Re: Violation Letter - Rental Registration/Inspection Required
Rental(s): 123 Beacon Rd, South Yarmouth,
Dear Dakenson:
It was brought to the attention of the Health Department that the above address is being used as a rental.
In effect since August 1976, the Town Bylaw, § 108-2 Certificate of registration required; posting, mandates all rental properties be registered.
The registration process is an Annual requirement, due each calendar year and expiring on December 31 of that year.
You are required to register your rental property with the Town of Yarmouth and contact this office to arrange a 2024 inspection. The registration fee is $80.00 per unit per each year
used as a rental.
Per § 108-6 Penalty, violating § 108-2 subjects the person up to a $300 fine with each day constituting a separate offense.
It was also brought to our attention that there are several illegal bedrooms in the home. These bedrooms must be removed. A building permit must be pulled to ensure proper, legal, and
safe deconstruction is being followed. The home has a septic system designed for 3 bedroom which would allow 6 TENANTS MAX.
You have seven (7) days from date of receipt of this letter to respond to this office.
You have the right to appeal against the above orders by requesting a hearing before the Board of Health. Said request shall be in writing and received in the office of the Health Department
within 7 days of receipt of this notice. At said hearing, you have the right to be heard and to present witness and documentary evidence as to why this order should be modified or
withdrawn. You have the right to be represented by an attorney and to inspect and obtain all relevant inspection or investigation reports, orders, notices, and other documents in possession
of this office. Also, any adverse party has the right to be present at said hearing.
