The results of the Plumbing&Gas Inspectors visit are that the system has failed inspection as a result of incorrect venting materials being used to exhaust the fixture.The safety of the unit is unclear.This code violation will need to be corrected.In addition to this,the inspector noted that there is a black discharge bubbling up from the raised septic system. I have copied the Health Director Bruce Murphy to make him aware of the apparent septic issues. The wiring permit for the unit was issued today.I am not aware of the inspection status. The owner has released the original contractor for the project.The original building permit is in limbo at this time.I am not aware of a contractor assuming responsibility for the building permit.The building inspections are not complete and the Occupancy Permit has not been issued to date.Any occupancy is a violation of section R111.1 of the MA State Building Code. There is not likely any chance that this will be resolved tomorrow. It is the end of the day and the contractor informed this office that they would be visiting the site tomorrow to make sure it is ready for inspection. The furnace does not have a permit for the gas and electrical connections yet either. We are just trying to keep Yarmouth vacationers safe. After multiple tickets , conversations , emails and letters , 2 Mr. Sears stated that as of October 13,2021 Mr. Fiorillo has failed to obtain a occupancy permit. Failing to obtain an occupancy permit is a violation of the State of Massachusetts Building Code 780CMR Sec. 111.2 When Nick Fiorillo signed the request for a hearing form on August 1, 2021, he acknowledged the following;"... I am aware that if I fail to appear at the time and place of the hearing I will be deemed responsible for the listed violations."Mr. Fiorillo did not attend the hearing and is responsible for fines totalling$23000.00. This decision may be appealed to the housing court within the county in which the violation occurred and shall be entitled to a hearing before a magistrate of the court.The appeal shall be filed by the aggrieved person within 10 days after receiving notice of the decision from the municipal hearing officer who conducted the meeting.
