Bruce:
On behalf of the Building Department we are requesting a legal opinion, concerning Parcel 52, shown on
Assessors map 132. We previously determined that parcel 52 complies with the provisions of zoning bylaw,
Section 104.3.4,--Non-conforming Lots, Para. 5, in that it was created before 1996, contains more than 10,000
square feet of land area (wetland TBD), contains more than the requisite frontage and was held on common
ownership with one adjoining parcel (53) prior to 1996. Parcel 53 is developed with a single family dwelling. We
are advised that parcel 52 was sold and conveyed into separate ownership a few weeks ago.
The question arises from Attorney John W. Kenney, who represents the owners of parcel 59, who wish to
purchase parcel 52, which is adjoining. Our concern is; that now that parcel 52 is in separate ownership does it
still qualify for protection pursuant to the provisions of Para. 5 or would it be deemed merged.

Once lot 52 is purchased by the owner of lot 59, I believe lot 52 loses its protection under sec. 104.3.4 and
the lots merge.
