Fitzsimmons 25 Mid Tech Drive West Yarmouth, MA 02673 Re: Parcels 222 & 223, 80,'82 Breezy Point Road Lot Inquiry Dear Attorney Fitzsimmons: This is to serve as an addendum to an October 27, 2016 Lot Inquiry determination, copy enclosed, concerning parcels 222 and 223, shown on Assessors Map 34 and depicted on an October, 1945 subdivision plan as lots 31 and 32, These lots contain a total of21,650 f with a total frontage of 100 feet (the upland area is unknown). The determination details are as follows: -The lots in questions were created via a subdivision dated October, 1941 and recorded at the Barnstable Registry of Deeds on December 14, 1945. -According to the plan, Lot 31 contains 10,400 square feet of land area and lot 32 contains 11,250 square feet. -The site lies within the R-25 Zoning District, requiring a minimum of 25,000 square feet of upland land area. -This requirement was adopted on January 7, 1989, when the Town voted to increase the minimum land area from 15,000 square feet to 25,000 square feet. -The lots comprising 88 Breezy Point were developed in 1967, according to the Assessors records. -The lots comprising 92 Breezy Point were developed in 1952, according to the Assessors records. -According to the Assessors records, lots 31 and 32 were conveyed from Mary Woodbury to Mark Woodbury on April 17, 2001. -The combined lots comprising 88 Breezy Point Road were conveyed from Seldon J. Woodbury to Mark Woodbury on December 1, 2009. -The combined lots comprising 92 Breezy Point Road were conveyed from the Town of Yarmouth Tax Title (formally owned by June Mae Mahoney) to Mark Woodbury on March 3, 1997. Because Lots 31 & 32 (parcel 222 & 223) were conveyed into common ownership after the combined lot total became non -conforming, it has been determined that theses lots are deemed merged with 88 Breezy Point Road and are not considered protected pursuant to the provisions of M.G.L. Chapter 40A, Section 6 and Town of Yarmouth Zoning Bylaw Section 104.3.4, para. 1, 2 or 5. You may contact me should you have any questions concerning this matter or should you have additional information concerning the ownership tracking, which this department obtained via the Assessors' records.
