We had reviewed my January 28, 2009 determination wherein I found this parcel of land did not qualify for the protection afforded in zoning bylaw Section 104.3.4. This was based on the Assessors' conveyance records. However,because this decision was contrary to one issued on April 17, 1996 by Forrest White I said I would request a legal opinion from Town Counsel. On August 13, 2009 I made that request. Enclosed is a copy of Town Counsel Bruce P. Gilmore's August 20,2009 legal opinion. He reviewed the actual deeds and found that the transfers from Mrs.Melnick were done so,either for estate planning purposes or an attempt to "checkerboard"the lots. In either event Attorney Gilmore found that Mrs. Melnick exercised sufficient control over the lot in question and two adjoining parcels. Therefore,it is his opinion that parcel 236 is protected and therefore buildable for zoning purposes. In some circumstances the issue of "control" can cause a parcel to be disqualified from being protected, however, in this scenario it caused the three lots to maintain their contiguous status. I had based my January 28, 2009 determination on a separation of ownership (control). At the conclusion of Attorney Gilmore's August 20, 2009 letter he states that "the conveyance to Christian and Elizabeth Preus in 1996 enjoyed the protections for Section 104.3.4(2). Brandolini, Building Commissioner DATE: August 13,2009 SUBJECT: Parcel 236,Assessors Map 22 On January 28, 2009 I determined that parcel 236 (lot 3) shown on Assessors' Map 22 does not qualify for the protection afforded in Zoning Bylaw Section 104.3.4(1)(2)and MGL 40A, Section 6, know as the separate and common lot protection. This parcel contains 8,960+/- square feet of area and 80 feet of frontage. I made this determination based on the fact that the parcel was conveyed from common ownership to single ownership,back to common ownership and then back to separate ownership as referenced in the February 4, 1952,March 26, 1986,October 7, 1992 and June 3, 1996 conveyances. Adjoining parcel 235 (lot 2)is developed with a single family dwelling. Unfortunately,the current owners purchased this parcel based on the attached April 17, 1996 letter from Forrest E. White. This was a response to an April 1, 1996 letter from Attorney Donald F. Henderson. Attorney Henderson provided information based on the then existing ownership and not the historical tracking. Attached are copies of the pertinent information. On March 26, 1986, Mrs. Melnick conveyed Lot 3 to Walter Melnick for$1.00 and Lot 1 to her daughter, Barbara Polidor. These family transfers appear to be either for estate planning purposes or an attempt to"checkerboard"the lots. Walter Mclnick died in 1989 and Lot 3 went back to Mary. She conveyed Lots 2 and 3 to her daughter,Barbara Polidor on October 7, 1992, reserving a life estate in herself. I conclude that the transfers described would demonstrate that Mrs. Melnick exercised sufficient control over these three(3)lots from 1952 until 1992 (and arguably beyond)and all three (3) lots remained a contiguous whole. The DeStefanc case would seem to support such a conclusion. • As a result, the conveyance to Christian and Elizabeth Preus in 1996 enjoyed the protections for Section 104.3.4 (2). We had reviewed my January 28, 2009 determination wherein I found this parcel of land did not qualify for the protection afforded in zoning bylaw Section 104.3.4. This was based on the Assessors'conveyance records. However,because this decision was contrary to one issued on April 17, 1996 by Forrest White I said I would request a legal opinion from Town Counsel. On August 13,2009 I made that request. Enclosed is a copy of Town Counsel Bruce P. Gilmore's August 20,2009 legal opinion. He reviewed the actual deeds and found that the transfers from Mrs.Melnick were done so,either for estate planning purposes or an attempt to"checkerboard" the lots. In either event Attorney Gilmore found that Mrs. Melnick exercised sufficient control over the lot in question and two adjoining parcels. Therefore,it is his opinion that parcel 236 is protected and therefore buildable for zoning purposes. In some circumstances the issue of "control" can cause a parcel to be disqualified from being protected, however, in this scenario it caused the three lots to maintain their contiguous status. I had based my January 28, 2009 determination on a separation of ownership(control). At the conclusion of Attorney Gilmore's August 20, 2009 letter he states that "the conveyance to Christian and Elizabeth Preus in 1996 enjoyed the protections for Section 104.3.4(2).
