Members of the Yarmouth Zoning Board of Appeals,
We are writing this in support of Mike and Cyndy Micale's petition ##5130 concerning the building department's recent
permit (BLDR-24-346) to Matt Marino to rebuild his house at 21 Lewis Bay Road.
Last September 28 he came before the zoning board and was told he couldn't have a deck on a three story house as it
would be over the height limit. The lots on his side of the street are small and the houses are close together as well as
the houses behind him on another street.
He has now done away with the need for variances thus doing an end around the zoning board and going straight to the
building department. He still has plans for a three story house with a deck with no change in the height.
Even three stories is too high for the area just to have open space and a bathroom as indicated in his plans. It seems his
need for a third floor is to get a deck high enough for a view.
It would loom over its neighbors giving them no privacy in their yards. Two other houses on the street at 15 and 27
Lewis Bay Road have rebuilt with two story homes which fit the area better than a three story home.
We respectfully ask that your ruling on October 10 be the same as it was last September as nothing has changed in
regards to the height.
