Dear Mr. Smith:
I have reviewed all of the information you have provided with respect to Lot 2 (357.2), shown on
Assessors' map 25 as part of parcel 357 and have concluded that said lot does not qualify for
protection under the provisions of Section 104.3.4 (2) for the following reasons:
1. As you have indicated Section 104.3.4 (2) provides certain protection for up to three (3)
contiguous lots held in common ownership. However, this section also provides that "such lot
was held in common ownership with contiguous lots and had less than the dimensional and
density requirements of the newly effective zoning -". This implies that in order to qualify for
this protection, the status of a lot had to have been in common ownership with at least one and
up to two other contiguous lots at the time it became non -conforming. The question then
arises; when did lot 2 "fall into common ownership" with lot 1 and how does the common
ownership of the original developers come into play?
2. This subdivision was created on or about May 16, 1949
3. The zoning changed on February 14, 1950 from 6,500 square feet to 8,500 square feet of area,
making this lot non -conforming, not withstanding any subdivision protection. At that time
Spaulding & Bailey, the original developers, owned these and other lots
4. As you stated in your letter, Spaulding & Bailey owned lot 2 until December 15, 1954; at which
time it was conveyed to Bailey. In 1956 it was conveyed to Thomas Eayrs, Jr and then to himself
and Lucy Eayrs on April 22, 1968.
5. In this case, the original developers Spaulding & Bailey retained title to many of the lots created
in this subdivision and were afforded applicable subdivision protection. However, subsequent
conveyances show that lots 1 and 2 were separated when Bailey conveyed lot 1 to Jefferson on
January 29, 1951 and Bailey conveyed lot 2 to T. Eayrs, Jr. in 1956.

6. In terms of applying Section 104.3.4 (2), lots I and 2 were not held in common ownership until
Boston Federal Savings Bank conveyed lot 1 to Thomas & Lucy Eayars in 1953.
7. Additionally, in applying MGL Chapter 40A, Section 6- Common Lot Protection, lot 2 was also
afforded a five (5) year protection from January 1, 1976, ending January 1, 1981.
In conclusion, I find that lot two (2) does not meet the technical qualifications for protection under
Section104.3.4 (2) for the reasons stated above and that lots 1 and 2, so called, have merged for
zoning purposes.

In regards to the above named property, please be advised that I have been
asked by John and Hilary Rosenbeck, the owners of the property, to determine if the
lot is buildable under the current zoning requirements. Enclosed in regards thereto is a
Buildable Lot Inquiry Form. I have also included for your use and information the
following documents:
1. Copy of deed to the current owners recorded in Book 10146 Page 96 on
April 11,1996.
2. Copy of a portion of the subdivision plan.
3. Copy of the mortgage inspection plan prepared by Yankee Survey
Consultants.
The party that sold the property to my clients obtained title to loth in August
1951 deed `recorded in Book 851 Page 452 and obtain title to lot_2 in April 196&by
deed recorded in Book 1398 Page 528. My research of the Registry of Deeds records
indicate to me that the Eayrs did not own any other adjoining lots.
Accordingly, I believe that under the provisions of Section 104.3.4 (2) lot 2 (also
known as lot E1-2 on Assessor's Map 15) is a buildable lot as it has more than 75 feet of
frontage and more than 7,500 square feet of area.
I would appreciate it if you would review this information and make a

As a follow up to our recent telephone conversation as you have requested, I
have researched the title deeds for the other lots not referenced in the deed in Book 929
Page 231 and I am enclosing copies of the deeds for each of the lots.
Norwood Spaulding and John Bailey convey some of these lots directly to third
party Buyers in 1949 and 1950. Others are first transferred to Bailey who later sells to
third parties.
It still appears to me that lot 2 comes under the provisions of Section 104.3.4 (2)
which indicates that any increase in area, frontage or other dimensional requirements
shall not apply to a lot for single family residential use provided the plan for such lot
was duly recorded and such lot was held in common ownership with contiguous lots
and had at least 7,500 square feet and 75 feet of frontage. Lot 2 meets the requirements
of that Section in that it is held in common ownership with Lot 1, is shown on a
recorded plan, has more than 75 feet of frontage and in excess of 7,500 square feet of
area.
