Yarmouth. My findings and comments are as follows: -The lot in question was created via a Subdivision Plan dated,October, 1941 and is depicted as Lot 90,containing a land area of 8,460 square feet and total frontage of 181.44+/-feet. -The lot in question is held in common ownership with parcel 194(Lot 89). -On August 27, 1987 the Zoning Board of Appeals issued a variance via Petition No.2456 allowing the lot to be built upon. This petition references a plan prepared by Land Surveyor A.Ojala which had a revised dated of July 2, 1987. This plan depicts the land area as being 8,282 square feet and a"Road Easement around the entire perimeter of the lot. -The Board cites in its decision that the "Petitioners also submitted a site plan showing that the Town of Yarmouth had taken 832 square feet of this lot for road easement,leaving 7,628 square feet. However,the site plan after deducing the easement area leave a lot are of only 7,450 square feet,fifty(50)short of the square footage necessary under today's zoning as this lot is held in common ownership with lot 89." -This variance was not exercised. -The Board of Appeals file included a"Building Lot"plan,of Lot 90,depicting 7,450 square feet of land area. -On November 14, 1997 a variance was denied,via Petition No.3436,by the Zoning Administrator,Leslie Campbell. In his decision he cited that lot(90)"contains 7,450 square feet of land area"and was in common ownership with lot 89. It also made reference to the 1987 Petition,number 2456. Mr.Campbell concluded"that there is insufficient hardship to justify a Variance for this lot,and the problem with the lot is really its size,and not shape." In summary, because the lot in question, Lot 90, appears to have less than 7,500 square feet of land area and has been historically and is currently held in common ownership with Lot 89,I find that Parcel 193(Lot 90)does not qualify for protection pursuant to the provisions of Zoning Bylaw 104.3.4, paragraph 2 and is considered merged for zoning purposes with Parcel 194(Lot 89). In- addition this lot has a unique shape , different from other lots in this subdivision. The Board feels the petitioner meets the criteria and that in granting this variance there will be no substantial detriment to the public good and it would not substantially derogate from the intent and purpose of the bylaw. The petitioner is the owner of the vacant lot shown on Assessor's Map 29, Parcel C90. It contains 7450 square feet of area. However, because the petitioner also owns the adjoining lot 89 (to the north) the bylaw, §104.3.4 (2) requires a minimum of 7500 square feet for the lot to be independently buildable. On August 31, 1987, (#2456) the petitioner was granted a Variance to allow the lot to be used for a single family home, not withstanding the size deficiency. That Variance was never exercised, and has lapsed. The petitioner now seeks a new Variance for the same purposes. The Zoning Administrator received numerous notes and letters from neighbors in opposition to the petition. The Zoning Administrator also received a memorandum from the Planning Board, voicing its opposition to the petition. The Zoning Administrator noted that the petitioner owns the adjoining lot, on which her residence is located. She would have the option of expanding that use onto this lot, if she chose to do so. Under the circumstances, the Zoning Administrator finds that there is insufficient hardship to justify a Variance for this lot, and the problem with the lot is really its size, not its shape. The Zoning Administrator therefore denied that Variance request, and noted to the petitioner that she had the option to appeal the determination to the full Board if she wished to do so. -1- Appeals from this decision shall be made pursuant to c40A §17 and must be filed within 30 days after the filing of this notice/decision with the Town Clerk. � • David S. Property and/or structure located at Lot C90 Breezy Point Rd. South Yarmouth. Assessor's Map: 29, Parcel: C90, Zoning District: R25. The petitioner seeks a Special Permit and or Variance from the Yarmouth Zoning By-law under §104.3.5, 104.3.4, 103.3.4 to build a single family home, relief from required frontage and plot plan more than 2 years old. Mr. Campbell opened the meeting by stating that Mrs. Pierson was a real estate broker as he was, and he has no opinion on this matter. He asked if anyone feels that he has a conflict by virtue of being in the same business to speak now. None of the neighbors present objected. Mrs. Pierson presented her petition by mentioning that she purchased property in 1987 at 45 Breezy Point Rd. and 51 Breezy Point Rd. She was granted a Variance on lot C90, Appeal #2456, in August 1987. Because of the extent of repairs that had to be undertaken on the house at 45 Breezy Point Road she was unable financially to build a house at the time. The property has 7,450 sq. ft.. At that time she had an approved septic plan and building permit. She stated that at this time it will be a handicap for her if she is unable to sell the property. Mrs. Pierson stated that she would like to build a year round home. Mr. Campbell asked if she owned the lot north to Lot 89 (referred to as the Mero property) which is 45 Breezy Point. Yes, she owns it. Mr. Campbell mentioned that he noticed the difference in the size of the lot. Mrs. Pierson stated that there is a road easement. He asked if she was building the same house that was approved in 1987. Mrs. Pierson stated that she was. She stated that she did not know that a Variance could expire, she assumed it didn't expire. Mr. Campbell read several letters from neighbors and abutters in opposition to the request to build a house on this lot. He also read a memo from the Planning Board reiterating their 1987 memo, which stated that they strongly objected to the granting of relief to allow building on the undersized lot. -1- • Mr. Campbell asked if anyone wanted to make a comment on this request. Maureen LaRock of 6 Evergreen Street, read a statement which was in opposition to the request. Roger Sherman of 16 Evergreen Street,Raymond Gallop of 5 Evergreen read a letter in opposition that he prepared, Peter Petrocki of 14 Evergreen Street, opposed to the request. Mr. White mentioned that §103.3.4 applies to commercial property. It appears that a Variance is needed here and that the new section deals with Special Permit's for uses and additions, it wouldn't apply to this case. You have to look back at the original bylaw§104.3.4 non-conforming lots, second paragraph. It appears to be that 7500 sq ft would be allowed and 75 feet of frontage. She falls short of the 7500 sq ft by virtue of the taking of the land by the town. Whether the town takes it or she sells it or gives it a way, its the same purpose, it does render the lot less square feet then it had in the beginning. You have to use that 7450 sq. ft., 50'shy of falling in to place with that second paragraph. Mrs. Pierson mentioned that the Variance was granted before because it was just 50' short of the regular lot size. She asked if the Variance was not granted, does she have the right to add on to the house at 45 Breezy Point and make it larger, or put up a fence around her property. Mr. White stated that she could. She mentioned it was her desire to build a year round home. She felt it would enhance the neighborhood. Mr. Campbell stated that she could do that by right if she conformed to the setback requirements. Mr. Gallop asked for a clarification. Mr. White stated that she could build over the lot line on to that lot if she wanted to add on the home. She could use that lot for an accessory use, if she wanted to put up a garage she could by right. But not a separate single family dwelling. After a brief discussion regarding the flood plan and elevations in the area, Mr. Campbell denied the petition and suggested to Mrs. Pierson she could take her appeal to the full Board of Appeals. He noted the number of people who came out for this hearing and didn't want to make a decision on it personally, and it should be voted by the whole board of appeals. -2- • Vision Government Solutions
