This is a violation of Section R105.1 of the Massachusetts State Building code. R105.1 Required. It shall be unlawful to construct, reconstruct, alter, repair, remove or demolish a building or structure; or to change the use or occupancy of a building or structure; or to install or alter any equipment for which provision is made or the installation o f which is regulated by this code without first filing a written application with the building off vial and obtaining the required permit. Failure to comply with the MA State Building code 780CMR is subject to fines and penalties as prescribed in MGL CH 143 section 91. Each day constitutes a new violation. To remedy this violation make proper application for the required building permits, and receive a building permit for this violation. You are required to respond within 7 days of receipt of this notice. You may appeal this letter to the Building Code Appeals Board in accordance with M.G.L. c. 143 § 100, within 45 days of this notice. This work was completed without the required building permit from this office or the required application and approval from the Old Kings Highway Historic District Committee. You are hereby notified that you are to Cease and Desist with any and all work, interior or exterior that requires a Building Permit and is also a violation of the OKH regulations on the above -referenced property until you have applied for and been issued a building permit by this office. OKH Bulletin Section 12 reads as follows: Section 12 — Enforcement Any person who violates any provision of this Act shall be guilty of as a misdemeanor and upon conviction thereof shall be fined not less One Hundred Dollars (S100) nor more than Five Hundred Dollars (S500). Each Day of violation of this Act shall constitute a separate violation. This office understands that the work was undertaken between December 6, 2023, and December 10, 2023, with demolition being witnessed by several passersby on December 8, 2023. On December 9, another resident witnessed a hole in the ell roof where the chimney had been located. Any fines imposed as allowed by the OKH Bulletin will begin on December 8, 2023, and continue daily until the work undertaken without the proper permitting has been reversed or been granted permits. Violations of 780 CMR, MA State Building Code will be addressed in a separate notice. You are hereby directed to make proper application for the required approvals and permits. Per MGL. CH. 143 Sec. 91, violations of the MA State Building Code, can result in fines of up to $1000.00 per day. You are required to respond within 7 days of the date of this letter Questions in this matter may be directed to this department.
