Housing Court Department The Southeastern Division Bristol, Plymouth & Barnstable Counties NO (Civil) COMPLAINT To the Housing Court department, Southeastern division, for the transaction of civil business: I, Timothy S Sears Deputy Building Commissioner of the Town of Yarmouth Building Department, complain under oath that: Brian Wilson & Steve Wilson are the Owners of a property located at 16 Denver Drive in the Town of Yarmouth. After receiving a written complaint on 9/25/23, an authorized representative of the Town of Yarmouth examined the dwelling/property on or about 10/23/2023. The inspection revealed that the dwelling/property did not comply with the provisions of the Town of Yarmouth Zoning Bylaw. The Defendant was served pursuant to Section 401.1.2 of the Code on or about, 9/27/2023 and 8/9/2024 and that the Defendant has willfully, intentionally, recklessly, or repeatedly failed to comply with the order from the date of being served with the order to and including the date of the complaint. It has come to the attention of the Building Department that a camper is being occupied at this property. This is a violation of the Town of Yarmouth Zoning Bylaws section 401.1.2. 401.1.2 Camping and Recreational Equipment. 401.1.1 At no time shall parked or stored camping and recreational equipment be occupied or used for living, sleeping or housekeeping purposes. 401.1. 2 If camping or recreational equipment is parked or stored outside of a garage, it shall be parked or stored to the rear of the front of the building line of the lot, except for loading and unloading. Failure to comply with the provisions of the zoning bylaw may result in penalties as prescribed. 101.3 Penalties. Any person violating any of the provisions of -this bylaw shall be fined not more than three hundred dollars ($300) for each offense. Each day that such violation continues shall constitute a separate offense You are hereby ordered to abate and or correct said violations or seek relief from the Zoning Board of Appeals as allowed by MGL Ch 40a §7 & § 15.
