Cc'd are Alex Nemanov (homeowner) and Wayne Tavares (designer of the dock). We are building a new house at 2 Buttercup Ln and have gone through the many processes of Conservation, Board of Health, Building Dept, and Zoning Board of Appeals to get as far as you see when you pass our house. Now, we are attempting to redevelop the dock that has been falling apart, through neglect, for some time. The process is one of Conservation and Building Dept (Town of Yarmouth) and Massachusetts DEP which grants the license for such a dock. DEP (Department of Environmental Protection) suggests (in every case) that, if possible, the new dock owner keep his dock 25' from the property line extended into water (in this case .... Follins Bay). The existing location of the dock is the location we chose for the new dock because it has previously been developed and the pathway to that dock represents the least damage to the coastal bank. If we go over in a new location, the coastal bank will be degraded. Conservation has asked us to pursue this with you, as the abutter that is being encroached. If the dock is built where it is, instead of a 25' setback from the property line extended, the dock would strat 13.38' from your property line and running askew from the property line and would end approx. 26.1 0' away from the property line extended into Follins Bay. The reason for the 25' separation is that many waterfront lots have small frontage and the neighboring docks would be protected if everyone could follow this rule. In other words, if each neighbor observed the rule, there would be 50' separation (twice 25') between docks and no interference with boats docking on either side. We are 100'-105' from our neighbor to the east. With your frontage on Follins Pond, we believe, that we are not encroaching on your property due to your superior frontage along the pond. If we redevelop according to the rule, we would move 12 to the right (east) causing a new "cut into the embankment" destabilizing the vegetated coastal bank. The solution discussed, is both an environmental and common sense solution. Attached please find the plans showing the dock's location (by field survey). The dock is of that length to reach the 3' (three ft) depth as required by the Waterways Committee, which is reflected in the plan. To sum up, we believe that it makes most sense to rebuild the dock in the existing location, and if this is fine with you, please confirm it by email.
