door.He now said no new sticker
was placed today. Fiorilla now insisted to know what the neighbor had said. I gave a brief account and Fiorilla
states that Wackrow has it out for him due to a previous real estate issue.
I informed I'd be clearing and Fiorilla wanted me to add a photo of the second sticker. I informed him it
would not be necessary. Fiorilla became louder and more insistent that I do so. I told he we were leaving which
we did.
No further police action required at this time.
