Dear Susan,
Our records show that your septic system is designed for 3 bedrooms. A walk through of home found that there are currently 6 bedrooms in the home. This is in accordance with the State
Environmental Code, Title 5, 310 CMR 15.303 (2). The system is designed for 3 bedrooms and there are 6 bedrooms in the home which is putting your septic system in failure due to being
undersized. You must remove 3 bedrooms or upgrade your septic system.
According to 310 CMR 15.305: Deadlines for Completion of Upgrades, from the State Environmental Code, Title 5, owners of systems that fail to protect public health and safety of the
environment shall upgrade the system within two years of discovery. The deadline for the upgrade of your septic system is September 26, 2026. If you have not started the process of
upgrading your septic system, you must do so now or open up 3 of the bedrooms walls with a floor to ceiling 5 foot cased opening.
You have the right to appeal the above orders by requesting a hearing before the Board of Health. Said request shall be in writing and received in the office of the Health Department
within 7 days of receipt of this notice. At said hearing; you have the right to be heard and to present witness and documentary evidence as to why this order should be modified or
withdrawn. You have the right to be represented by an attorney and to inspect and obtain all relevant inspection or investigation reports, orders, notices, and other documents in possession
of this office. Also, any adverse party has the right to be present at said hearing
