Staff Present: Dolores Fallon PETITION 5144: Alfredo and Janel Lopilato. Property Location: 21 Television Lane, West Yarmouth, MA. Map & Lot #: 14.53; Zoning District: R-25. The Applicant seeks a Special Permit per §104.3.2(2) to increase the ridge height of a nonconforming structure. Mr. Lopilato stated that when it rains, the crawl space floods. If the rainfall is heavy, the water level is two inches from the floor joists. Wants to raise the foundation. Board Questions: Do you have a plan that shows how high you want to raise the foundation? At the hearing, the petitioner provided a foundation plan to the Board. Is it a poured foundation now? It’s block, but want a poured foundation. Raising the foundation to meet flood regulations? Yes. Current elevation is 5’ 5”. New elevation is 12’ 2”. Yes. Did you show the plan to the homeowner association? No. You may want to check with them about any restrictions. Are you planning to put fill in the front? Maybe down the line. How are you going to get into the house? Stairs. How do you get in/out of the house now? Front and back stairs (back door & slider). If you go up 7 feet, the stairs might be into the rear and side setbacks. Corner lot with two sides and two fronts. 15’ side setback in the rear. Building code: 4’ landing off the house. Then, the stairs would come off the landing. The Board needs more information: • Any requirements/restrictions from the homeowners association? • After raising the foundation, stairs in setback? • Additional relief needed? • Need the elevation of the existing grade of the lot; need to see how many stairs, where stairs come out, stair cross-sections, landings, and setbacks from lot lines. • Can raise the grade or cover the exposed foundation for aesthetic purposes. A motion was made by Mr. Martin and seconded by Mr. Fraprie to continue the hearing to January 9, 2025. On a voice vote (5-0), the motion was approved.
