Aug. 6, 2024 4 Millbrook Lane Bolton, MA 01740 RE: Short Term Rental noise complaints Dear Mr. &Ms. Hanoosh; Please be advised that I am the Zoning Enforcement officer for the Town of Yarmouth, In that capacity,this letter constitutes a formal order for zoning compliance. This office has received numerous complaints regarding excessive noise on your property. The Yarmouth Police Dept(YPD)has confirmed that they have responded to noise complaint calls at your property,the most recent being on the early morning of August 2 on two separate occasions. YP.D does not create formal reports for noise complaints and the responding officer did not call in the name of the party they met. However, the noise is allegedly being generated by tenants utilizing your Short Term Rental as defined in Section 418.2 of the Town of Yarmouth Zoning Bylaw. Section 418.4#2 requires that your Rental Certificate be on displayed the property in a prominent location and shall include 24-hour local contact information. Section 418.5 #4c states that this use shall not adversely affect the residential character of the neighborhood nor interfere with any reasonable persons enjoyment of their residence. As the property owner it is your responsibility to comply with section 418 in its entirety. Failure to comply with the provisions of the zoning bylaw may result in penalties as prescribed. Section 101.3 Penalties. Any person violating any of the provisions of this bylaw shall be fined not more than three hundred dollars($300)for each offense. Each day that such violation continues shall constitute a separate offense. You are hereby ordered to abate and or correct the violations noted above. Alternatively,you may appeal this order to the Zoning Board of Appeals as allowed by MGL c. 40a§7& Y 15. Hi Mark, Nice speaking with you today and thank you for the time. Per your letter to us we are posting the Rental Certificate and a Quiet Hours sign in our house for all the short term renters this week. I even outlined the noise ordinance and the applicable fine in the quiet hours sign to make sure people respect the neighbors and keep the noise to a minimum. This should have us in compliance with Section 418.4#2 and 418.5#4c. Please let me know if you have any questions. Best, James 1
