We own the property at 15 Lewis Bay Road, the first raze and replacement in Yarmouth in 2003. The height of our home is 26 ft and 2 stories. Attic is crawl space. Mr. Marino withdrew his plans without prejudice Sept 28th after the ZBA members voted unanimously that his proposed plan was too large for his lot. The board also stated house height was also too much for the neighborhood and the proposed roof deck would be habitable space. He was told to go back and redesign with a height of 26 feet. By meeting the setbacks, Mr Marino has bypassed the height requirement recommended by the ZBA on Sept 28th. I believe this new plan is slightly higher. I believe Mr. Marino has the absolute right in razing and replacing his current "cottage" but the height of this will impinge on many other properties` privacy in the neighborhood. "Rinse stations" will be able to be viewed by any number of people that choose to sit on either deck proposed in the rear of the house. We had to follow strict guidelines in our home building process. I cannot add on, nor convert a 3 season porch to a 4 season. I was happy to comply. Again, we are not opposed to a new home, only the height. We ask that you please consider requiring a height that is equal to the other new homes on Lewis Bay Road, 26 ft. If allowed to go 40+feet, not only will much privacy be lost, but I also fear for home values. Thank you Carol and Patrick Walsh 15 Lewis Bay Road
