The purpose of a Lot Inquiry is to determine whether an undeveloped lot is protected(grandfathered). However,I have reviewed the site for zoning compliance in terms of historical data and your proposed use. My findings and comments are as follows: -This lot appears as Lot 2 on an undated plan on file. This plan depicts Lot 1, being 1268 Route 28 and Lot 2, being 1272 Route 28. -The plans depicts Lot 2 as having 11,966 square feet of land area, containing a"wood garage". -A deed dated March 11, 1947 includes the identical dimensions of the lot as the plan, indicating the lot was created sometime before this date. -This lot has historically been zoned for Business Use and currently lies within the B-2,General Business Zoning District. --The lot in question is developed with a building. The site has been used for various mercantile sales uses. Our records contain copies of Certificates of Occupancy for these uses. The records also show the site was once used as accessory to the adjoining lot, 1268 Route 28, because of the nature of a former landscaping use. -The B-2 Zone allows the sale of motor vehicles by Special Permit from the Zoning Board of Appeals and is reflected as an H4 Use, in Zoning Bylaw Table 202.5. It appearing that notice of said hearing has been given by sending notice thereof to the petitioner and all those owners of property deemed by the Board to be affected thereby, and to the public by posting notice of the hearing and published in The Register, the hearing was opened and held on the date stated above. The petitioner requests a Special Permit and/or Variance, in order to be allowed to maintain the existing paved parking area and existing sign at this commercial location. The property is a .27 acre lot, on Route 28, in the B2 zone. The lot has for many years been improved with a"garage" building, which has been used for various commercial ventures. It has had a gravel driveway and parking lot until recently. The petitioner recently had the "existing" driveway and parking area paved. She represents that the pavement does not extend beyond the original gravel parking lot, and actually reduced the size of the parking area along the easterly lot line. Unfortunately, there is no plan showing the prior (or present) parking. Since the petitioner did not consult the Building Department prior to undertaking the improvement the Inspector is unable to verify this assertion. The petitioner has, however, presented letters from persons knowledgeable of the site confirming her claim. The Board received no direct evidence contradicting this claim. The Board finds that, if the petitioners assertion is correct, no relief is needed at this time, because no increase in the parking demand nor in the parking lot is involved. On the evidence presently before the Board, it appears that the petitioner is correct. However, it is impossible for the Board to conclusively make this finding, since the petitioner has not supplied the Board with either a current or a past plot plan. On the issue of the sign, it appears that it meets the size limitations, but not the setback requirements, of the bylaw. The petitioner represents that there has been a sign at this location for many years, and that she has simply changed the interior content portion when she changed -l- the business. She represents that she has applied for a sign permit, but that it remains under consideration, because of the issue of its location. Again, the Board is hampered in its review by the fact that the petitioner has failed to provide the Board with a plot plan of the site. Fortunately, the Town Engineering Department has provided us with a letter and sketch. This indicates that the sign Is located approximately 7.5'over the lot line, into the Route 28 layout. The Board received Ietters of support for the petitioner, indicating the fact that the petitioner had actually improved the appearance of the lot. The Board also received letters of opposition to the petitioner, from the Route 28 Task Force, and from the Planning Board, each emphasizing that any "hardship" which the petitioner may be experiencing should be considered self imposed, since the work was undertaken without the benefit of appropriate permits. The Board agrees with the Planning Board and Route 28 Task Force. The difficulty in this matter is principally the result of the petitioners failure to seek appropriate municipal review prior to undertaking these site alterations. The Board also agrees that no such relief relating to the parking lot, should be granted without first assuring maximum feasible compliance, recognizing that full compliance would not be possible. However, since it appears that no upgrade is required (there is no increase in the parking demand), no upgrade can be addressed at this time. This result is, however, inconclusive, given the incomplete information before the Board. As to the sign, the Board finds that, while the sign structure may have been pre-existing at its present location, it is not likely to have been lawfully placed at this location, 7.5' into the road layout. There is room within the Iot to place the sign(the Engineering Department letter indicates that there is approximately 2' of lawn) within the lot line before reaching the pavement. While moving the sign to this location within the property would not comply with the bylaw, it would be substantially Iess non-conforming than the present location, and would be consistent with the locations of signs on the neighboring properties. A motion was made by Mr. Robertson, seconded by Mr. Campbell, to grant so much of the petition as seeks a Special Permit (§104.3.2 (e)) to relocate the sign from its present location on to the property (between the lot line and the edge of the pavement). As the petitioner has a sign permit application pending, she will modify that application accordingly and proceed with the permitting and relocation forthwith. The members voted unanimously in favor of this motion. A second motion was made by Mr. Robertson, seconded by Mr. Campbell, to Deny without prejudice, so much of the petition as required relief for the pavement of the parking lot. This motion is predicated upon the Boards finding that, based on the evidence presented, it does not appear that any relief is needed in order to maintain the present pavement. However, this motion is not intended to constitute a determination that the present pavement does not require relief, nor is it intended to prevent the petitioner from seeking further relief if and when it may be necessary to do so.
