INFORMATION REQUEST
APPLICATION FOR LAND OF LOW VALUE FORECLOSURE AFFIDAVIT

We have completed a review of your application to foreclose tax titles using the land of low value
procedure authorized by G.L. c. 60, §§ 79 and 80 and the additional information submitted in
response to our Information Request dated October 26, 2018.
However, as detailed below, our review found (1) certain information not included in your application
or in your response to our Information Request, (2) discrepancies between the information in parcel
records and supporting documents or (3) issues regarding parcel eligibility.
Please review our guide on applying for a land of low value affidavit, which includes instructions for
completing the parcel information records.
DLS Review Findings
Parcel ID No.
5169 You have submitted a statement that zoning renders the parcel unbuildable. There
is a provision under G.L. c. 40A, § 6 which allows grandfathering from zoning
changes for existing lots with at least 5000 SF and 50 feet of frontage as follows:
"Any increase in area, frontage, width, yard, or depth requirements of a zoning
ordinance or by-law shall not apply to a lot for single and two-family residential use
which at the time of recording or endorsement, whichever occurs sooner was not
held in common ownership with any adjoining land, conformed to then existing
requirements and had less than the proposed requirement but at least five
thousand square feet of area and fifty feet of frontage." Please provide an
explanation in a document uploaded under"Current Documents"why the parcel
does not fall within the statutory grandfathering langua•e.
Please review these findings and submit the necessary information within 90 days of the date of this
letter. If the information is not received within that time period, we will treat the application as denied
and close our file. You may resubmit the application when you are able to supply the requested
information.
The parcel in the application has been "Unlocked for Community" in Gateway so that you may edit
the parcel record as appropriate. Before resubmitting, please review and update §§ 4, 6a, 6b and any
other information as needed to ensure it is current as of the resubmission date.
