RE: Operation of Junk Yard—324 Route 28 West Yarmouth
To whom it may concern,
Please be advised that I am the Zoning Enforcement officer for the Town of Yarmouth, In that capacity, this
letter constitutes a formal order for zoning compliance.
This office has received numerous complaints regarding the use of 324 Route 28 West Yarmouth. A recent site
visit has identified numerous junk vehicles, equipment, engines, transmissions, and storage containers to name a
few. The items mentioned are distributed throughout the site.
This use qualifies as a junkyard which is identified in the Town of Yarmouth Zoning Bylaw, Use Table 202.5 as
an L6 Junk Yard or Similar use. This use is prohibited in the zoning bylaw.
Failure to comply with the provisions of the zoning bylaw may result in penalties as prescribed.
Section 101.3 Penalties. Any person violating any of the provisions of this bylaw shall be fined not more than
three hundred dollars ($300) for each offense. Each day that such violation continues shall constitute a separate
offense.
You are hereby ordered to abate and or correct the violations noted above. Alternatively, you may appeal this
order to the Zoning Board of Appeals as allowed by MGL c. 40a §7 & §15.
I request that you respond to this letter within 7 days to confirm your intent to comply with the same.
