Therefore, we need to determine the ownership history from that time frame forward. -I was able to obtain limited ownership history from the Assessors' records. I then attempted to obtain additional ownership history via the Barnstable Registry of Deeds; specifically, Book 1128, Page 296(1961) and Book 484, Pages 334 and 335(1931). However, when printed,these appear skewed because the words "Not Official" are printed throughout the pages and therefore I am unable to ascertain certain information. -You did include deeds recorded in Book 3024, Page 216 (1979) and Book 12117, Page 141 (1994). However, in reviewing the deed it does not include Lots 66 & 67. The Assessors records also reflect a recording for 6 Vernon St. lots 68,69, 70&71 (lot C)with the same Book, Page and date and also a Trial Court recording Doc. 760243, Cert. 152427, dated March 24, 1999. As you know, Clancy Appraisal submitted a request for a Determination of Buildability at our request. According to the Deed (Book 3024, Page 216), Lots 66 &67 were conveyed from Paul T. Souliotes (sic)to his children (T. Paul, George, Susan, Diane) in 1979. I have attached that deed to this email. Title to Lots 68-71/Parcel C is separate from Lots 66 & 67. The deed to lots 68-71/Parcel C is located at Book 12117, Page 140. For some reason, the Assessor's office lists the deed at 12117, Page 140 as the controlling deed for 66& 67 as well. We noticed this mistake as well, and hired a title company to clarify the issue. Hopefully this assists you in your Determination of Buildability for Lots 66 & 67. Please be advised that I have completed my research of this parcel with respect to its compliance with MGL Chapter 40A, Section 6 and the Town of Yarmouth Zoning Bylaw,Section 104.3.4,paragraphs 1 & 2. My findings and comments are as follows: . -The parcel in question has a combined total of 8,000 square feet of land area and 100 feet of frontage, consisting of lots 66 and 67, created via a 1892 subdivision plan, recorded August 20, 1894. -This parcel became non-conforming in terms of land area in 1950, when the land are requirement increased from 6,500 sq. ft. to 8,500 sq. ft. -Lots 68, 69 and 70 contain a total of 12,000 sq. ft. of land area. -Lot 71/C, contains 6,400 square feet of land area. -Parcel C is included the Quitclaim Deed recorded March 10, 1999,BK12117,PG 140,but I don't find previous deeds that specifically relate to this parcel. -Lots 66 &67 were conveyed into separate ownership on November 29, 1979 via the Quitclaim Deed from Paul Souliotes to his children when the combined land area total was less than the required 15,000 square feet. Accordingly, based on the information provided, I find that Parcel 32 (lots 66 & 67) does not comply with either Paragraph 1 or 2 of Zoning Bylaw Section 104.3.4 nor MGL Chapter 40A, Section 6. I am putting my inquiry in email format per your request. 1) Could you please let me know when the first zoning bylaw was enacted in Yarmouth? What were the minimum requirements for square footage and frontage for a residential lot at this time? Our records indicate the first Zoning Bylaw was in 1946 with residential lot sizes of 6,500 square feet. 2) Could you please confirm whether, in 1950, the square footage requirement for residential lots increased from 6,500 sq/ft to 8,500 sq/ft? The whole Town changed from 6,500 sf to 8,500 square feet in 1950. 3) Could you please let me know what the minimum square footage and frontage requirements for residential lots were in August 1979 ? After 1960, minimum lot sizes varied by various residential areas. Vernon Street is west of Mill Creek where the minimum lot size changed to 10,000 sf in 1960,then to 15,000 sf in 1971 and finally to 25,000 sf in 1987. In 1979 Vernon Street was RD-3, minimum lot size of 15,000 sf for single family and frontage requirements as shown in the attached zoning bylaw excerpt which were in effect for the RD-3 zoning district in August 1979. If there are different requirements for different residential lots(e.g. Residential Zone 1/ Residential Zone 2) in 1950 or in 1979, that's ok. My clients property is located on Vernon Street, close to Lewis Bay.
