Box 443 • Barnstable MA 02630 • (508) 362-2565 • Fax (508) 362-4480• mark@thecompact.net Ms. Brittany DiRienzo November 8, 2024 Conservation Administrator Town of Yarmouth 1146 Route 28 South Yarmouth, MA 02664 Dear Ms. DiRienzo, On behalf of the Native Land Conservancy, we respectfully ask that the Yarmouth Conservation Commission review the attached Conservation Restriction (CR) at your November 21, 2024 meeting. We hope that the Conservation Commission will recommend town approval of this Conservation Restriction by the Select Board. The Rivero Conservation Restriction will permanently protect a 9.120-acre parcel of land along Route 6A in Yarmouthport. The Native Land Conservancy received this property as a donation of land from the Rivero family and the Yarmouth Conservation Trust has agreed to hold the conservation restriction. The property is identified as an Indigenous Cultural Landscape that is part of the Wampanoag ancestral homelands. The property also abuts 10.816 acres of conservation land to the west, acquired by the Native Land Conservancy in 2020 that also has a conservation restriction held by the Yarmouth Conservation Trust. Preserving this property will maintain its many conservation benefits including maintaining the water quality within the Chase Garden Creek estuary, protecting drinking water within a Zone II Wellhead protection area, and maintaining critical habitat for threatened species. The Conservation Restriction, included with this letter, has received approval for local signatures from the Massachusetts EEA Division of Conservation Services. We are anticipating recording of the Conservation Restriction by December 31, 2024. Please let me know if you have any questions.
